CIRCULAR LETTER OF THE FINANCIAL SERVICES AUTHORITY NUMBER 41 /SEOJK.03/2017
CONCERNING
MAXIMUM LIMIT ON CREDIT PROVISION BY RURAL BANKS
In connection with the Financial Services Authority Regulation Number 49/POJK.03/2017 concerning the Maximum Limit on Credit Provision by Rural Banks (State Gazette of the Republic of Indonesia Year 2017 Number 155, Additional State Gazette of the Republic of Indonesia Number 6098), hereinafter abbreviated as POJK BMPK BPR, and in connection with the transfer of functions, duties, and authority for the regulation and supervision of financial services in the banking sector from Bank Indonesia to the Financial Services Authority, it is necessary to regulate again the implementation provisions regarding the Maximum Limit on Credit Provision by Rural Banks in a Circular Letter of the Financial Services Authority as follows:
I. GENERAL PROVISIONS
-
Rural Banks (BPR) in providing funds need to pay attention to the principle of prudence, inter alia, by diversifying the portfolio of Fund Provision provided so that the risk of such Fund Provision is not concentrated on a specific Borrower or group of Borrowers.
-
In the context of monitoring Fund Provision, BPRs submit reports on the Maximum Limit on Credit Provision (BMPK) periodically to the Financial Services Authority.
-
BMPK reporting is submitted by the BPR headquarters online, which includes data from the headquarters and data from all BPR branches.
II. BMPK CALCULATION
-
BMPK for Credit
The BMPK calculation for Credit is based on the debit balance of all Credits received by the relevant debtor, including the provision of Credit in the name of another debtor used for the benefit of the relevant debtor. For Credit in the form of a current account, the BMPK calculation is based on the highest debit balance in the reporting month.
-
BMPK for Interbank Fund Placement in the Form of Savings
The BMPK calculation for Interbank Fund Placement in the form of savings is based on the highest balance in the reporting month.
-
BMPK for Interbank Fund Placement in the Form of Time Deposits
The BMPK calculation for Interbank Fund Placement in the form of time deposits is based on the nominal amount as stated in all time deposit receipts at the same BPR.
-
BMPK for Fund Provision to Related Parties
The BMPK calculation for Fund Provision to Related Parties is based on the total amount of the debit balance of Related Party Credits and the total nominal amount or debit balance of Interbank Fund Placement (savings, deposits, and Credit) to all other Related Party BPRs, amounting to 10% (ten percent) of the BPR's Capital.
-
BMPK for Interbank Fund Placement at Other Non-Related Party BPRs
The BMPK calculation for Interbank Fund Placement at other Non-Related Party BPRs is based on the total nominal amount or debit balance of Interbank Fund Placement (savings, deposits, and Credit) at each Non-Related Party BPR, amounting to 20% (twenty percent) of the BPR's Capital.
-
Fund Provision in the Form of Credit to One or More Non-Related Party Borrowers Who Are Part of a Non-Related Party Borrower Group
The BMPK calculation for Fund Provision in the form of Credit to one or more Non-Related Party Borrowers who are part of a Non-Related Party Borrower Group is calculated based on the provision of Credit to each Borrower and the provision of Credit to one group of Non-Related Party Borrowers. The BMPK for Credit provision to one group of Non-Related Party Borrowers is 30% (thirty percent) of the BPR's Capital.
III. BMPK VIOLATIONS
-
A BPR is stated to have committed a BMPK violation if there is an excess difference between the percentage of Fund Provision realized against the BPR's Capital and the permitted BMPK. A BPR remains assessed as violating BMPK until such BMPK Violation is resolved.
-
The BPR Capital used in the BMPK calculation is the sum of Core Capital and Supplementary Capital as regulated in the Financial Services Authority Regulation regarding minimum Capital provision requirements and fulfillment of minimum Core Capital for BPRs at the position of the last month before the realization of Fund Provision.
-
In the event of a BMPK Violation consisting of Fund Provision in the form of Credit to one or more Non-Related Party Borrowers who are part of a Non-Related Party Borrower Group, the BMPK Violation is calculated based on the sum of violations for Credit provision to each Borrower and the violation of Credit provision to one group of Non-Related Party Borrowers.
