Application of Host Country National Product Intervention Measures

The MFSA requires the Compliance Function to monitor cross-border business and verify whether host National Competent Authorities have adopted stricter national product intervention measures for Contracts for Differences and Binary Options compared to MFSA rules. The Conduct of Business Rulebook was amended on 11 July 2019 to reflect national measures for Binary Options, and the MFSA is currently amending the rulebook to incorporate national measures for Contracts for Differences. ESMA maintains a continuously updated link disclosing opinions on various national product intervention measures, indicating their similarity to ESMA measures and their effective dates.
