Ingingo ya mbere: Icyo aya mabwiriza agamije Aya mabwiriza rusange agenga umurimo w’ibiro by’ivungisha. Ashyiraho ibisabwa mu kwemererwa n’ibindi bisabwa mu gukora umurimo w’ivunjisha. Ingingo ya 2: Ibisobanuro by’amagambo Muri aya mabwiriza rusange, amagambo akurikira asobanura:
1° imari-shingiro: umutungo uhoraho w’abanyamigabane mu buryo bw’imigabane isanzwe yemejwe kandi yishyuwe yose hiyongereyeho amafaranga azigamwe yatangajwe; Having reviewed the Regulation No 01/2017 of 22/02/2017 governing Foreign Exchange Bureaus; The National Bank of Rwanda, hereafter referred to as “the Central Bank”, decrees:
CHAPTER ONE: GENERAL
PROVISIONS
Article One: Purpose
This regulation governs the activity of foreign exchange bureaus. It establishes licensing requirements and other conditions to carry out the “foreign exchange business”.
Article 2: Definitions
In this Regulation, the following words and expressions shall mean:
1° capital: permanent shareholders’ equity in form of issued and fully paid-up shares of common stock plus all disclosed reserves; Revu le Règlement No 01/2017 du 22/02/2017 régissant les bureaux de change ; La Banque Nationale du Rwanda, ci-après dénommée « la Banque Centrale », édicte :
CHAPITRE PREMIER : DISPOSITIONS GENERALES
Article Premier : Objet
Le présent règlement régit l’activité de bureaux de change. Il établit les conditions d’agrément et autres conditions pour exercer l’activité de change.
Article 2 : Définitions
Au sens du présent règlement, les termes et expressions suivants signifient :
1° capital: fonds permanent des actionnaires sous forme d’actions ordinaires émises et entièrement libérées plus toutes les réserves publiées ; 2° ufitanye isano n’ibiro by’ivungisha:
Umuntu ku giti cye cyangwa ikigo gifite ubuzima gatozi ufitanye/gifitanye n’ibiro by’ivunjisha 2° related party: any natural person or legal entity that maintains with a forex bureau at least one of the following relationships:
2° partie apparentée: toute personne physique ou morale qui entretient avec un bureau de change au moins l’une des relations suivantes :

(i) umuntu uri mu nama y’Ubutegetsi cyangwa mu Buyobozi by’ibiro by’ivunjisha; (i) a person who is a member of the Board of Directors or Management of a Forex Bureau; (i) une personne qui est membre du Conseil d’Administration ou de l’Organe de Direction d’un bureau de change; (ii) umuntu ufite imigabane igaragara mu buryo buziguye cyangwa butaziguye mu biro by’ivunjisha; (ii) a person who has a direct or indirect significant shareholding in a forex bureau; (ii) une personne qui, directement ou indirectement, possède des actions dans un bureau de change; (iii) uwashyingiranwe n’uri mu Inama y’Ubutegetsi y’ibiro by’ivunjisha; (iii) a spouse of a member of the Board of Directors of a forex bureau; (iii) le conjoint d’un membre du Conseil d’Administration d’un bureau de change; (iv) uwashyingiranwe n’uri mu Buyobozi bw’ibiro by’ivunjisha; (iv) a spouse of a member of the Management of a forex bureau; (iv) le conjoint d’un membre de l’Organe de Direction d’un bureau de change; (v) uwashyingiranwe n’ufite imigabane mu biro by’ivunjisha; (v) a spouse of a shareholder in a forex bureau; (v) le conjoint d’un d’un actionnaire dans un bureau de change; (vi) umubyeyi cyangwa umwana w’ufite imigabane mu biro by’ivungisha; (vi) a parent or a descendant of a shareholder in a forex bureau; (vi) le parent ou le descendant d’un actionnaire dans un bureau de change; (vii) ufitanye n’uri mu nama y’Ubutegetsi bw’ibiro by’ivunjisha, isano y’ubuvandimwe itaziguye kugarukira ku ku rwego rwa mbere; (vii) a person in direct kinship, at first degree, with a member of the Board of Directors of a forex bureau; (vii) une personne ayant avec un membre du Conseil d’Administration d’un bureau de change, un lien direct de parenté au premier degré;

