AGREEMENT designating to the Secretariat of Agriculture and Rural Development the federal property known as "DDR Istmo," with an area of 2,652.635 square meters

AGREEMENT DESIGNATING TO THE SECRETARIAT OF AGRICULTURE AND RURAL DEVELOPMENT THE FEDERAL PROPERTY KNOWN AS "DDR ISTMO," WITH AN AREA OF 2,652.635 SQUARE METERS, LOCATED AT FEDERAL HIGHWAY OAXACA DE JUÁREZ - JUCHITÁN DE ZARAGOZA KM 797, NUMBER 797, COLONIA BARRIO VIXHANA, POSTAL CODE 70760, MUNICIPALITY OF SANTO DOMINGO TEHUANTEPEC, STATE OF OAXACA, WITH FEDERAL REAL ESTATE REGISTRATION NUMBER 20-26300-9.

DR. PABLO ISRAEL ESCALONA ALMERAYA, President of the Institute of Administration and Appraisal of National Assets, a decentralized administrative body of the Secretariat of Finance and Public Credit, pursuant to the provisions of Articles 2, fraction I, 17, 26, fraction VI, 31, fractions XXIX and XXX of the Organic Law of the Federal Public Administration; Articles 2, fractions II, IV, V, VI and VII, 3, fraction III, 4, paragraphs first and second, 6, fraction XXI, 11, fraction I, 13, 28, fractions I, III and VII, 29, fractions I and V, 61, 62, 66, 70 and 101, fraction V of the General Law of National Assets; Articles 4, section G, fraction V, 48 and 49 of the Internal Regulations of the Secretariat of Finance and Public Credit; and Articles 3, fractions VIII, IX and X, 4, fraction I, subsection a) and 6, fractions XXVI and XXXIII of the Regulations of the Institute of Administration and Appraisal of National Assets;

I deem it appropriate to issue this agreement, taking into account the following:

CONSIDERATIONS

FIRST.- That among the assets subject to the public domain regime of the Federation, is the federal property known as "DDR Istmo," with an area of 2,652.635 square meters and Federal Real Estate Registration (RFI) number 20-26300-9, located at Federal Highway Oaxaca de Juárez - Juchitán de Zaragoza Km 797, number 797, Colonia Barrio Vixhana, Postal Code 70760, Municipality of Santo Domingo Tehuantepec, State of Oaxaca.

SECOND.- That the ownership of the federal property described in the preceding Consideration is accredited through Public Deed number 13 dated February 16, 1961, granted before the clerkship of Licenciado Miguel Hernández Méndez, Mixed Judge of First Instance of the Judicial District of Tehuantepec, State of Oaxaca, certified by the receiver's office in the absence of a Public Notary, in which the donation contract celebrated between the Society of Users of the Waters of the River of Tehuantepec and the Constitutional City Council of Tehuantepec, State of Oaxaca, in favor of the then Secretariat of Hydraulic Resources, regarding the property located north of Barrio Vixhana, with an area of 6,730.00 square meters, was recorded. It was registered in the Public Registry of Federal Property under Real Folio number 2936 dated January 21, 1981.

The Public Deed was validated through Agreement with folio number 005/2017 dated January 27, 2017, registered in the Public Registry of Federal Property under Real Folio number 2936/5 dated February 3, 2017.

THIRD.- That Topographic Plan number 001, prepared at a scale of 1:1000, approved and registered under number DRPCPF-4102-2012-T, dated May 30, 2012 and certified on October 7, 2024, by the Directorate of Public Registry and Real Estate Control, attached to the General Directorate of Real Estate Policy and Management of the Institute of Administration and Appraisal of National Assets, records the area, measurements and boundaries resulting from the topographic survey of the property subject to this Agreement, with an area of 2,652.635 square meters.

FOURTH.- That through Administrative Act dated August 26, 2024, the legal, administrative and provisional delivery made by the Institute of Administration and Appraisal of National Assets, a decentralized administrative body of the Secretariat of Finance and Public Credit, in favor of the Secretariat of Agriculture and Rural Development, regarding the property subject to this Agreement, was recorded. This was registered in the Public Registry of Federal Property under Real Folio number 2936/9 dated February 28, 2025.

FIFTH.- That through Land Use Certificate with official number DDU/0209/2024 dated September 4, 2024, the Directorate of Public Works of the Constitutional Municipal City Council of Santo Domingo Tehuantepec, State of Oaxaca, recorded that the authorized land use for the property subject to this Agreement is for offices.