-
BMPK Calculation Examples:
a. Credit with installments where disbursement is done all at once BPR "X" provides a Credit facility with installment payments to debtor A (Non-Related Party) with disbursement done all at once under the following conditions:
- BPR Capital:
a) End of June 2017: Rp1,500,000,000.00 (one billion five hundred million rupiah). b) End of July 2017: Rp1,400,000,000.00 (one billion four hundred million rupiah).
- Non-Related Party BMPK: 20%
a) July 2017: Rp300,000,000.00 (three hundred million rupiah).
(= 20% x Rp1,500,000,000). b) August 2017: Rp280,000,000.00 (two hundred eighty million rupiah).
(= 20% x Rp1,400,000,000.00).
- Credit Facility: Rp400,000,000.00 (four hundred million rupiah).
- Tenor: 18 (eighteen) months.
- Credit Agreement Date: July 14, 2017.
- Credit Realization: One-time Credit disbursement on July 14, 2017.
- Debit Balance:
a) End of July 2017: Rp400,000,000.00 (four hundred million rupiah). b) End of August 2017: Rp350,000,000.00 (three hundred fifty million rupiah).
BMPK Calculation
-
July 2017
Based on the percentage of the debit balance at the time of realization or disbursement of debtor A's Credit, which is Rp400,000,000.00 (four hundred million rupiah) against the BPR Capital at the end of June 2017, which is Rp1,500,000,000.00 (one billion five hundred million rupiah), minus the Non-Related Party BMPK percentage (20%), the result is as follows:
(Rp400,000,000.00 / Rp1,500,000,000.00 x 100%) – 20% = 6.67% Thus, there is a BMPK violation of 6.67% (six point six seven percent).
-
August 2017
Based on the percentage of debtor A's debit balance at the end of August 2017, which is Rp350,000,000.00 (three hundred fifty million rupiah) against the BPR Capital at the end of July 2017, which is Rp1,400,000,000.00 (one billion four hundred million rupiah), minus the Non-Related Party BMPK percentage (20%), the result is as follows:
(Rp350,000,000.00 / Rp1,400,000,000.00 x 100%) – 20% = 5% Thus, there is a BMPK violation of 5% (five percent).
b. Credit with phased disbursement
BPR "Y" provides a Credit facility to debtor B (Related Party) with phased disbursement under the following conditions:
- BPR Capital:
a) End of July 2017: Rp2,000,000,000.00 (two billion rupiah). b) End of August 2017: Rp1,500,000,000.00 (one billion five hundred million rupiah).
- Related Party BMPK: 10%
a) August 2017: Rp200,000,000.00 (two hundred million rupiah).
(= 10% x Rp2,000,000,000.00). b) September 2017: Rp150,000,000.00 (one hundred fifty million rupiah).
(= 10% x Rp1,500,000,000.00).
- Credit Facility: Rp200,000,000.00 (two hundred million rupiah).
- Tenor: 24 (twenty-four) months.
- Credit Agreement Date: August 8, 2017.
- Credit Realization: Phased Credit disbursement
a) Disbursement Stage I, August 8, 2017: Rp100,000,000.00 (one hundred million rupiah). b) Disbursement Stage II, September 8, 2017: Rp100,000,000.00 (one hundred million rupiah).
BMPK Calculation
-
August 2017
Based on the percentage of the debit balance at the time of realization or disbursement of debtor B's Credit Stage I, which is Rp100,000,000.00 (one hundred million rupiah) against the BPR Capital at the end of July 2017, which is Rp2,000,000,000.00 (two billion rupiah), minus the Related Party BMPK percentage (10%), the result is as follows:
(Rp100,000,000.00 / Rp2,000,000,000.00 x 100%) – 10% = -5% Thus, there is no BMPK violation.
