Effective August 1991, financial entities must maintain a minimum computable equity equal to the greater of a risk-weighted asset formula or specific minimum capital amounts set by Communications B 4336 and B 4489. The regulation introduces a weighting factor of 2 for immobilized assets of new entities during their first year, decreasing annually, and specifies that savings and loan societies and credit boxes must adhere to financial company capital requirements from December 1991. Non-compliance triggers penalties including the appointment of a supervisor, restrictions on rediscount access, maintenance of deposit-to-equity ratios, exclusion from direct central bank operations, and potential revocation of authorization for new entities failing to comply within 60 days. The circular also repeals specific provisions from Circular LISOL-1 and updates capital contribution rules to require cash or national public securities.
