Banks and Trust Companies (Foreign Currency Position) Regulations, 2005

These regulations limit the larger of a licensee's net short or long foreign currency positions to ten percent of its capital base, including all outstanding spot and forward foreign exchange contracts and on and off-balance sheet assets and liabilities. Licensees must immediately notify the Inspector of any contravention and provide specified particulars. The Inspector may require remedial action or vary the foreign currency limit for a specific licensee. Non-compliance with these provisions subjects the licensee to a fine not exceeding five thousand dollars.
