AGREEMENT subdividing the federal property with an area of 172,952

AGREEMENT subdividing the federal property with an area of 172,952.12 square meters,

which forms part of a larger property, identified as the eastern fraction of the rural land,

located on the unnamed street, Ejido Salahua, Municipality of Manzanillo, Colima, pursuant to the title that protects

the property in favor of the Federal Government.

IRENE GRACIELA CORREA PÉREZ, General Director of Real Estate Policy and Management, of the

Institute of Administration and Appraisal of National Assets (INDAABIN), a decentralized body of the Ministry

of

Finance and Public Credit, based on what is established in articles 27 and 132 of the

Political Constitution of the United Mexican States; articles 17, 31 fractions XXIX and XXX of the Organic Law of the

Federal Public Administration; articles 1 fractions I, IV and V, 2 fraction VII, 3 fraction III, 4, 6 fraction VI, 9,

11 fraction I, 28, 29, 40, 42 fraction XV and 48 of the General Law of National Assets, 4, section G, fraction

V of the Internal Regulations of the Ministry of Finance and Public Credit; and 1, 3, 10, fraction XXIV of the

Regulations of the Institute of Administration and Appraisal of National Assets.

CONSIDERING

I. That the ownership of the property subject to this Agreement is evidenced by public deed number three

thousand three hundred sixty-one of December 13, 2002, Volume XXXIX, Thirty-ninth, granted by

the Public Notary Attached to Public Notary Office 3 in the City of Manzanillo, Colima, and Notary of the Federal

Real Estate Heritage, licensed Marcelo Romero Vargas, from the "Real Estate Purchase and Sale Contract",

in which the Housing Institute of the State of Colima sells and delivers an area of 172,952.1200 square

meters of the rural land to the Federal Government, represented by the Navy Secretariat, and that it

is registered in the Federal Property Registry, under Real Folio 72118 and in the

Public Registry of Property and Commerce of Colima, in Real Folio 150898-1 on April 23, 2003.

II. That by Agreement published in the Official Gazette of the Federation, of August 31, 2012, the

Secretariat of the Public Function, assigned to the service of the Navy Secretariat, a fraction of land with

an area of 172,952.12 square meters, as part of a larger property identified as

"Eastern Fraction of the Rural Land", in order for it to be used in the fulfillment of the duties

conferred upon it as a naval residential unit and complementary facilities.

III. That by letter DRM-SCBI-DRCPSM/476 of February 12, 2024 and DRM-DRCPSM/673 of February 27

of 2024, the Real Estate Manager of the Navy Secretariat, requested the General Directorate of

Real Estate Policy and Management, to issue the Administrative Agreement for the Subdivision of the property subject to the

present, to remain divided into 2 fractions of lesser expression, being fraction I under the denomination

"Chandiablo" with a land area of 102,929.7400 square meters and a fraction II identified

as "Property Adjacent to the Naval Hospital of Manzanillo" with an area of 70,022.38 square meters.

IV. That by letter DGDU/DROUMC/JDU/0108/2024 of February 1, 2024, the General Director

of Urban Development of the Municipality of Manzanillo, Colima, states that the properties identified with cadastral

key 07-25-99-751-765-000 and 07-01-90-A11-215-000 were authorized and approved by the Municipal

Cadastral Authority by letter No. CAT 541-2022, dated June 06, 2022, where a copy of the Certified Plan is attached,

being this document that approves the subdivision and which is attached to the present as Annex I.

Likewise, that the property identified with cadastral key 07-01-90-A11-215-000, has a

Partial Urbanization Program approved by the Council of the H. Municipality of Manzanillo, on August 1, 2022 and

subsequently published, in the Official Newspaper of the Constitutional Government of the State of Colima, on September 10

of 2022, also has an authorization for the executive urbanization project folio UR022/2023/PEU of May 19, 2023 and an urbanization and building license simultaneous with folio UR-028/2023/LUES dated May 19, 2023.

That the property identified with cadastral key 07-025-99-751-765-000, does not have any authorization

from the Urbanization Department, remaining in a rural state.

V. That the two fractions regarding which this Agreement is issued are property of the Federal

Government, as has been evidenced in considering I and are adjacent to each other, so

there is no physical, legal or administrative impediment for them to constitute two separate plots in the future.

VI. That regarding federal properties, the Institute of Administration and Appraisal of National Assets

through the General Directorate of Real Estate Policy and Management has the express authority to

issue this Subdivision Agreement in accordance with what is established in article 40 of the General Law

of National Assets and 10 fraction XXIV of the Regulations of the Institute of Administration and Appraisal of National Assets

and other normative provisions and legal precepts cited as the legal basis of the

present act.

VII. That for the reasons stated above, the subdivision of the surface of greater

extension of the titles that protect the property in favor of the Federal Government of 172,952.1200 square

meters of the rural land referred to in Consideration I of the present is considered appropriate, therefore I have deemed it fit to

issue the following:

AGREEMENT

FIRST.- The plot described in Consideration I, consisting of an area of

172,952.1200 square meters of the rural land, is subdivided into two polygons to remain as follows:

• Fraction I (CHANDIABLO) with an area of 102,929.7400 square meters which is identified in

graphic form in the plan registered in the Directorate of the Public Registry and Real Estate Control of the

INDAABIN with number DRPCI/7187/6-3738-0/2023/T plan which is attached in certified copy

as Annex II, with the measurements and boundaries set forth in

the descriptive memory which is attached

as Annex III and which for administrative inventory purposes has been assigned the Federal

Real Estate Registry (RFI) 6-3783-0; and

• FRACTION II (PROPERTY ADJACENT TO THE NAVAL HOSPITAL OF MANZANILLO) with an area of

70,022.38 square meters which is identified in graphic form in the plan registered in the Directorate

of the Public Registry and Real Estate Control of INDAABIN with number DRPCI/7188/6-3958-6/2023/T; plan which is attached in certified copy as Annex IV with the measurements and boundaries

set forth in

the descriptive memory which is attached as Annex V, and which for purposes

of administrative inventory has been assigned the Federal Real Estate Registry (RFI) 6-3958-6

SECOND.- This Agreement shall be registered in the Federal Property Registry and in the

Public Registry of Property and Commerce of the

Government of the State of Colima, in terms of what is

established in articles 42 and 48 of the General Law of National Assets.

THIRD.- Request the corresponding local authorities to carry out the registrations and

annotations appropriate in terms of what is established in article 40 of the General Law of

National Assets.

FOURTH.- The Ministry of Finance and Public Credit through INDAABIN, within the scope of its

attributions, will monitor the strict compliance with this Agreement.

TRANSITORY

ONLY.- This Agreement shall enter into force from its publication in the Official Gazette of the

Federation.