-
September 2017
With the realization or disbursement of debtor B's Credit Stage II amounting to Rp100,000,000.00 (one hundred million rupiah), the debit balance becomes Rp200,000,000.00 (two hundred million rupiah). The percentage of this debit balance against the BPR Capital at the end of August 2017, which is Rp1,500,000,000.00 (one billion five hundred million rupiah), minus the Related Party BMPK percentage (10%), yields the following result:
(Rp200,000,000.00 / Rp1,500,000,000.00 x 100%) – 10% = 3.33% Thus, there is a BMPK violation of 3.33% (three point three three percent).
c. Credit with current account facility
BPR "Y" provides a current account Credit facility to debtor C (Non-Related Party) under the following conditions:
- BPR Capital: End of August 2017: Rp1,800,000,000.00 (one billion eight hundred million rupiah).
- Non-Related Party BMPK: 20% or Rp360,000,000 (three hundred sixty million rupiah).
(= 20% x Rp1,800,000,000.00).
- Credit Facility: Rp400,000,000.00 (four hundred million rupiah).
- Tenor: 12 (twelve) months.
- Credit Agreement Date: September 5, 2017.
- Realization of debit balance: In September 2017.
BMPK Violation Calculation
The BMPK calculation is based on the percentage of the highest debit balance in the relevant month (September 2017), which is Rp400,000,000.00 (four hundred million rupiah) against the BPR Capital at the end of August 2017, which is Rp1,800,000,000.00 (one billion eight hundred million rupiah), minus the Non-Related Party BMPK percentage (20%), with the calculation as follows:
(Rp400,000,000.00 / Rp1,800,000,000.00 x 100%) – 20% = 2.22% Thus, there is a BMPK Violation of 2.22% (two point two two percent).
d. Credit provision where individual borrowers do not exceed BMPK but the borrower group exceeds BMPK BPR "X" provides a Credit facility to debtor A (Non-Related Party) and debtor PT B (PT B guarantees the Credit provided by BPR "X" to debtor A) with disbursement done all at once under the following conditions:
- BPR Capital: End of September 2017: Rp3,000,000,000.00 (three billion rupiah).
| Date | Disbursement | Debit Balance |
|---|
| September 8 | Rp370,000,000,- | Rp370,000,000,- |
| September | Rp5,000,000,- | Rp365,000,000,- |
| September | Rp35,000,000,- | Rp400,000,000,- |
| September | Rp15,000,000,- | Rp385,000,000,- |
- Non-Related Party BMPK:
a) Individual Borrower: 20% or Rp600,000,000.00 (six hundred million rupiah).
(= 20% x Rp3,000,000,000.00). b) Borrower Group: 30% or Rp900,000,000.00 (nine hundred million rupiah).
(= 30% x Rp3,000,000,000.00).
- Credit Facility: a) Debtor A: Rp500,000,000.00 (five hundred million rupiah).
b) Debtor PT B: Rp600,000,000.00 (six hundred million rupiah).
- Tenor: Each 24 (twenty-four) months.
- Credit Agreement Date: a) Debtor A, October 16, 2017.
b) Debtor PT B: Rp600,000,000.00 (six hundred million rupiah).
- Credit Realization: Disbursement done all at once
a) Debtor A, October 16, 2017. b) Debtor PT B, October 20, 2017.
BMPK Violation Calculation
-
Individual Borrower BMPK
a) Credit provision by BPR "X" to debtor A amounting to Rp500,000,000.00 (five hundred million rupiah) does not violate BMPK with the calculation as follows:
(Rp500,000,000.00 / Rp3,000,000,000.00 x 100%) – 20% = -3.34%. b) Credit provision by BPR "X" to debtor PT B amounting to Rp600,000,000.00 (six hundred million rupiah) does not violate BMPK with the calculation as follows:
(Rp600,000,000.00 / Rp3,000,000,000.00 x 100%) – 20% = 0%.
-
Borrower Group BMPK
Given that debtor A and PT B meet the criteria for a borrower group, the BMPK calculation is also based on the debit balance of the borrower group, which is Rp1,100,000,000.00 (one billion one hundred million rupiah) (Rp500,000,000.00 + Rp600,000,000.00). The BMPK for Non-Related Party Borrower Groups is 30%. The calculation for this borrower group BMPK is as follows:
(Rp1,100,000,000.00 / Rp3,000,000,000.00 x 100%) – 30% = 6.67%.
