Art. 1 BCB Resolution No. 96, of May 19, 2021, published in the Official Gazette of the Union on May 21, 2021, shall enter into force with the following alterations:
“Art. 13. Institutions must close the payment account regarding which they verify:
I - irregularities in the information provided by the holder, considered to be of a serious nature; or
II - provision of services by the holder client that constitute financial or payment services within the scope of the National Financial System or the Brazilian Payments System, without due legal provision or not compliant with the current regulation of the National Monetary Council or the Central Bank of Brazil.
§ 1 Serious nature irregularities include, among others, situations of registration in the Individual Taxpayer Registry – CPF or in the National Registry of Legal Entities – CNPJ defined in a normative instruction of the Federal Revenue of Brazil as:
.................................................................................................................................................
§ 2 The hypothesis of item II of the caput is configured, in a non-exhaustive manner, by the use, by the holder client, of resources held in payment accounts for payments, receipts, or compensation of obligations on behalf of third parties, which may allow the concealment or substitution of financial obligations of these third parties and prevent their identification.
§ 3 The institution must use its own criteria to identify the provisions of item II of the caput, making use, among other things, of information contained in public or private databases.
§ 4 The criteria referred to in § 3 must be documented and approved by the institution's board of directors.
§ 5 Institutions must keep available to the Central Bank of Brazil, for a minimum of ten years, the documentation of the criteria referred to in § 4, as well as documentation related to the closure of payment accounts closed under the hypotheses provided for in this article.” (NR)
Art. 2 This Resolution enters into force on December 1, 2025.