SIXTH.- That through Alignment and Official Number Certificate with official number DDU/0208/2024 dated September 4, 2024, the Directorate of Public Works of the Constitutional Municipal City Council of Santo Domingo Tehuantepec, State of Oaxaca, recorded that the property subject to this Agreement is located at Federal Highway Oaxaca de Juárez - Juchitán de Zaragoza Km 797, Colonia Barrio Vixhana, Municipality of Santo Domingo Tehuantepec, State of Oaxaca, assigning it the official number 797.

SEVENTH.- That through official number 512.-0939-2024 dated October 22, 2024, the General Director of Material Resources, Real Estate and Services attached to the Administration and Finance Unit of the Secretariat of Agriculture and Rural Development, requested the issuance of the Administrative Agreement for the Designation of the federal property subject to this Agreement, to continue using it as administrative offices for the Rural Development District known as Istmo. It also stated, "Under oath of telling the truth, for the purposes of compliance with the provisions of fraction V of Article 62 of the General Law of National Assets, I inform you that based on the documentary background of the file available, the age of the property in question and its architectural configuration, it is considered that it does not meet the characteristics established by the relevant law to be considered a Historical or Artistic Monument," in accordance with what is established in Criteria 2/2011, issued by the Committee of Federal and Parastatal Real Estate Heritage, published in the Official Gazette of the Federation on January 19, 2012.

EIGHTH.- That the General Directorate of Administration of Federal Real Estate Heritage of the Institute of Administration and Appraisal of National Assets, in accordance with what is provided in Article 11, fraction V, of the Regulations of this Institute, knew and reviewed from a technical-legal point of view the operation authorized. The legal and technical documentation supporting the legal and administrative situation of the property, as well as of this Agreement, is in the procedural file integrated by said General Directorate and was duly compared with that in the Federal and Parastatal Real Estate Information System. Likewise, based on Article 9, fraction XIV in relation to Article 11, fraction V of the Institute's Regulations, the Legal Unit issued an opinion deeming the present Agreement procedent.

For the foregoing and in accordance with the provisions established in Articles 61, 62, 66 and 70 of the General Law of National Assets, and being the purpose of the Federal Executive, the optimal use of federal real estate heritage, prioritizing public institutions of different levels of government with federal real estate for the provision of public services under their charge, I have deemed it appropriate to issue the following:

AGREEMENT

FIRST.- The federal property known as "DDR Istmo," located at Federal Highway Oaxaca de Juárez - Juchitán de Zaragoza Km 797, number 797, Colonia Barrio Vixhana, Postal Code 70760, Municipality of Santo Domingo Tehuantepec, State of Oaxaca, with Federal Real Estate Registration (RFI) number 20-26300-9, with an area of 2,652.635 square meters, is designated to the Secretariat of Agriculture and Rural Development, to continue using it as administrative offices for the Rural Development District known as Istmo.

SECOND.- If the Secretariat of Agriculture and Rural Development gives the federal property designated to it a use different from that established by this Agreement, without prior authorization from the Secretariat of Finance and Public Credit, through the Institute of Administration and Appraisal of National Assets; or if it ceases to use it or no longer needs it, said asset with all its improvements and accessions will be withdrawn from its service to be administered directly by this Institute, in accordance with what is provided in Article 68 of the General Law of National Assets.

THIRD.- In case construction, reconstruction, modification, adaptation, conservation, maintenance, repair and demolition works are planned for the designated property, prior to their realization, the Secretariat of Agriculture and Rural Development must manage before local and federal authorities the obtaining of licenses, permits, authorizations or any other similar ones that are required.

FOURTH.- The Secretariat of Agriculture and Rural Development must guard and supervise the property, being obliged to cover the necessary expenses for its conservation and maintenance, and other inherent services that, if any, are generated, as well as the corresponding insurance against damage to the property, in accordance with what is provided in Articles 32, fraction IV and 66 of the General Law of National Assets.

FIFTH.- The Secretariat of Agriculture and Rural Development must carry out actions to guarantee the security and integrity of the persons who use the property subject to this Agreement.

SIXTH.- The designation only confers upon the Secretariat of Agriculture and Rural Development the right to use the designated property for the authorized use, but does not transfer ownership of it, nor grants any real right over it, in accordance with the provisions of Article 70 of the General Law of National Assets.

SEVENTH.- The Institute of Administration and Appraisal of National Assets, within the scope of its attributes, through the General Directorate of Administration of Federal Real Estate Heritage, will supervise the strict compliance with this Agreement.

This Agreement will enter into force the day following its publication in the Official Gazette of the Federation.