Official Gazette no. 01 of 07/01/2019 (viii) ufitanye n’uri mu Buyobozi bw’ibiro by’ivunjisha, isano ishingiye ku buvandimwe itaziguye ku rwego rwa mbere; (viii) a person in direct kinship, at first degree, with a member of the Management of a forex bureau; (viii) une personne ayant avec un membre de l’Organe de Direction d’un bureau de change, un lien direct de parenté au premier degré; (ix) ufitanye n’umuntu ufite imigabane mu biro by’ivunjisha, isano y’ubuvandimwe itaziguye ku rwego rwa mbere; (ix) a person in direct kinship, at first degree, with a shareholder in a forex bureau; (ix) une personne ayant avec un actionnaire dans un bureau de change, un lien direct de parenté au premier degré; (x) ikigo cyose uri mu nama y’Ubutegetsi y’ibiro by’ivunjisha abereye umwe mu bagize Inama y’Ubutegetsi; (x) any entity whose member of the Board of Directors is also a member of directors of a forex bureau; (x) toute entité dont un membre du Conseil d’Administration est aussi membre du Conseil d’Administration d’un bureau de change; (xi) ikigo cyose gifite uri mu nama y’ubutegetsi akaba ari no mu buyobozi bukuru bw’ibiro by’ivunjisha (xi) any entity whose member of the Board of Directors is also a member of the Management of a forex bureau; (xi) toute entité dont un membre du Conseil d’Administration est aussi membre de l’Organe de Direction d’un bureau de change; (xii) umunyamigabane uwo ari we wese ufite nibura 10% by’imiganane cyangwa by’uburenganzira bwo gutora, byaba mu buryo buziguye cyangwa butaziguye, yaba wenyine cyangwa abisangiye n’abandi cyangwa akaba ashobora gushyira igitutu ku bagize inama y’ubutegetsi y’ibiro by’ivunjisha; (xii) any shareholder holding directly or indirectly, alone or with others, at least ten (10%) percent of the shares or voting rights or can exert influence is also member of the Board of Directors of a forex bureau; (xii) tout actionnaire, possédant, directement ou indirectement, individuellement ou en copropriété, au moins dix pour cent (10%) des actions ou des droits de vote ou peut exercer une influence sur le conseil d’administration du bureau de change ;

