CHAPTER ONE: GENERAL
PROVISIONS
Article One: Purpose of this regulation
This regulation determines administrative sanctions applicable to a regulated institution, its board members and its senior managers for violations defined in this regulation.
Article 2: Interpretation
In this Regulation:
(a) “Central Bank” means the National Bank of Rwanda, Supervisory Authority; (b) “senior managers” means the management personnel which are the prévention du blanchiment de capitaux, de financement du terrorisme et de financement de la prolifération des armes de destruction massive ; ÉDICTE LE PRÉSENT RÈGLEMENT :
CHAPITRE PREMIER: DISPOSITIONS GÉNÉRALES

Le présent règlement détermine les sanctions administratives applicables à une institution réglementée, à ses membres du conseil d’administration et ses cadres supérieurs pour les violations définies dans ce règlement.
Article 2 : Interprétation
Dans le présent règlement :
(a) « Banque Centrale » signifie la Banque Nationale du Rwanda, Autorité de Contrôle ; (b) «Cadres supérieurs» signifient le personnel de direction qui est composé

These are:
(i) Chief Executive Officer (CEO) or Managing Director (MD); (ii) Senior executives reporting to the Board or to Board Committees; and (iii) Senior executives reporting to the Chief Executive Officer (CEO) or Managing Director (MD), (c) “regulated institution” means any institution licensed by the Central Bank notably banks, deposit-taking microfinance institutions, non-deposit taking financial service providers, life insurance institutions, pension schemes, trust and company service providers, payment service providers and other financial services providers supervised by Central Bank. de cadres supérieurs de haut niveau de l'institution réglementée. (a) ubugenzuzi bukorerwa ikigo kigenzurwa n’abagenzuzi ba Banki Nkuru bukagaragaza amakosa yakozwe; cyangwa (b) inama itangwa n’inzego zibifitiye ububasha; (c) ingano y’ikigo kigenzurwa bireba; (d) ikigero cy’ingorane z’iyezandonke, cyo gutera inkunga iterabwoba n’icyo gutera inkunga ikwirakwiza ry’intwaro za kirimbuzi; (e) uburemere bw’ikosa ryo kutubahiriza ibiteganywa n’amategeko n’amabwiriza n’ingorane urwego rw’imari rushobora guhura na yo bitewe n’iryo kosa.
CHAPTER II: SANCTIONS
Article 3: Determination of administrative
sanctions
The administrative sanctions is imposed upon the following:
(a) examination of the regulated institution and observance of contraventions by the Central Bank examiners; or (b) recommendation from any other relevant authority; (c) the size of the regulated institution in question; (d) risk rating of money laundering, financing of terrorism and financing the proliferation of weapons of mass destruction; (e) the seriousness of the violation of laws and regulations and the harm that financial sector may suffer due to that violation. CHAPITRE II : SANCTIONS
Article 3 : Détermination de sanctions

Les sanctions administratives sont infligées sur base de ce qui suit :
(a) l'inspection d'une institution réglementée et constatation d’une contravention par les inspecteurs de la Banque Centrale; ou (b) les recommandations des organes compétents; (c) la taille de l’institution réglementée en question ; (d) taux de risque du blanchiment de capitaux, du financement du terrorisme et de la prolifération des armes de destruction massive ; (e) la gravité de la violation des lois et règlements et le préjudice que le secteur financier peut subir en raison de cette violation.

Article 4: Categories of the regulated
Institutions
(1) For the purpose of this regulation, regulated institutions are grouped in the following categories for proportionality purpose:
(a) Category 1: Commercial Banks; (b) Category 2: Cooperative Banks, deposit-taking microfinance Companies, large deposit taking microfinance cooperatives, mortgage banks, large e- money issuers; (c) Category 3: Development banks, life insurers, Pension Schemes and Non￾deposit taking financial service providers subject to anti-money laundering, countering the financing of terrorism or the financing of proliferation of weapons of mass destruction (AML/CFT) obligations;
Article 4: Catégories d’institutions

(1) Aux fins du présent règlement, les institutions réglementées sont regroupées dans les catégories suivantes aux fins de proportionnalité :
(a) Catégorie 1 : Banques commerciales ; (b) Catégorie 2 : Banques coopératives, Sociétés de microfinance de dépôts, Grandes Coopératives de microfinance de dépôts, banques hypothécaires, Grands émetteurs de monnaie électronique ; (c) Catégorie 3 : Banques de développement, assureurs-vie, régimes de retraite et prestataires de service financier ne recevant pas de dépôts qui sont soumis aux obligations de la lutte contre le blanchiment de capitaux, le financement du terrorisme ou le financement de la prolifération des armes de destruction massive (AML/CFT) ;

