AGREEMENT DESIGNATING TO THE EXECUTIVE COMMISSION FOR VICTIM ASSISTANCE THE FEDERAL PROPERTY KNOWN AS "INTEGRAL ATTENTION CENTER GUANAJUATO - CEAV", WITH A SURFACE AREA OF 556.00 SQUARE METERS, SEGREGATED FROM A LARGER PROPERTY, LOCATED AT GUANAJUATO - JUVENTINO ROSAS STATE HIGHWAY KILOMETER 7.5, NUMBER 120, LA YERBABUENA DELEGATION NEIGHBORHOOD, POSTAL CODE 36259, MUNICIPALITY OF GUANAJUATO, STATE OF GUANAJUATO, WITH FEDERAL REAL ESTATE REGISTRATION 11-11415-3.

VÍCTOR JULIÁN MARTÍNEZ BOLAÑOS, President of the Institute of Administration and Appraisal of National Assets, a decentralized administrative body of the Ministry of Finance and Public Credit, based on the provisions of Articles 2, fraction I, 17, 26, 31, fractions XXIX and XXX of the Organic Law of the Federal Public Administration; Articles 2, fractions II, IV, V, VI and VII, 3, fraction III, 4, first and second paragraphs, 6, fraction XXI, 11, fraction I, 13, 28, fractions I, III and VII, 29, fractions I and V, 61, 62, 66, 70 and 101, fraction V of the General Law of National Assets; Articles 4, section G, fraction V, 48 and 49 of the Internal Regulations of the Ministry of Finance and Public Credit; and Articles 3, fractions VIII, IX and X, 4, fraction I, subsection a) and 6, fractions XXVI and XXXIII of the Regulations of the Institute of Administration and Appraisal of National Assets, and taking into account the following:

CONSIDERATIONS

FIRST.- That among the assets subject to the public domain regime of the Federation, is the federal property known as "Integral Attention Center Guanajuato - CEAV", with a surface area of 556.00 square meters, with Federal Real Estate Registration 11-11415-3, segregated from a larger property, located at Guanajuato - Juventino Rosas State Highway kilometer 7.5, number 120, La Yerbabuena Delegation Neighborhood, Postal Code 36259, Municipality of Guanajuato, State of Guanajuato.

SECOND.- That the ownership of the fraction of the federal property described in the preceding Consideration is evidenced by public deed number 3 dated December 17, 2001, granted before the notary of Licenciado Daniel Chowell Zepeda, Holder of Public Notary Office number 16 of the State of Guanajuato and of the Federal Real Estate, through which the donation contract regarding a surface area of 10,000.00 square meters is recorded, which was celebrated by one part, the Free and Sovereign State of Guanajuato as donor and the Attorney General's Office of the Republic on behalf and representation of the Federal Government as donee, which is registered in the Federal Property Registry under Real Folio 63364, dated April 30, 2002.

THIRD.- That topographic plan number 1 OF 1, prepared at a scale of 1:200 approved and registered under number DRPCI/7269/11-11415-3/2024/T, on April 24, 2024 and certified on April 26, 2024, by the Directorate of Public Registry and Real Estate Control attached to the General Directorate of Real Estate Policy and Management of the Institute of Administration and Appraisal of National Assets, reports the surface area, measurements and boundaries resulting from the topographic survey of the property subject to this Agreement, stating in its notes table that, "... the topographic survey yielded a surface area of 563.224 m2, which with respect to that indicated in the antecedent, a difference of 7.224 m2 was obtained, which is equivalent to a 1.30% increase, therefore, it is within the tolerance limits according to the Technical Specifications and Requirements for the Preparation of Topographic Plans with Cadastral Information to be carried out on properties that are part of the Federal and Para-state Real Estate Heritage, however, the property does not lose its identity with respect to its antecedent".

FOURTH.- That through Administrative Act dated February 29, 2012, the physical and legal delivery was recorded, which was carried out by the then Attorney General's Office in favor of the then Ministry of Public Function, through the Institute of Administration and Appraisal of National Assets, through the then General Directorate of Federal Real Estate Heritage, who in that same act received and delivered physically and legally to the then Social Prosecutor's Office for Victim Assistance the property subject to this Agreement, which is registered in the Federal Property Registry under Real Folio number 63364/1 dated March 21, 2012.

FIFTH.- That through Decree dated January 7, 2014 published in the Official Gazette of the Federation on January 8, 2014, the Social Prosecutor's Office for Victim Assistance of Crimes was transformed into the Executive Commission for Victim Assistance.

