The application of Risk Management for PPDPs is reflected in 4 (four) main pillars, namely:
a. active supervision by the Board of Directors, Board of Commissioners, and Sharia Supervisory Board; b. adequacy of Risk Management policies and procedures and the determination of Risk limits;
c. adequacy of the process for Risk identification, measurement, monitoring, and control; and
d. Risk Management information systems, and good internal control systems.
With the issuance of Law Number 4 of 2023 regarding the Development and Strengthening of the Financial Sector, the supervision field for Non-Bank Financial Service Institutions is divided into 2 (two), namely the supervision field for insurance, pension funds, and guarantees; and the supervision field for financing institutions, venture capital companies, microfinance institutions, and other financial service institutions.
To implement the mandate of Article 11 paragraph (5) of Law Number 40 of 2014 regarding Insurance as amended by Law Number 4 of 2023 regarding the Development and Strengthening of the Financial Sector, as well as Article 143 paragraph (4) and Article 269 of Law Number 4 of 2023 regarding the Development and Strengthening of the Financial Sector, the Financial Services Authority issues provisions regarding the application of Risk Management for PPDPs with the aim of ensuring that PPDP Risk Management runs effectively.
Furthermore, the Financial Services Authority has also launched a roadmap for the development and strengthening of the guarantee industry in 2024, which aims to specifically develop guarantee companies regarding the application of Risk-based supervision for guarantee institutions. Supervision of guarantee institutions, which currently still uses compliance-based supervision, will shift to Risk-based supervision.
Generally, this Financial Services Authority Regulation contains main materials including the application of Risk Management, organization and Risk Management functions, management of Risks for business development or expansion, self-assessment and Risk Profile reporting, other provisions, and closing provisions.
Based on the above, it is necessary to refine the provisions by establishing regulations regarding Risk Management in the PPDP sector.