(xiii) any other person whose connection to any forex bureau is, in sole appreciation of the Central Bank, likely to compromise the efficiency expected within the foreign exchange activity in general. (xiv) toute autre personne dont toute relation avec un bureau de change peut, dans l’appréciation de la Banque Centrale, compromettre l’efficacité souhaitée dans l’activité de change en général. 3° ibiro by’ivunjisha: isosiyete ifite uburyozwe bugarukira ku migabane, koperative cyangwa ikigo cya Leta yemerewe/cyemerewe na Banki Nkuru gukora umurimo w’ivunjisha; 3° foreign exchange bureau, forex bureau or bureau de change: a company limited by shares, a cooperative or a Governement institution licensed by the Central Bank to carry out foreign exchange business; 3° bureau de change: une société à responsabilité limiteé par actions, une coopérative ou une institution publique agréée par la Banque Centrale pour exercer des activités de change; 4° umurimo w’ivunjisha: umurimo wo kugura no kugurisha amadovize; 4° foreign exchange business: the business of buying and selling foreign currencies; 4° activite de change: activité d'achat et de vente de devises 5° amadovize bikubiyemo: 5° foreign currency includes: 5° le devise comprend:
(i) inoti, ibiceri cyangwa ibindi bikoreshwa mu kwishyura hakoreshejwe ikoranabuhanga bitari mu rugero rw’ifaranga ry’ u Rwanda kandi byemewe n’amategeko mu bihugu bikoreshwamo (i) banknotes, coins or electronic units of payment in any currency other than Rwandan Francs which are or have legal tender outside Rwanda; (i) Des billets de banque, pièces de monnaie ou des unités électroniques de paiement dans toute autre monnaie que le franc rwandais qui ont cours légal en dehors du Rwanda ; (ii) inyandiko z’imari ziri mu madovize na (ii)financial instruments denominated in foreign currency; and (ii)Les instruments financiers libellés en monnaie étrangère ; (iii) uburenganzira ubwo ari bwo bwose bwo kwakira izo noti cyangwa ibiceri by’amafaranga asigaye kwishyurwa mu kigo (iii) any right to receive such bank notes or coins in respect of any balance at a financial institution located within or outside Rwanda. 8° “umuntu utuye” bikubiyemo: 8° “resident” includes: 8° « resident » comprend :
(i) Umunyarwanda wese uba mu Rwanda; (i) acitizen of the Republic of Rwanda residing therein; (i) Un citoyen de la République du Rwanda y résidant ; (ii) umuntu wese utari umunyarwanda ariko uhaba ku buryo buhoraho kandi wahawe uruhushya rwo gutura mu Rwanda ; (ii) any individual who is not a citizen of the Republic of Rwanda but he/she permanently residing therein and has received the visa for residence; (ii) Toute personne physique qui n’est pas citoyen de la République du Rwanda mais qui y réside de façon permanente et a reçu le visa de résidence ; (iii) Mu gihe cyose yamaze mu mahanga, Umunyarwanda wese wamaze igihe kitarenze amezi cumi n’abiri mu mahanga ; (iii) During their stay, citizens of the Republic of Rwanda staying abroad for a period not exceeding twelve months; (iii) Durant leur séjour à l'étranger, citoyen de la République du Rwanda qui séjournent pour une période n’excédent pas douze mois; (iv) inzego zihagarariye u Rwanda mu mahanga mu rwego rwa politiki cyangwa rw’ubucuruzi zifatwa ko zituye n’abantu bafite ubwenegihugu bw’u Rwanda bakora muri izi nzego hamwe n’abagize imiryango yabo, iyo (iv) Rwandan diplomatic missions or consular offices abroad are considered as residents and persons with Rwandan nationality attached to these institutions and, if they are of Rwandan nationality, members of their families are also considered as residents; (iv) les missions diplomatiques ou les consulats rwandais se trouvant à l’étranger sont considérés comme résidents et les personnes de nationalité rwandaise attachées à ces institutions, si elles sont de nationalité rwandaise, les membres de leurs familles sont également considérés comme des résidents;

Ariko, nyuma yo kubyemererwa mu nyandiko na Banki Nkuru, umuntu usanzwe ufite uruhusha rwo gukora umurimo wo kohereza amafaranga ku rwego mpuzamahanga ashobora gukora umurimo wo kugura no kugurisha amadovize atarinze guhabwa ikindi cyemezo. Ibiro by’ivunjisha bikora indi mirimo y’imari yemewe na Banki Nkuru bigomba kugira imari shingiro itari munsi y’iteganwa kuri buri gikorwa cyemewe na Banki Nkuru. No person shall carry out or purport to carry out a foreign exchange business in Rwanda unless he/she is licensed by the Central Bank in accordance with this regulation. However, subject to written approval by the Central Bank, companies licensed to carry out international money remittance activities may carry out foreign exchange activities without getting a new license for foreign exchange activities. The Foreign exchange bureau that provides other financial services approved by the Central Bank shall maintain the minimum required paid up capital for each approved activity by the Central Bank. Nul ne peut exercer ou prétendre exercer l’activité de change au Rwanda s’il n’est pas agréé par la Banque Centrale en vertu de ce règlement. Néanmoins, à la suite de l’autorisation écrite de la Banque Centrale, une personne qui exerce les activités de transferts d’argent au niveau international peut exercer les activités d’achat et de vente des devises sans toutefois exiger un agrément pour les activités de change des devises. Le bureau de change qui exerce d’autres services financiers agréés par la Banque Centrale doit maintenir un capital minimum exigé pour chaque activité agréée par la Banque Centrale.

Article 4: Category of forex bureaus
Forex bureaus are classified in two categories. Category one (I) Forex Bureaus and Category II Forex Bureaus. The Central Bank shall issue Directive specifying geographical area in which each category of a forex bureau shall operate.

