Amendments to the Regulations of the Bank of Latvia No. 160 "Credit Register Regulations" of 18 January 2018
Issued in accordance with Articles 10, 13, 17, the second part of Article 24 and the first point of the fifth part of Article 31, the fourth part of Article 38, the fourth part of Article 39 and the third part of Article 40 of the Credit Register Law
1.1. replace throughout the text of the regulations the words and numbers "Implementing Regulation No. 680/2014" (in the relevant inflection) with the words and numbers "Implementing Regulation (EU) 2024/3117" (in the relevant inflection);
1.2. replace throughout the text of the regulations the words "regulations on asset quality assessment and provision formation" with the words "Bank of Latvia regulations, which establish credit risk management requirements regarding asset quality assessment and provision formation";
1.3. replace throughout the text of the regulations the words "regulations on the assessment of assets and off-balance sheet liabilities" with the words "Bank of Latvia regulations, which establish credit risk management requirements for credit unions regarding the assessment of assets and off-balance sheet liabilities";
1.4. replace in sub-points 10.1 and 11.1 the words "actual balance" with the words "outstanding principal amount";
1.5. express point 42 in the following wording: "42. The information 'Unified Registration Number' is included in the register if the client or the client's guarantor is a legal entity, sole trader, partnership or apartment owners' association that is a resident (hereinafter collectively – legal entity resident).";
1.6. supplement point 43 with the second sentence in the following wording: "If the client or the client's guarantor is an apartment owners' association, when including the information 'Unified Registration Number' in the register, the identifier assigned by the State Construction Control Bureau is indicated.";
1.7. express the title of sub-section 3.4.1 in the following wording: "3.4.1. Outstanding principal amount of client liabilities (outstanding principal amount)";
1.8. in point 115:
1.8.1. replace the words "actual balance" with the words "outstanding principal amount";
1.8.2. supplement after the word "actual" with the word "principal amount";
1.9. replace in point 180.2 the words "actual balance" with the words "outstanding principal amount";
1.10. express point 189 in the following wording: "189. The information 'Note on project finance loan' is included in the register by a register participant that is a credit institution or a subsidiary of a credit institution registered in Latvia, if the client's liabilities correspond to the case specified in Section 2 'Reporting on financial information in accordance with IFRS' of Annex I of Commission Implementing Regulation (EU) 2024/3117 of 29 November 2024 laying down implementing technical standards with regard to the supervision reporting by institutions and repealing Commission Implementing Regulation (EU) 2021/451 (hereinafter – Implementing Regulation (EU) 2024/3117), and the project finance loan is secured by assets attached to the project and repaid from the cash flow generated by the project.";
1.11. express the second sentence of point 190 in the following wording: "Client liabilities are considered subordinate liabilities in accordance with the definition included in the table of Annex II to Regulation (EU) 2021/379 of the European Central Bank of 22 January 2021 on the balance sheet items of the credit institutions and monetary financial institutions sector (ECB/2021/2).";
1.12. supplement the first sentence of point 193 after the word "balance" with the words and parentheses "(outstanding nominal amount), which includes the outstanding principal amount of the client's liabilities, the amount of overdue interest on the client's liabilities and the amount of other overdue payments on the client's liabilities (hereinafter – actual balance of client liabilities),";
1.13. supplement point 195.1 after the word "used" with the words "registered in Latvia";
1.14. replace in point 222 the words "actual balance" with the words "outstanding principal amount";
1.15. supplement point 226 after the word "credit institution" with the words "or a subsidiary of a credit institution registered in Latvia";
1.16. replace in points 269 and 274 the number and word "Annex V" with the numbers and words "Section 2 'Reporting on financial information in accordance with IFRS' of Annex I";
1.17. replace in sub-point 289.1 the numbers and words "sub-point 3.2.5 of Annex II" with the numbers and words "Section 1 'Reporting on own funds and own funds requirements' of Annex I";
1.18. replace in point 297 the numbers and words "sub-points 3.2.5 and 3.3.3 of Annex II" with the numbers and words "Section 1 'Reporting on own funds and own funds requirements' of Annex I";
1.19. replace in points 328, 331, 337, 339, 341, 342 and 343 the word "five" with the word "three";
1.20. replace in points 383, 384 and 385 the words "actual balance" with the words "outstanding principal amount";
1.21. replace in point 386 the words "participant has concluded an e-contract or" with the words and parentheses "participant's status obtained (by concluding an e-contract) or lost or";
1.22. replace in point 387 the words "actual balance" with the words "outstanding principal amount";
1.23. supplement the regulations with points 441, 442 and 443 in the following wording:
"441. On 1 July 2026, the Bank of Latvia renames the information 'Actual balance of client liabilities' to the information 'Outstanding principal amount of client liabilities'.
The information 'Type of impairment of client liabilities' is included in the register by a subsidiary of a credit institution registered in Latvia, starting from 1 July 2026 (for the status as of 30 June 2026).
If a register participant, a restricted register participant or the State Treasury has included information about client liabilities in the register by 1 July 2026 and on 1 July 2026 these client liabilities have not terminated and the respective rights and obligations or claims have not been transferred to another person, the register participant, restricted register participant or State Treasury must check and update the information 'Type of client liabilities' included in the register by 30 September 2026 in accordance with the changes in the code '80' ('Credit for housing acquisition'), '81' ('Credit for real estate acquisition') or '91' ('Other credits') specified in the 'List of codes for types of client liabilities' (Annex 3).";
1.24. in Annex 3:
1.24.1. express the row providing the description of the client liability type code "80" in the following wording: " Credit for housing acquisition (loan to a household for the acquisition, construction, reconstruction and repair of housing (land, house, apartment intended for human accommodation, as well as economic buildings, for example, basement, garage, shed, barn, etc.), including a loan for improving the economic indicators of housing (for example, installation of solar panels)) 80 ";
1.24.2. express the row providing the description of the client liability type code "81" in the following wording: " Credit for real estate acquisition (loan to a legal entity or a natural person who is a self-employed person for the acquisition, construction, reconstruction and repair of real estate, including a loan for improving the economic indicators of the respective person's real estate) 81 ";
1.24.3. express the row providing the description of the client liability type code "95" in the following wording: " Other credits (a loan that according to this list of codes does not correspond to any other type of client liability, including a credit to a household (including a self-employed person), the purpose of which is to start or promote commercial activity or finance another long-term investment project, and including a credit with which equipment is financed, the operational characteristics (for example, capacity, efficiency) of which are related to the production and sale of electricity, heat energy, biogas or other types of energy resources for commercial activity) 95 ";
1.25. express the row of Annex 24 providing the description of the code "2" for the note on recognition in the balance sheet and off-balance sheet in the following wording: " Client liabilities recognized in the balance sheet or off-balance sheet to the extent of further involvement of the register participant (in accordance with Section 2 'Reporting on financial information in accordance with IFRS' of Implementing Regulation (EU) 2024/3117 Annex I) 2 ";
1.26. express the title row of the columns of Annex 25 providing the descriptions of the codes for sources of client liability impairment in the following wording: " Sources of client liability impairment (in accordance with Section 8 'Reporting on impaired assets' of Implementing Regulation (EU) 2024/3117 Annex I) Code ".
Point 1.19 of these regulations enters into force on 1 April 2026.
Sub-points 1.4, 1.5, 1.6, 1.7, 1.8, 1.9, 1.12, 1.14, 1.15, 1.20, 1.22 and 1.24 of these regulations enter into force on 1 July 2026.