(2) Ibigo byose bigenzurwa bivugwa mu gika cya (1) cy’iyi ngingo bigumana ubusobanuro bihabwa n’amategeko n’amabwiriza rusange abigenga. Ingingo ya 5 : Ibihano byo mu rwego rw’ubutegetsi bihabwa ikigo kigenzurwa Iyo ikigo kigenzurwa kitubahirije cyangwa kirenze ku biteganwa n’ingingo z’amategeko, iz’amabwiriza rusange, iz’amabwiriza cyangwa ibyemezo byafashwe na Banki Nkuru cyangwa Urwego Rushinzwe Ubutasi (d) Catagory 4: Forex bureau category I, and Remittances service providers; (e) Catetory 5: Deposit taking microfinance Cooperatives, Small E- Money Issuers and Forex bureaus Category II; (f) Category 6: Insurance Brokers and Trust and Company service providers; (g) Category 7: Other Financial Service Providers. (2) All the regulated institutions mentioned in Paragraph (1) of this
Article retain the interpretation as in
their specific laws and regulations.
Article 5: Administrative sanctions against
a regulated institution When a regulated institution violates or fails to comply with the provisions of laws, regulations, directives or decisions of the Central Bank or Financial Intelligence Centre regarding anti-money laundering, combating (d) Catégorie 4 : Bureau de change de Catégorie I et les prestataires de services de transfert d’argent ; (e) Catégorie 5 : Coopératives de microfinance de dépôts, petits émetteurs de monnaie électronique, bureaux de change de Catégorie II ; (f) Catégorie 6 : Courtiers d'assurance et prestataires de services aux sociétés commerciales et fiducies ; (g) Catégorie 7 : Autres prestataires de services financiers. (2) Toutes les institutions réglementées mentionnés ci-dessus conservent les significations définies dans leurs lois et règlements spécifiques.
Article 5 : Sanctions administratives à
l’encontre d’une institution réglementée Lorsqu’une institution réglementée enfreint ou ne respecte pas des dispositions des lois, règlements, des directives ou des décisions de la Banque Centrale ou du Centre de renseignement financier en relation avec la

(a) kwihanangirizwa mu nyandiko ; (b) guhagarika inkunga yose yatangwaga na Banki Nkuru; (c) kubuza ikigo kigenzurwa gutangaza cyangwa kwishyura inyungu buri munyamigabane agenerwa; (d) kubuza ikigo kigenzurwa gushyiraho amashami mashya; (e) kubuza ikigo kigenzurwa gushora imari mu bindi bikorwa cyangwa kwagura ibikorwa biriho; (f) guhagarika ibikorwa byo gutanga inguzanyo, ibyo gushora imari n’ibyo kongera gutanga inguzanyo; (g) kubuza ikigo kigenzurwa kubona indi mitungo binyuze mu kugura, gukodesha, cyangwa mu ikodeshagurisha; the financing of terrorism and financing of proliferation of weapons of mass destruction, commits a fault. The Central Bank may impose one or more of the following sanctions against the institution in question depending on the gravity of the fault; (a) written warning; (b) suspension of all support from the Central Bank; (c) prohibition on declaring or paying dividends to shareholders; (d) prohibition from establishing new branches; (e) prohibition from engaging in new activities or expanding existing activities; (f) suspending of lending, investment and credit extension operations; (g) prohibition from acquiring additional assets through purchase, rent or lease; lutte contre le blanchiment de capitaux, le financement du terrorisme et la prolifération des armes de destruction massive, commet une faute. (a) avertissement écrit ; (b) suspension de tout soutien de la part de la Banque Centrale; (c) interdiction de déclarer ou de verser des dividendes aux actionnaires ; (d) interdiction de créer de nouvelles succursales ; (e) l'interdiction d'exercer de nouvelles activités ou de faire l’extension de celles existantes ; (f) la suspension des opérations de prêt, d'investissement et d'extension de crédit ; (g) l’interdiction d'acquérir des actifs supplémentaires par achat, location ou crédit-bail ;

(h) prohibition from accepting further deposits, insurance premiums or other lines of credit; (i) prohibition from declaring any types of bonuses, severance packages, or other discretionary compensation to Board of Directors; (j) prohibition from declaring any types of salary incentives other than discretionary compensation to senior managers and staff; (k) prohibition of payment of management and technical fees to parent companies and related parties; (l) suspension of the license for a period not exceeding six months; (m) revocation of license (h) l’interdiction d'accepter d'autres dépôts, d’autres primes d’assurance ou d’autres lignes de crédit ; (i) l’interdiction de déclarer différents types de primes, indemnités de départ ou autres rémunérations discrétionnaires auprès du conseil d’administration ; (j) l’interdiction de déclarer tout type de motivation d’ordre salarial, autre que l’indemnité discrétionnaire auprès des cadres supérieurs et au personnel ; (k) l’interdiction de payer les frais de gestion et des frais techniques aux sociétés mères et aux parties apparentées ; (l) suspension de licence d’opération pour une période ne dépassant six mois ; (m) la révocation de la licence d’opération.

(a) Kumwihanangiriza mu nyandiko; (b) Kumuhagarika by’agateganyo; (c) Gukuraho icyemezo kimwemerera gukora mu kigo kigenzurwa; (d) Kumwirukana.