Where the application is rejected, the Central Bank shall notify the applicant in writing with reasons for the rejection. Iyo usaba amaze gukora ibivugwa mu gika kibanziriza iki, abimenyesha Banki Nkuru mu nyandiko akanayisaba ko yakorerwa igenzura ry’ibanze. Iyo Banki Nkuru ibonye urwo rwandiko, mbere yo gutanga uruhushya rwo gukora, ikorera igenzura ry’ibanze ahateganyijwe gukorerwa umurimo w’ivunjisha, hagamijwe gusuzuma ko habereye umurimo w’ivunjisha koko kandi ko hatanyuranyije n’amakuru yatanzwe mu isaba. From the date of reception, by the applicant, specified in paragraph 2 of article 7 of this regulation, the applicant is entitled to a maximum period of 3 months to comply with that letter and prepare the projected working premises appropriate to foreign exchange business. Once the applicant completed works specified in the above paragraph, he/she informs the Central Bank together with requesting for pleriminary inspection. Upon reception of the said letter, the Central Bank shall, before granting a license, conduct preliminary inspection on the projected working premises, to verify if the place is appropriate for the conduct of foreign exchange business and consistent with the information provided in the application. During that process period, the applicant shall not carry out any foreign exchange transaction until granted a written licence by the Central Bank. Après reception de ladite lettre et avant d’octroyer l’agrément , la Banque Central procède à une inspection préliminaire des lieux pour vérifier qu'ils sont appropriés pour la conduite de l’activité de change et qu’ils sont conformes aux informations fournies dans la demande. Au cours de tout ce processus, le requérant ne peut faire aucune transaction de change avant l’octroi d’agrément écrit par la Banque Centrale.

When the Central Bank is satisfied with the documents and other informations given by the applicant, in compliance with the provisions of this regulation, it issues a licence to exercise the activity of foreign exchange. Une fois la Banque Centrale est satisfaite des documents et autres informations fournis par le requérant, conformément aux dispositions du présent règlement, elle délivre l’agrément pour exercer l’activité de change. The license to exercise the activity of foreign exchange shall remain valid unless revoked in accordance with provisions of this regulation. The license cannot be transferred, in anyway, to anyone else, or be pledged. L’agrément délivré reste valable sauf si elle est revoquée conformément aux dispositions du présent règlement. Notwithstanding the definition related to spot exchange transaction, Forex Bureau’s transactions amounting to or above twenty million Rwandan Francs (Frw 20,000,000) or its equivalent shall be transacted through forex bureau banks’ accounts.
Article 12: Avaliable funds at all times
A category one Forex Bureaus is required, to maintain in cash and at all times, the minimum working capital of fourty million Rwandan Francs (Frw 40,000,000) or its equivalent. A category two Forex bureau is required, to maintain in cash and at all times, the minimum working capital of twenty million Rwandan Francs (Frw 20,000,000) in cash at all time. Forex Bureaus of category II are not allowed to open a branch in the area of Forex Bureaus of category I; unless they comply with the minimum required capital of category I Forex Bureaus and have additional capital of Frw 20 million for each branch. The approval of a branch manager shall be based on an analysis of relevant documents provided for in Article 6 (8o ) of the present regulation, which documents shall be submitted together with the application for opening a branch. However, a manager having an Advanced Level certificate of secondary education (A2) with 5 years of experience in forex bureau activities or a diploma (A1) with 2 years of experience in forex bureau activities may be appointed as a manager. The Central Bank has the power to undertake an examination of the operations and affairs of a forex bureau, at any place of business, in order to ensure that the foreign exchange bureau is compliant with legal and regulatory requirements. La Banque Centrale se reserve le pouvoir de procéder à un examen des opérations et des affaires d'un bureau de change, à tout lieu d'affaires, afin de s’assurer que le bureau de change se conforme aux exigences légales et réglementaires. For the purpose of the provisions of the previous paragraph, a forex bureau shall avail to the Central Bank all relevant documents and informations for effective examination. These documments and informations referred to herein shall be forwarded to the Central Bank upon request or remitted to Inspectors at the place of business of the forex bureau. Dans le sens des dispositions de l’alinéa précédent, le bureau de change remet à la Banque Centrale tous les documents et informations nécessaires aux fins d'examen. Ces documents et informations sont transmis à la Banque Centrale sur demande ou remis aux Inspecteurs lors de l’inspection au lieu d’activités du bureau de change.