Thus, there is a Non-Related Party Borrower Group BMPK Violation of 6.67% (six point six seven percent).
Based on the calculations in items 1) and 2) above, the provision of Credit to each Borrower, namely debtor A and PT B, does not violate BMPK individually, but the borrower group violates BMPK by 6.67% (six point six seven percent).
e. Credit provision and Interbank Fund Placement at other BPRs where individual borrowers exceed BMPK but the borrower group does not exceed BMPK BPR "Y" places its funds at BPR "Z" and provides a Credit facility to debtor PT A (Non-Related Party owning 40% of the shares of BPR "Z") under the following conditions:
- BPR Capital: End of October 2017: Rp5,000,000,000.00 (five billion rupiah).
- Non-Related Party BMPK:
a) Individual Borrower: 20% or Rp1,000,000,000.00 (one billion rupiah).
(= 20% x Rp5,000,000,000.00) b) Borrower Group: 30% or Rp1,500,000,000.00 (one billion five hundred million rupiah) (= 30% x Rp5,000,000,000.00).
- BPR "Y"'s Fund Provision to BPR "Z" consists of:
a) Deposit: Rp500,000,000.00 (five hundred million rupiah), tenor 3 (three) months (November 10, 2017 to February 10, 2018). b) Credit: Rp700,000,000.00 (seven hundred million rupiah).
- BPR "Y" provides Credit to debtor PT A amounting to Rp800,000,000.00 (eight hundred million rupiah).
- Tenor: 36 (thirty-six) months.
- Credit Agreement Date: a) BPR "Z", November 3, 2017.
b) Debtor PT A, November 10, 2017.
- Credit Realization: Disbursement done all at once
a) BPR "Z" on November 3, 2017. b) Debtor PT A on November 10, 2017.
BMPK Calculation:
-
Individual Borrower BMPK
a) Interbank Fund Placement by BPR "Y" at BPR "Z" consisting of a deposit of Rp500,000,000.00 (five hundred million rupiah) and Credit of Rp700,000,000.00 (seven hundred million rupiah), so the total Interbank Fund Placement is Rp1,200,000,000.00 (one billion two hundred million rupiah). The BMPK for Interbank Fund Placement at other BPRs is 20%. The calculation for this Interbank Fund Placement BMPK is as follows:
(Rp1,200,000,000.00 / Rp5,000,000,000.00 x 100%) – 20% = 4%. b) Credit provision by BPR "Y" to debtor PT A amounting to Rp800,000,000.00 (eight hundred million rupiah) does not violate BMPK with the calculation as follows:
(Rp800,000,000.00 / Rp5,000,000,000.00 x 100%) – 20% = -4%.
-
Borrower Group BMPK
Given that debtor PT A and BPR "Z" meet the criteria for a borrower group, the BMPK calculation is also based on the borrower group. Based on the calculation, the BMPK for the borrower group does not violate BMPK because the total debit balance in the form of Credit to each debtor PT A of Rp700,000,000.00 (seven hundred million rupiah) and BPR "Z" of Rp800,000,000.00 (eight hundred million rupiah), totaling Rp1,500,000,000.00 (one billion five hundred million rupiah), does not exceed the BMPK for Non-Related Party Borrower Groups, which is at most 30%, with the calculation as follows:
(Rp1,500,000,000.00 / Rp5,000,000,000.00 x 100%) – 30% = 0%.
Based on the calculations above:
- BPR "Y"'s fund placement at BPR "Z" violates BMPK for Interbank Fund Placement at other BPRs by 4% (four percent).
- BPR "Y"'s Credit provision to debtor PT A does not violate BMPK.
Credit provision to BPR "Z" and debtor PT A as a group of Non-Related Party Borrowers also does not violate BMPK.
f. Credit provision where both individual and borrower group exceed BMPK BPR "B" provides a Credit facility to Non-Related Party debtors PT X and PT Y. PT X and PT Y are owned by Mr. S with 50% share ownership in each PT. Credit disbursement is done all at once under the following conditions:
- BPR Capital: End of November 2017: Rp4,000,000,000.00 (four billion rupiah).