Board of Directors and senior managers If the Central Bank finds that a member of the board of directors or a senior manager of a regulated institution has violated the provisions of the Law on prevention and punishment of money laundering, financing of terrorism and financing of Proliferation of weapons of mass destruction, the regulations and directives implementing measures to combat money laundering and the financing of terrorism, the decisions of the Central Bank in the matter, it may impose one of the following sanctions, taking into account the gravity of the violation committed:
(a) written warning;
(b) suspension;
(c) Revocation of the approval; (d) dismissal.
Article 6 : Sanctions à l'encontre des
membres du conseil d'administration et des cadres supérieurs Si la Banque Centrale constate qu'un membre du conseil d'administration ou un cadre supérieur d'une institution réglementée a enfreint les dispositions de la loi portant prévention et répression du blanchiment de capitaux, du financement du terrorisme et du financement de la prolifération des armes de destruction massive, les règlements et directives de mise en œuvre des mesures de lutte contre le blanchiment d’argent et le financement du terrorisme, ou les décisions de la Banque Centrale en la matière, elle peut lui infliger l’une des sanctions suivantes compte tenu de la gravité de la violation commise:
(a) avertissement écrit ; (b) suspension ; (c) Révocation de l’approbation ; (d) renvoi.

Article 7: Disclosure of violations
(1) If a member of the Board of Directors, a member of senior management who is aware of any violation of the Law on prevention and punishment of money laundering, financing of terrorism and financing of proliferation of weapons of mass destruction, its implementing regulations or directives must immediately disclose the violation to the Central Bank. (2) If the Central Bank finds out that the Board of Directors, a director or a member of the senior management omitted or neglected to disclose to the Central Bank of any violation or any other material act required to be disclosed, Central Bank imposes against him or her one of the sanctions provided in article 6 of this regulation. (3) The Central Bank may also disclose the violations committed by regulated institutions and the imposed sanctions through publication on its official public website.
Article 7 : Révélation de violations
(1) Lorsqu’un membre du conseil d'administration, ou un membre de direction d’une institution réglementée qui est au courant de toute violation de la Loi portant prévention et répression du blanchiment de capitaux, du financement du terrorisme et du financement de la prolifération des armes de destruction massive, ses règlements et instructions d’exécution, doit directement informer la Banque Centrale. (2) Lorsque la Banque Centrale découvre qu’un membre du conseil d’administration, ou un cadre supérieur d’une institution réglementée a omis ou négligé de révéler à la Banque Centrale toute infraction ou tout élément à révéler, elle lui impose l’une des sanctions prévues à l'article 6 du présent règlement. (3) La Banque Centrale peut également divulguer les violations commises par les institutions réglementées et les sanctions imposées en les publiant sur son site internet.

Article 8: Pecuniary sanctions
Without prejudice to the provisions of article 5 and 6 of this regulation, where a regulated institution is in violation with the requirements provided in laws and regulations stated above, the Central Bank imposes to its pecuniary sanctions specified in the appendix attached to this regulation.
Article 9: Recourse against the sanction
A regulated institution may appeal to the Central Bank on pecuniary and/or administrative sanction imposed to it within seven working days counted from the date of receipt of the letter communicating the sanction. The Central Bank decision on the appeal is administratively final.
Article 10: Recovery of sanctioned amount
(1) The pecuniary sanctions are paid to the Central Bank account by the regulated institution voluntarily within a period of ten days upon receipt of the notification letter.
Article 8 : Sanctions pécuniaires
Sans préjudice aux dispositions de l’article 5 et 6 du présent règlement, si une institution réglementée commet une violation de la loi et règlement ci-haut mentionnés, la Banque Centrale lui inflige les sanctions pécuniaires spécifiées dans l’annexe du présent règlement.
Article 9 : Recours contre la sanction
L’institution réglementée peut faire recours contre la sanction pécuniaire et/ou administrative auprès de la Banque Centrale dans un délai de sept jours ouvrables à compter de la date de réception de la lettre indiquant la sanction. La décision de la Banque Centrale sur ce recours est administrativement définitive.
Article 10 : Recouvrement du montant

(1) La sanction pécuniaire est versée volontairement par l’institution réglementée sur le compte de la Banque Centrale endéans dix jours dès la réception de la lettre de notification.

CHAPTER III: FINAL PROVISIONS
Article 11: Repealing provision
The Regulation n° 32/2020 of 08/06/2020 determining administrative sanctions applicable to financial institution for non￾compliance with the prevention of money laundering, financing terrorism and financing of proliferation of weapons of mass destruction requirements and all other prior provisions contrary to this Regulation are repealed.
Article 12: Language provision
This regulation was drafted in English. (2) Lorsque l’institution réglementée ne paie pas volontairement, le montant sanctionné est débuté en faveur de la Banque Centrale par prélèvement automatique sur le compte de l’institution réglementée concernée ouvert à la Banque Centrale ou par une saisie-arrêt sur simple convocation notifiée par un huissier. CHAPITRE III : DISPOSITIONS FINALES
Article 11 : Disposition abrogatoire
Le Règlement n° 32/2020 du 08/06/2020 déterminant des sanctions administratives imposables à une institution financière qui ne se conforme pas aux exigences requises de prévention du blanchiment de capitaux, de financement du terrorisme et de financement de la prolifération des armes de destruction massive et toutes autres dispositions antérieures contraires au présent règlement sont abrogées.

Le présent règlement a été rédigé en anglais.