A licensed forex bureau shall pay, annually and not later than the 30th April, a supervision fee of three hundred thousand Rwanda Francs (Frw 300,000). The annual supervision fee may be modified by the Central Bank from time to time. Le bureu de change agréé doit payer, chaque année et au plus tard le 30 Avril, les frais annuels de supervision de trois cent mille francs Rwandais (300.000 Frw). It may also result in revocation of the license following the provisions of this regulation. Le manquement au payement des frais de supervision conduit aux sanctions pécuniaires. Mais aussi, il peut conduire à la révocation de l’agrément, conformément aux dispositions du présent règlement.

Mu gihe ibiro by’ivunjisha bidakurikije cyangwa binaniwe kubahiriza ingingo z’aya mabwiriza rusange cyangwa n’ibindi byangombwa bisabwa, hakurikijwe uburemere bw’ikosa ryakozwe, bifatirwa ibihano by’imyitwarire mibi bikurikira:
In case a forex bureau violates or fails to comply with provisions of this regulation and any other relevant regulatory requirement, it shall be liable, depending upon the seriousness of the violations, to the following disciplinary measures:
Au cas où un bureau de change contrevient ou omet de se conformer aux dispositions du présent règlement ou de toute autre exigence réglementaire adéquate, il est passible, selon la gravité de la faute commise, des mesures disciplinaires suivantes:

The Central Bank may revoke a forex bureau’s license due to at least one or all of the following reasons:
La Banque Centrale peut révoquer l’agrément du bureau de change pour l’une ou toutes des raisons suivantes:
1° Kunanirwa gutangira gukora mu gihe cy’amezi atandatu uhereye igihe icyemezo cyatangiwe; 1° failure of the forex bureau to commence operations within a period of six months from the date of issuance of the license; 1° ne pas commencer les opérations dans un délai de six mois à compter de la date de livraison du certificat d’agrément; 2° ibiro by’ivunjisha byahagaritse imirimo byemerewe gukora bitarabimenyesheje Banki Nkuru mu nyandiko; 2° the forex bureau has ceased to conduct the authorized activities without disclosing the incident to the Central Bank in writing; 2° le bureau de change a cessé les activites autorisées sans en informer la Banque Centrale par écrit;

Official Gazette no. 01 of 07/01/2019 3° gukoresha imari shingiro mu bindi bikorwa bitaherewe uburenganzira na Bannki Nkuru; 3° deviation of capital in activities other than those authorized by the Central Bank; 3° deviation du capital dans les activités autre que celles authorisées par la Banque Centrale; 4° ibiro by’ivunjisha bikora indi mirimo bitaherewe uruhushya na Banki Nkuru; 4° the Forex bureau undertakes activities other than those approved by the Central Bank; 4° le bureau de change entreprend des activités autres que celles approuvées par la Banque Centrale; 5° abanyamigabane cyangwa ibiro by’ivunjisha ubwabyo byahamijwe n’urukiko rubifitiye ububasha mu Rwanda cyangwa mu mahanga, icyaha cy’iyezandonke cyangwa gutera inkunga iterabwoba cyangwa se ibyo biro by’ivunjisha bishamikiye ku isosiyete yahamwe n’icyo cyaha; 5° the shareholders of the bureau, or the bureau itself, is convicted by any court of competent jurisdiction, in Rwanda or elsewhere, of an offense related to money laundering and/or terrorist/proliferation financing, or is an affiliated or is a subsidiary of a company that has been so convicted; 5° les actionnaires du bureau de change ou le bureau de change lui-même est déclaré coupable par une juridiction compétente au Rwanda ou d’ailleurs d’une infraction en rapport avec le blanchiment d’argent et/ou le financement/la prolifération du terrorisme, ou est une filiale ou un affilié d’une société qui a également été reconnue coupable de telles infractions; 6° ibiro by’ivunjisha byatanze amakuru atariyo mu gihe byasabaga icyemezo cyo gutangira gukora; 6° the forex bureau has made a false or incorrect statement in its application for license; 6° le bureau de change a fait une déclaration fausse ou inexacte dans sa demande d’agrément; 7° ibiro by’ivunjisha byakoresheje impapuro z’impimbano mu mirimo bikora; 7° the forex bureau is using forged or counterfeit documents in its foreign exchange operation; 7° le bureau de change utilise des documents falsifiés ou contrefaits dans ses opérations de change; 8° ibiro by’ivunjisha bitera inkunga cyangwa bigira uruhare mu bikorwa bitemewe n’amategeko; 8° the Forex Bureau is financing or involved in illegal practices; 8° le bureau de change finance ou est impliqué dans des activités illégales; 9° ibiro by’ivunjisha bikomeza kutubahiriza ibisabwa n’amabwiriza ariho; 9° persistent non-compliance with existing regulatory requirements; 9° la non conformité persistante aux exigences règlementaires existantes;