SIXTH.- That through letter number 0811-C/0570 dated June 9, 2023, the Director of Architecture and Conservation of Immovable Artistic Heritage of the National Institute of Fine Arts and Literature (INBAL), informed that the property subject to this Agreement, "... does not have a Declaration of Artistic Monument, published through Decree published in the Official Gazette of the Federation, therefore, this Architecture Directorate of INBAL has no influence in issuing a technical opinion on it".

SEVENTH.- That through letter number 401.2C.5-2023/259.5 dated June 13, 2023, the Director of the INAH Center of Guanajuato of the National Institute of Anthropology and History, determined that "... the property in question is a construction and/or building corresponding to the second half of the 20th century, so it does not possess historical monumental quality, also that on site (during the inspection visit) the absence of historical monuments in adjacent immovable properties to the building in question was corroborated, without overlooking that the aforementioned property is outside the polygon of the Historical Monuments Zone of the city of Guanajuato as well as the corresponding to the UNESCO Protection Polygon of the Historic City of Guanajuato and its Adjacent Mines. In this way, it is evident that the property in question is outside the competence of the National Institute of Anthropology and History ...".

EIGHTH.- That through letter number CEAV/DGAYF/2347/2024 dated May 7, 2024, the General Director of Administration and Finance and Real Estate Responsible of the Executive Commission for Victim Assistance, requested that the Administrative Agreement for the Destination of the federal property subject to this Agreement be issued, to continue using it for the operation of administrative offices.

NINTH.- That through letter number DAU/V/45147/2024 dated October 21, 2024, the Director of Urban Administration of the Municipality of Guanajuato, determined that the property subject to this Agreement corresponds to the land use, "... of Administrative offices for public attention of the CEAV is a Conditional use contained in Table No. 2. Of Compatibilities. No. IV. Group. Specialized Urban Equipment".

TENTH.- That the General Directorate of Administration of Federal Real Estate Heritage of the Institute of Administration and Appraisal of National Assets, in accordance with what is provided for in Article 11, fraction V, of the Regulations of this Institute, knew and reviewed from a technical-legal point of view, the operation that is authorized. The legal and technical documentation supporting the legal and administrative situation of the property, as well as of this Agreement, is in the processing file integrated by said General Directorate and was duly compared with that which is in the Federal and Para-state Real Estate Information System. Likewise, and based on Article 9, fraction XIV in relation to Article 11, fraction V of the Regulations of this Institute, the Legal Unit issued an opinion regarding the procedency of this Agreement.

For the above and in accordance with the provisions established in Articles 61, 62, 66 and 70 of the General Law of National Assets, and being the purpose of the Federal Executive the optimal use of the federal real estate heritage, prioritizing public institutions of different levels of Government with federal properties for the provision of public services under their charge, I have deemed it appropriate to issue the following:

AGREEMENT

FIRST.- The federal property known as "Integral Attention Center Guanajuato - CEAV", located at Guanajuato - Juventino Rosas State Highway kilometer 7.5, number 120, La Yerbabuena Delegation Neighborhood, Postal Code 36259, Municipality of Guanajuato, State of Guanajuato, with Federal Real Estate Registration 11-11415-3, with a surface area of 556.00 square meters, is designated to the Executive Commission for Victim Assistance, so that it continues to use it as administrative offices.

SECOND.- If the Executive Commission for Victim Assistance gives the federal property designated to it a use different from that established by this Agreement, without prior authorization from the Ministry of Finance and Public Credit, through the Institute of Administration and Appraisal of National Assets; or if it ceases to use it or no longer needs it, said asset with all its improvements and accessions will be withdrawn from its service to be administered directly by this Institute, in accordance with what is provided in Article 68 of the General Law of National Assets.

THIRD.- In the event that construction, reconstruction, modification, adaptation, conservation, maintenance, repair and demolition works are planned for the designated property, prior to their realization, the Executive Commission for Victim Assistance must manage before local and federal authorities the obtaining of licenses, permits, authorizations or any other similar that is required.

FOURTH.- The Executive Commission for Victim Assistance must guard and supervise the property, being obliged to cover the necessary expenses for its conservation and maintenance, and other inherent services that, in their case, are generated, as well as the corresponding insurance against damage to the property, in accordance with what is provided in Articles 32, fraction IV and 66 of the General Law of National Assets.

FIFTH.- The designation only confers upon the Executive Commission for Victim Assistance the right to use the designated property for the authorized use, but does not transmit ownership of it, nor grants any real right over it, in accordance with what is provided in Article 70 of the General Law of National Assets.

SIXTH.- The Institute of Administration and Appraisal of National Assets, within the scope of its attributes, through the General Directorate of Administration of Federal Real Estate Heritage, will supervise the strict compliance with this Agreement.

This Agreement will enter into force the day following its publication in the Official Gazette of the Federation.
