Financings and loan capacity shall be computed in accordance with the provisions of point 2.5.
For the purpose of granting such financings, regardless of the source of resources applied, financial entities must verify that clients have sufficient repayment capacity. To that end, at least two scenarios must be considered in which significant exchange‑rate variations of different magnitudes occur over a term of up to one year.
The financing agreed and the maturities set must be related to the projected income flow in the currency in which the loans are granted, except in the cases provided for in points 2.1.7, 2.1.15 and 2.1.17.
If the purpose is that indicated in point 2.1.14, tax revenues related to foreign trade – income‑tax and value‑added‑tax withheld by the General Directorate of Customs and import‑export duties – must be considered when determining repayment capacity.
Financings may be allocated to the loan capacity of foreign‑currency deposits for the purposes established in point 2.1, transferred by other financial entities, provided that the assignors have complied with the requirements set out in point 2.2.
Financings to debtors classified as “unrecoverable” and recorded in order‑of‑payment accounts, according to the rules on “Minimum Provisions for Uncollectibility Risk”, may not be allocated to the loan capacity of foreign‑currency deposits.
Loan capacity shall be determined for each foreign currency captured and shall result from the sum of deposits and inter‑financial loans received, which have been reported by the granting financial entity as originating from its loan capacity of foreign‑currency contributions, net of the minimum cash requirement on deposits.
Exchange houses and agencies must consider, for the development of the application systems used to process their commercial and management information, the implementation of appropriate controls in line with the legal and regulatory requirements currently established by the Central Bank of the Argentine Republic.
Application systems must have automated controls that minimize errors in data entry, processing and consolidation, in the execution of file and database update processes, and in the output of information.
Data recorded in application systems must be subjected to programmed controls that ensure the integrity, validity and reliability of the processed information, including:
Parameters that limit data entry in the mentioned systems must have appropriate access levels for their update and restrictions on the possibility of being modified through specific functions.
Furthermore, these systems must include programmed controls that limit the modification and deletion of basic and agreed‑upon data of consummated operations, movements and balances.
The application system used for processing foreign‑currency purchase and sale operations must contain validation processes to consult information on natural and legal persons with the “precautionary measures” required by the BCRA.
The client‑application system must possess adequate integrity and validity controls, considering its unique identification and the mandatory data according to current regulations.
All application systems must generate audit logs containing user activities, tasks performed, monetary and non‑monetary functions used, and identify who entered and authorized each transaction. These logs must be reviewed regularly by internal‑control responsible persons. The integrity of the information recorded in these reports must be protected, properly safeguarded and remain recoverable, being kept available for a period not less than 10 years, using non‑re‑usable storage media.