Article 31: Consequence of revocation of a
forex bureau’s license on other licences
Article 31 : Conséquence de la révocation de
l’agrément d’un bureau de change sur d’autres agréments Iyo ibiro by’ivunjisha byambuwe uruhushya rwo gukora kandi byari bifite n’urundi ruhushya rwo gukora imirimo yo kohereza amafaranga ku rwego mpuzamahanga, uko kwamburwa uruhushya rwo gukora umurimo w’ivunjisha bijyana no kwamburwa uruhushya rwo gukora imirimo yo kohereza amafaranga ku rwego mpuzamahanga. When a forex bureau whose license is revoked was also licensed to carry out international money transfers, the revocation of its license as a forex bureau implies also revocation of the license for the money transfers activity. Si le bureau de change dont l’agrément est révoqué et que ce bureau de change était en même temps autorisé d’exercer les transferts d’argent au niveau international, la révocation de l’agrément comme bureau de change implique également la révocation de l’autorisation d’exercer des transferts d’argent internationaux. après révocation d’agrément Umunyamigabane, umuntu ufitanye isano, uri mu nama y’Ubutegetsi n’umuyobozi w’ibiro by’ivunjisha byambuwe uruhushya rwo gukora kubera impamvu z’imiyoborere cyangwa z’imikorere bashobora kwemererwa kongera gukora umurimo w’ivunjisha nyuma y’imyaka itanu kuva bambuwe uruhushya rwo gukora. A shareholder or a related party, a Board member and a management member of a Forex Bureau whose license was revoked for administrative or operational reasons may be authorized to carry out a foreign exchange activity, once again, after a period of 5 years from the license revocation. Un actionnaire ou une partie connexe, un membre du Conseil d’Administration ou un cadre dirigeant d’un Bureau de change dont l’agrément a été révoqué pour des raisons administratives ou opérationnelles peut être autorisé à entreprendre de nouveau l’activité de change après une période de cinq ans à partir de la révocation de l’agrément.