- Non-Related Party BMPK:
a) Individual Borrower: 20% or Rp800,000,000.00 (eight hundred million rupiah).
(= 20% x Rp4,000,000,000.00). b) Borrower Group: 30% or Rp1,200,000,000.00 (one billion two hundred million rupiah).
(= 30% x Rp4,000,000,000.00).
- Credit Facility: a) Debtor PT X: Rp1,000,000,000.00 (one billion rupiah).
b) Debtor PT Y: Rp900,000,000.00 (nine hundred million rupiah).
- Tenor: Each 48 (forty-eight) months.
- Credit Agreement Date: a) Debtor PT X, December 7, 2017.
b) Debtor PT Y, December 15, 2017.
- Credit Realization: Disbursement done all at once
a) Debtor PT X, December 7, 2017. b) Debtor PT Y, December 15, 2017.
BMPK Violation Calculation
-
Individual Borrower BMPK
a) Credit provision by BPR "B" to debtor PT X amounting to Rp1,000,000,000.00 (one billion rupiah) violates BMPK with the calculation as follows:
(Rp1,000,000,000.00 / Rp4,000,000,000 x 100%) – 20% = 5%. b) Credit provision by BPR "B" to debtor PT Y amounting to Rp900,000,000.00 (nine hundred million rupiah) violates BMPK with the calculation as follows:
(Rp900,000,000.00 / Rp4,000,000,000 x 100%) – 20% = 2.5%.
-
Borrower Group BMPK
Given that debtor PT X and PT Y meet the criteria for a Non-Related Party Borrower Group, the BMPK calculation is also based on the borrower group, which amounts to Rp1,900,000,000.00 (one billion nine hundred million rupiah) (Rp1,000,000,000.00 + Rp900,000,000.00). The BMPK for Non-Related Party Borrower Groups is 30%. The calculation for this borrower group BMPK is as follows:
(Rp1,900,000,000.00 / Rp4,000,000,000.00 x 100%) – 30% = 17.5%.
Based on the calculations above:
- Credit provision by BPR "B" to debtor PT X individually violates BMPK by 5% (five percent).
- Credit provision by BPR "B" to debtor PT Y individually violates BMPK by 2.5% (two point five percent).
- Credit provision by BPR "B" to debtors PT X and PT Y as a group of Non-Related Party Borrowers violates the Non-Related Party Borrower Group BMPK by 17.5% (seventeen point five percent).
Thus, the total percentage of BMPK violations committed by BPR "B" is 25% (twenty-five percent).
g. Interbank Fund Placement at other BPRs in the form of time deposits BPR "Y" places its funds in the form of time deposits at BPR "Z" under the following conditions:
- BPR "Y" Capital:
a) End of August 2017: Rp4,900,000,000.00 (four billion nine hundred million rupiah). b) End of September 2017: Rp5,000,000,000.00 (five billion rupiah).
- BMPK for Interbank Fund Placement at other BPRs: 20% (twenty percent)
a) September 2017: Rp980,000,000.00 (nine hundred eighty million rupiah) (= 20% x Rp4,900,000,000.00). b) October 2017: Rp1,000,000,000.00 (one billion rupiah) (= 20% x Rp5,000,000,000.00).
- BPR "Y"'s Fund Provision to BPR "Z" consists of:
a) Deposit I: Rp700,000,000.00 (seven hundred million rupiah) with a tenor of 3 (three) months (July 10, 2017 to October 10, 2017). b) Deposit II: Rp500,000,000.00 (five hundred million rupiah) with a tenor of 1 (one) month (October 2, 2017 to November 2, 2017).
BMPK Violation Calculation
-
September 2017
Based on the percentage of the nominal amount as stated in Deposit I receipt amounting to Rp700,000,000.00 (seven hundred million rupiah) against the BPR Capital at the end of August 2017, which is Rp4,900,000,000.00 (four billion nine hundred million rupiah), minus the BMPK percentage for Interbank Fund Placement at other Non-Related Party BPRs (20%), the result is as follows:
(Rp700,000,000.00 / Rp4,900,000,000.00 x 100%) – 20% = -5.71% Thus, there is no BMPK violation.
