RESOLUTION OF THE BOARD OF DIRECTORS OF THE CENTRAL BANK OF THE REPUBLIC OF UZBEKISTAN
On Approval of the Regulation on the National Information Base of Bank Depositors of the Republic of Uzbekistan and the Procedure for Assigning Unique Numbers to Clients and Maintaining a Register of Bank Accounts

This resolution has lost its force based on the Resolution of the Board of Directors of the Central Bank of the Republic of Uzbekistan dated January 4, 2023, No. 30/18 "On Approval of the Instruction on the Procedure for Opening, Maintaining and Closing Bank Accounts" [resolution] (registration number 3420, 08.02.2023).
Based on Articles 7 and 51 of the Law of the Republic of Uzbekistan "On the Central Bank of the Republic of Uzbekistan", the Board of Directors of the Central Bank of the Republic of Uzbekistan resolves:
Approve the Regulation on the National Information Base of Bank Depositors of the Republic of Uzbekistan and the Procedure for Assigning Unique Numbers to Clients and Maintaining a Register of Bank Accounts (in the new edition) attached to the appendix.
Recognize as having lost its force the Resolution of the Board of Directors of the Central Bank of the Republic of Uzbekistan dated April 22, 2002, No. 10/5 "On Approval of the Regulation on the National Information Base of Bank Depositors of the Republic of Uzbekistan and the Procedure for Assigning Unique Numbers to Clients and Maintaining a Register of Bank Accounts" (May 30, 2002, registration number 1145 - Normative Documents Bulletin, 2002, No. 10).
This resolution enters into force ten days after the day of its state registration by the Ministry of Justice of the Republic of Uzbekistan.

This Regulation establishes the procedure for the formation of the National Information Base of Bank Depositors, assigning unique numbers to bank clients, maintaining a register of their bank accounts, and obtaining information about client accounts in accordance with the Civil Code of the Republic of Uzbekistan code, the Law "On the Central Bank of the Republic of Uzbekistan", the Law "On Banks and Banking Activity" and the Law "On Bank Secrecy".

Section 1. General Provisions

The NIBD is serviced by the Main Center for Informatization (hereinafter referred to as MCI), and its activities are supervised by the Central Bank.
The NIBD stores information about bank clients and their bank accounts without recording balance amounts.
In accordance with the Tax Code of the Republic of Uzbekistan, separate divisions (branches, representative offices) of legal entities bearing the obligation to pay taxes and fees operate under the taxpayer's identification number (TIN); if so, separate unique numbers are assigned to these branches (representative offices).

Commercial banks assign unique numbers to physical persons who have a Personal Identification Number (hereinafter referred to as PIN) within the range from "60000001" to "99999999", preserving uniqueness according to the PIN.

Unique numbers for physical persons who do not have a PIN are assigned by the NIBD.

Client accounts in the NIBD are formed programmatically based on the principle of sequential numbering by currency codes for each balance sheet account, except for budget organizations. When forming accounts of budget organizations, the income (expense) item (section) is indicated instead of the account sequence number. The bank account formed for the client in the NIBD is entered into the bank's database, and they cannot be changed by the bank.
During the process of opening a deposit account (hereinafter referred to as the main deposit account) requested by the client, the bank receives a notification from the NIBD that a unique number has been assigned to the client, informs the client about this, and only then does the client have the right to carry out bank operations on this account.
Accounts of physical persons are entered into the bank's database after being registered in the NIBD.
The provisions of this Regulation related to legal entities, peasant farms operating without forming a legal entity, and individual entrepreneurs do not apply to the accounts of physical persons.

Dates for opening accounts in the NIBD, transferring to another bank, closing, temporarily suspending fund removal operations, and restoring them are formed and transmitted to banks. They are entered programmatically into the bank's database and cannot be changed by the bank.
Information exchange between banks of the Republic of Uzbekistan and the NIBD is based on the request file principle and is carried out through the MCI's email system.
After requests are sent to the NIBD, the MCI sends a confirmation to the bank regarding the transmission of the file to the NIBD.
All types of requests arriving at the NIBD from banks are processed programmatically on the same day.
Information on all request types processed during the day is sent by the NIBD to banks for comparison at the end of the banking day.

Request types sent by physical persons to the NIBD consist of the information specified in Appendix 12 of this Regulation.
When forming data in the NIBD, data from the "Electronic Government" system and electronic information systems of state bodies maintaining the database may be used.