Central Bank shall determine pecuniary sanctions applicable to a forex bureau that violates the provisions of this regulation, instructions and decisions. La Banque Centrale fixe les sanctions pécuniaires applicables à un bureau de change qui viole les dispositions de ce règlement, instructions et décisions. The amount of each penalty shall depend on the nature and seriousness of the violation, according to a scale set out in Appendix IVof this regulation. activités de bureau de change non autorisées Umuntu wese ukora imirimo y’ivunjisha ku butaka bwa Repurika y’u Rwanda, yaba abyikorera cyangwa abikora mu izina ry’undi muntu, atabifitiye uruhushya rwo gukora rutangwa na Banki Nkuru ahanwa hakurikijwe ingingo z’ igitabo cy’amategeko ahana. Any person who engages in forex bureau activities on his own account or on behalf of a third party within the territory of the Republic of Rwanda without license issued by the Central Bank, shall be penalized in accordance with the provisions of the penal code. Toute personne (physique ou morale), agissant pour son propre compte ou pour le compte d'un tiers, qui s'engage dans les activités du bureau de change sur le territoire de la République du Rwanda avant qu’il soit agréé par la Banque Centrale, est punie conformément aux dispositions du code pénal. Ingingo ya 35: Iseswa ry’ibiro by’ivunjisha Article 35: Liquidation of the forex bureau Article 35 : Liquidation du bureau de change Iseswa ry’ibiro by’ivunjisha bikurikiza amategeko abigenga bijyanye n’uko ibiro by’ivunjisha bikora nk’isosiyete, koperative cyangwa ikigo cya Leta, n’Itegeko ryerekeye igihombo cy’isosiyete n’icy’ umuntu ku giti cye; The process of liquidation of a forex bureau shall be in conformity with relevant laws following whether the forex bureau was in form of a company, a cooperative or a public institution, and the law relating to insolvency and bankruptcy; La procédure de liquidation d'un bureau de change doit être faite conformément aux lois en la matière, selon que le bureau de change opérait en tant qu’ une société commerciale, une coopérative ou une institution publique ; ainsi que la Loi relative à l’insolvabilité et à la faillite; Ibiro by’ivunjisha bigomba kubanza kubyemererwa na Banki Nkuru mbere yo gutangira gahunda y’iseswa ku bushake. A forex bureau shall seek for non objection from the Central Bank before it enters into the process of the voluntary liquidation. The Governor of the Central Bank shall issue directives to guide the activities of Forex Bureaus in accordance with this Regulation. Le Gouverneur de la Banque Centrale émet des directives pour guider les activités de bureaux de change conformément au présent Règlement. Ubuyobozi bwa Banki Nkuru bushobora, igihe cyose byaba ngombwa, gufata icyemezo cyo kuba buhagaritse isaba ryose ryerekeye gukora umurimo w’ivunjisha, mu gihe kizwi cyangwa kitazwi. Ingingo ya 37: Ibisabwa ibiro by’ivunjisha bifite amashami Ibiro by’ivunjisha bifite amashami bisabwa kuba bifite imari shingiro y’inyongera kuri buri shami ivugwa muri aya mabwiriza rusange mu gihe cy’amazi atandatu kuvu igihe aya mabwiriza rusange atangarijwe mu igazeti ya Leta. Mu gihe ibiro by’ivunjisha bigaragaje ko hari impamvu zumvikana zituma atashobora kubahiriza igihe kivugwa mu gika kibanziriza iki, Banki Nkuru ishobora kumwongerera igihe kitarengeje amezi atandatu (6). Ingingo ya 38: Itegurwa n’isuzumwa ry’aya mabwiriza Aya mabwiriza yateguwe asuzumwa kandi yemezwa mu rurimi rw’Icyongereza. The Administration of the Central Bank may, any time it may be deemed necessary, decide to suspend applications related to the exercise of the foreign exchange business for a definite or indefinite period.
Article 37: Requirements for forex bureau
with branches
Forex bureaus with branches are required to comply with the additional capital for each branch provided in this regulation within a period of six (6) months from the publication of this regulation in the Official Gazette. Where a forex bureau has a sound reasons preventing, it to comply with the period referred to under the previous paragraph have been given, the Central Bank may extend the compliance deadline for a period not exceeding six (6) months.
Article 38: Drafting and consideration of
this Regulation
This Regulation was drafted, considered and approved in English. L’Administration de la Banque Centrale peut, ẚ tout moment qu’il s’avère nécessaire, décider de suspendre toute sorte de demande relative ẚ l’exercice de l’activité de change pour une période déterminée ou indéterminée.
Article 37 : Exigences pour les bureaux de
change avec des succursales Un bureau de change avec des succursales est tenu de respecter le capital supplémentaire de chaque succursale comme prevu dans le présent règlement avec un délai de six (6) mois à compter de la publication du présent règlement au Journal Officiel. Lorsque le bureau de change prouve qu’il a des raisons valables pouvant l’empêcher de se conformer à la période prévue par l’alinéa précédent, la Banque Centrale peut lui accorder une prolongation de l’échéance de conformité pour une période n'excédant pas six (6) mois.

The regulation No 01/2017 of 22/02/2017 governing Foreign Exchange Bureaus and other previous provisions of regulations or directives contrary to this regulation are hereby repealed.