-
October 2017
With the placement of Deposit II amounting to Rp500,000,000.00 (five hundred million rupiah) on October 2, 2017, the total placement of deposits at BPR "Z" on that date becomes Rp1,200,000,000.00 (one billion two hundred million rupiah). Thus, the percentage of the nominal amount of this Interbank Fund Placement against the BPR Capital at the end of September 2017, which is Rp5,000,000,000.00 (five billion rupiah), minus the BMPK percentage for Interbank Fund Placement at other Non-Related Party BPRs (20%), yields the following result:
(Rp1,200,000,000.00 / Rp5,000,000,000.00 x 100%) – 20% = 4% Thus, there is a BMPK violation of 4% (four percent).
- Based on the BMPK calculation examples as referred to in Section III item 4, particularly for letters a, c, d, e, and f, in addition to violating BMPK, the BPR also violates Article 3 paragraph (1) of POJK BMPK BPR, which states that BPRs are prohibited from making Credit Agreements that require the BPR to provide funds that will result in a BMPK Violation.
IV. BMPK EXCEEDANCE
-
Fund Provision by a BPR is categorized as a BMPK Exceedance if there is an excess difference between the percentage of Fund Provision realized against the BPR's Capital on the reporting date and the permitted BMPK, and it is not included as a BMPK Violation.
-
BMPK Exceedance can be caused by a decrease in BPR Capital, business merger, business consolidation, business acquisition, changes in ownership structure and/or changes in management that cause changes in Related Parties and/or borrower groups, and/or changes in regulations.
-
Example of BMPK Exceedance Calculation due to Decrease in BPR Capital
BPR "X" provides a Credit facility with installment payments to debtor A (Non-Related Party) with disbursement done all at once under the following conditions:
a. BPR Capital:
- End of August 2017: Rp1,500,000,000.00 (one billion five hundred million rupiah).
- End of September 2017: Rp1,200,000,000.00 (one billion two hundred million rupiah).
b. Maximum Credit Granting Limit for Non-Related Parties: 20% (twenty percent)
- September 2017 amounting to Rp300,000,000.00 (three hundred million rupiah).
(= 20% x Rp1,500,000,000.00).
- October 2017 amounting to Rp240,000,000.00 (two hundred forty million rupiah).
(= 20% x Rp1,200,000,000.00).
c. Credit Facility: Rp300,000,000.00 (three hundred million rupiah).
d. Tenor: 18 (eighteen) months. e. Credit Agreement Date: 15 September 2017. f. Credit Realization: Single disbursement on 21 September 2017. g. Debit Balance:
- As of end of September 2017 amounting to Rp300,000,000.00 (three hundred million rupiah).
- As of end of October 2017 amounting to Rp285,000,000.00 (two hundred eighty-five million rupiah).
Calculation of Maximum Credit Granting Limit Exceedance a. September 2017 Based on the percentage of the debit balance at the time of realization for Debtor A, which was Rp300,000,000.00 (three hundred million rupiah), against the BPR Capital as of the end of August 2017 amounting to Rp1,500,000,000.00 (one billion five hundred million rupiah) minus the percentage of the Maximum Credit Granting Limit for Non-Related Parties (20% (twenty percent)), the result is as follows:
(Rp300,000,000.00 / Rp1,500,000,000.00 x 100%) – 20% = 0% No violation of the Maximum Credit Granting Limit. b. October 2017 Based on the percentage of Debtor A's debit balance at the end of October 2017, which was Rp285,000,000.00 (two hundred eighty-five million rupiah), against the BPR Capital as of the end of September 2017 amounting to Rp1,200,000,000.00 (one billion two hundred million rupiah) minus the percentage of the Maximum Credit Granting Limit for Non-Related Parties (20% (twenty percent)), the result is as follows:
(Rp285,000,000.00 / Rp1,200,000,000.00 x 100%) – 20% = 3.75% Thus, there is an exceedance of the Maximum Credit Granting Limit by 3.75% (three point seven five percent).