All data in response files received from the NIBD are compared again at the bank with the originals of documents submitted by the client. If errors are detected, erroneous data is eliminated, and a request is resent to the NIBD.
When the activities of a bank or bank branch are terminated, all accounts of clients in the terminating bank must be closed in advance or, before the termination of bank activities, the main account must be transferred to the corresponding bank branch or another bank by sending request No. 6 to the NIBD.
The fee for services indicated in requests is specified in the contract concluded between the bank and the MCI.
Persons guilty of disclosing information in the NIBD, including information considered bank secrecy, in violation of legislation, are liable in the established order.
Section 2. Functions of the NIBD
a) ensuring the formation, storage, replenishment, and active maintenance of the information base of bank depositors;
b) exchanging electronic information on bank depositors' accounts and depositor types with relevant state authorities in cases provided for by legislation, while observing bank secrecy;

c) ensuring the accurate execution of interbank electronic payments;
d) responding to bank requests;
e) timely updating the information base in accordance with bank data;
f) rapid search for requested information;
g) organizing the archive of the information base and storing it for the specified period;
h) maintaining an electronic log of the system's operational performance;
i) ensuring the protection of received, sent, processed, and stored information;
j) fully providing banks with information about their clients and their bank accounts in case of emergencies;
k) providing information about depositors registered in the NIBD and their bank accounts based on written requests of relevant state authorities in cases provided for by legislation.

Section 4. Types of Requests (Responses) Sent to/from the NIBD

Request Type 0. "Client Identification"
This request is formed when opening an account for a client before assigning a unique number to them, and is used to determine whether the client previously received a unique number from the NIBD and was registered, and whether they opened or did not open a bank account in any other bank branch.

Request Type 1. "Assigning Unique Numbers to Clients and Opening the Main Deposit Account"
Request Type 1 is intended for assigning unique numbers to bank clients in the NIBD when opening their initial main deposit account in national currency. This request is formed only if the client has not previously received a unique number from the NIBD.
If separate divisions (branches, representative offices) of legal entities operate with a TIN, when forming Request Type 1 for the NIBD, information and the TIN from the certificates of these branches (representative offices) are indicated, and additionally, the name, unique number, and TIN of the head enterprise must be indicated.
In other cases, for branches (representative offices), Request Type 2 "0" indicator is formed for the NIBD, and an account is opened with the unique number and TIN of the head enterprise, and the remaining information is formed programmatically in the NIBD.

Request Type 2. "Opening Accounts for Clients with Their Unique Numbers"
Request Type 2 is used when banks open accounts for clients with their unique numbers.
The existence of client accounts in the NIBD is checked, all accounts of the client opened according to the balance sheet account and currency code indicated in the request are displayed, the account is formed, and the response file is returned to the bank.
If the client's main deposit account is closed, secondary deposit accounts for the client are not opened in other branches of the bank or other banks, and a response with a non-execution indicator is returned to the bank. Similarly, if fund removal operations from accounts are temporarily suspended, secondary deposit accounts for the client are not opened in other branches of the bank or other banks (accounts opened based on documents of the President and Government of the Republic of Uzbekistan, credit (loan), 22600 (except 22696), 23100, 23200 (except 23206), and 23500 accounts are exceptions), and a response with a non-execution indicator is returned to the bank.

