ESAs Guidelines on templates for explanations and opinions, and the standardised test for the classification of crypto-assets

The European Supervisory Authorities establish templates for the content and form of explanations and legal opinions required under Article 97(1) of Regulation (EU) 2023/1114, alongside a standardised test for the regulatory classification of crypto-assets. Offerors, persons seeking admission to trading, and operators of trading platforms for crypto-assets other than asset-referenced tokens or e-money tokens must use the template in Annex A to provide explanations, while credit institutions and other legal persons offering asset-referenced tokens must use the template in Annex B for legal opinions. Competent authorities and market participants must apply the common approach outlined in the flow chart in Annex C to determine the classification of crypto-assets on a case-by-case basis. These guidelines apply to competent authorities, offerors, and crypto-asset service providers, with an effective date set for two months after publication in all official EU languages.
