Regulations Relating to Unfair Terms in Banking Institution Contracts

The Namibian Minister of Finance, on the Bank of Namibia’s recommendation, has promulgated regulations defining and regulating unfair contractual terms in banking transactions. The rules mandate that financial institutions draft agreements in plain English, individually negotiate key provisions, and provide customers with at least five working days to review contracts before signing. Empowered by these provisions, the central bank may investigate consumer complaints, order the cessation or revision of unfair clauses, and require public disclosure of enforcement actions to safeguard customer interests.