Request Type 3. "Temporarily Suspending Fund Removal Operations from Accounts and Information on Account Status"
Request Type 3 is formed by the bank to temporarily suspend fund removal operations from accounts based on documents provided for by legislation, and to transmit relevant information to users using the NIBD database regarding their status.
A request to temporarily suspend fund removal operations from all accounts is formed only by the bank that opened the main deposit account, in cases provided for by legislation.
Only the bank servicing a specific account can form a request type to temporarily suspend fund removal operations from that specific account.
All information indicated in Request Type 3 is transmitted to the NIBD for temporarily suspending fund removal operations from a specific account.
When temporarily suspending withdrawal operations from all accounts of a client opened in a specific balance account, the currency code is transmitted as 'VVV', and the account sequence number is entered as three zeros — '000'. If it is necessary to temporarily suspend withdrawal operations from all accounts of a client in a specific currency, the relevant currency code is transmitted instead of 'VVV'.
When temporarily suspending withdrawal operations from all accounts of a client in all currencies, five zeros — '00000' are entered instead of the balance account, 'VVV' instead of the currency code, and three zeros — '000' instead of the account sequence number.
After the Type 3 query is processed in the NIB database, the status of the accounts changes from 'active' to 'temporarily suspended'. The bank that formed the Type 3 query receives a response with the list of accounts and banks, and withdrawal operations from the accounts are suspended. At the same time, banks that have temporarily suspended withdrawal operations from accounts based on a request from another bank are sent response files (for updating the banks' databases) containing the following:
a) the code of the bank that sent the request to temporarily suspend withdrawal operations;
b) the basis for temporarily suspending withdrawal operations;
c) the date the basis was provided;
d) the symbol indicating that withdrawal operations from the account were temporarily suspended;
e) the client's account;
f) the date withdrawal operations from the account were temporarily suspended;
g) the date of the last activity.
Upon receiving information from the NIB that withdrawal operations from a client's bank account have been temporarily suspended, the date of temporary suspension of withdrawal operations is entered into the bank's database automatically. Withdrawal operations on these accounts are temporarily suspended until information is received about activating the accounts, or based on a justified electronic appeal from the bank that opened the main account, funds from secondary accounts are transferred to the main account.
Responsibility for the transfer of funds from secondary accounts to the main account without the client's consent (except in cases established by legislation) lies with the bank that sent the electronic appeal.
In accordance with the Regulation approved by Resolution No. 704 of the Cabinet of Ministers of the Republic of Uzbekistan dated August 21, 2019, on the procedure for removing business entities not carrying out financial and economic activities from the state register, if commercial organizations do not receive funds for financial and economic activities into their bank accounts within nine months, commercial banks submit electronic information through the Automated System for Registration and Accounting of Business Entities to the state tax authority at the place of registration within three working days.

The service bank transmits information about this to the NIB, and the NIB transmits an electronic notification to the State Tax Committee on the same day.

In this case, the Type 3 query sent to the NIB database with the "25" symbol contains information only about commercial organizations that have not carried out financial and economic activities for nine months, for state tax authorities.

Type 4 Query. "Activating Accounts with Temporarily Suspended Withdrawal Operations"
The Type 4 query is formed by the bank when permitting withdrawal operations from a client's account that has been temporarily suspended, i.e., when activating. This query type is formed only by banks that sent the Type 3 query to the NIB.
When activating accounts with temporarily suspended withdrawal operations for a specific account, all specified details are included in the Type 4 query.
When activating accounts with temporarily suspended withdrawal operations for all clients' accounts in a specific balance account, 'VVV' is entered instead of the currency code, and three zeros — '000' instead of the sequence number. If it is necessary to activate all accounts of a client in a specific currency, the relevant currency code is entered instead of 'VVV'.
When activating all accounts of a client with temporarily suspended withdrawal operations in all currencies, five zeros — '00000' are entered instead of the balance account, 'VVV' instead of the currency code, and three zeros — '000' instead of the account sequence number.
After the Type 4 query is processed in the NIB database, the status of the accounts changes from 'temporarily suspended' to 'active', and the bank receives a response with the list of banks confirming that accounts with temporarily suspended withdrawal operations have been activated, and withdrawal operations on these accounts are activated. At the same time, banks are sent response files (for updating the banks' databases) containing the following information regarding the activation of accounts with temporarily suspended withdrawal operations based on a request from another bank:
a) the code of the bank that sent the request to activate accounts with temporarily suspended withdrawal operations;
b) the basis for activating accounts with temporarily suspended withdrawal operations;
c) the date the basis was provided;
d) the symbol indicating the reason for activating accounts with temporarily suspended withdrawal operations;
e) the client's account;
f) the date withdrawal operations from the accounts were temporarily suspended;
g) the date accounts with temporarily suspended withdrawal operations were activated.
In this case, the Type 4 query sent to the NIB database with the "26" symbol contains information only about commercial organizations that have not carried out financial and economic activities, regarding the restoration of their activity, for state tax authorities.

Type 5 Query. "Changing Client Information in the NIB"
The Type 5 query is formed only by the bank where the client's main deposit account is opened when any of the information specified in Clause 18 of this Regulation changes.
Information about the client is updated in the NIB through the Type 5 query while preserving all previous historical descriptions.

Type 6 Query. "Transferring the Main Account to Another Bank"
The Type 6 query is formed by the service bank when transferring the client's main deposit account to another bank.
When transferring the client's main deposit account from the service bank to another bank:
a) when the client moves to another bank, the bank transfers the balance in its main deposit account to another bank, i.e., to account 29801 — "Settlements with Clients" specified in the letter of the receiving bank, based on the client's application and the receiving bank's consent letter. It forms the Type 6 query and sends it to the NIB on the same day. Upon receipt of the Type 6 query by the NIB, the account status changes from 'active' to 'being transferred to another bank';
b) before giving consent, the receiving bank accepts the client's application and signature specimen sheet, and must open account 29801 — "Settlements with Clients" in its name to receive the balance of the account being closed. Balances, after arriving in this account, must be sent by the bank receiving the account to the NIB with the Type 2 query marked as 'transferred', i.e., with the "1" symbol, no later than the next working day, based on the client's application and information in the legal entity's file and signature specimen sheet. In this case, the existence of the account according to the requested details by the NIB is checked with the "1" symbol marked as 'transferred', and a new account is opened with the same details (except for the control key);
c) if the bank receiving the main account gives consent to the client and sends the Type 6 query, but does not open the account with the Type 2 query within three bank working days, the NIB sends information to the bank that sent the Type 6 query on the fourth bank working day that the main account was not transferred, and the account status returns from 'being transferred to another bank' to 'active'.

d) when the client's main deposit account is transferred from one bank to another, secondary deposit accounts are not closed, and all information about the main deposit account, except for the control key, is preserved unchanged;
e) after the client's main account is accepted by another bank with the Type 2 query, the bank that sent the Type 6 query from the NIB receives information that the account has been closed and that the account status in the NIB has changed from 'active' to 'transferred to another bank'.

Type 7 Query. "Closing the Client's Account"
The Type 7 query is formed by the bank to close the client's account.
If the client's main deposit account is being closed, all accounts opened with the client's unique number must be closed, regardless of currency; otherwise, the client's main deposit account is not closed.
Before closing the client's main account, the bank sends the Type 8 query to the NIB to obtain information about all accounts opened by the client in other banks and sends letters to these banks via email indicating the document number and date serving as the basis for closing the account.
The bank that received the letter closes the client's secondary accounts based on this letter if there is no balance; if there is a balance in the account, it transfers it to the main account and then closes the account. Banks in other countries and the client themselves are responsible for closing secondary accounts in other banks based on the letter issued by the bank that provided the basis for closing the account.
Upon receipt of the Type 7 query, a response is sent to the service bank on the same day confirming receipt of the request, and no later than the next bank working day, the status of the account indicated in the Type 7 query in the NIB changes from 'active' to 'closed', and information is transmitted to banks about this.
When closing accounts in the NIB, the bank must indicate the relevant symbol from Appendix 1 with the Type 7 query.

Type 8 Query. "Obtaining a List of Accounts Opened by the Client in Other Banks"
The Type 8 query is intended for obtaining a list of all accounts opened by the client in other banks in all currency codes.
To obtain a list of all the client's deposit accounts, the Type 8 query can only be formed by the bank that opened the client's main deposit account.
To obtain a list of the client's main deposit, loan, and special (232XX) transit accounts, the Type 8 query can be sent by all bank branches serving this client. Information obtained about accounts must be kept confidential based on the requirements of the Law "On Bank Secrecy."

To obtain a list of all bank accounts opened by clients in other banks, five zeros — '00000' are transmitted by the bank serving the main requested deposit account instead of the balance account.
The NIB analyzes the query type and sends a response to the bank that sent the request, indicating the requested accounts and bank codes.

Type 9 Query. "Terminating the Activity of the Client's Unique Number"

The Type 9 query may also be formed when unique numbers issued to individual entrepreneurs and peasant farms, who do not have legal entity status, are cancelled, which is carried out only when information is received from the state tax authority that the taxpayer's identification number has been cancelled.
a) the bank that opened the client's main deposit account must obtain a list of all accounts opened by the client in other banks using the Type 8 query;
b) the bank serving the main deposit account must notify banks to close the client's secondary deposit and other accounts (if any) by transferring their balances to the main deposit account due to the termination or reorganization of the client's unique number activity;
c) closing the client's deposit and other accounts is carried out using the Type 7 query;
d) the activity of the client's unique number is terminated using the Type 9 query.

Section 5. Features of Registration and Maintenance of Physical Persons and Their Accounts in the NIB
Physical persons are identified in the NIB based on the Unique State Registration Number (USRN) and information from identity documents.
If the USRN exists, the unique numbers of physical persons do not change when their identity documents change.
If the USRN does not exist, the unique number of a physical person with a unique number changes when their identity document changes.
The cancellation of unique numbers of physical persons is registered in the following cases:
when a physical person dies;
when a physical person without an existing USRN obtains a USRN;
when a physical person with an existing USRN loses citizenship of the Republic of Uzbekistan.
