BOARD RESOLUTION NO. 123/2022

SUBJECT: GENERAL MANAGEMENT – APPROVAL OF THE TABLE OF SERVICE COMMISSIONS AND THE TABLE OF FINES OF THE CENTRAL BANK OF BOLIVIA.

VIEWED:

• The Political Constitution of the State (CPE) of February 7, 2009.
• Law No. 1670 of October 31, 1995, of the Central Bank of Bolivia (BCB).
• The Statute of the BCB approved by Board Resolution No. 095/2022 of October 6, 2022.
• Board Resolution No. 146/2021 of December 21, 2021, which approves the Table of Service Commissions and the Table of Fines of the BCB for the 2022 fiscal year.
• Board Resolution No. 103/2022 of November 8, 2022, which modifies the Table of Service Commissions and the Table of Fines of the BCB for the 2022 fiscal year.
• Report BCB-GOI-SOEXT-DOCC-INF-2022-30 of December 23, 2022, from the Economic Policy Advisory (APEC) and the General Managerates of International Operations (GOI), Treasury (GTES), Monetary Operations (GOM), Financial Entities (GEF), and Administration (GADM).
• Report from the Legal Affairs General Management BCB-GAL-SANO-INF-2022-284 of December 23, 2022.

CONSIDERING:

• That the Political Constitution of the State, in its article 327, determines that the BCB is a public law institution, with legal personality and its own assets.
• That article 3 of Law No. 1670 establishes that the BCB, within the framework of the present Law, will formulate general application policies in monetary, exchange, and payment system matters, for the fulfillment of its object.
• That according to article 29 of Law No. 1670, it establishes the functions of the BCB as Financial Agent of the Government.

• That article 44 of Law No. 1670 establishes that the Highest Authority of the BCB is its Board of Directors, which is responsible for defining its policies, specialized regulations of general application, and internal norms; as well as for establishing administrative, operational, and financial strategies of the BCB, approving their respective short and medium-term programs. For the monitoring and oversight of their execution, it will have independent information, analysis, and audit services.
• That according to article 54, subsection a) of Law No. 1670, it is an attribution of the Board of Directors to issue norms and adopt general decisions that are necessary for the BCB to fulfill the functions, competencies, and powers assigned to it by the present Law.
• That numeral 44) of Article 10 of the Statute of the BCB approved by Board Resolution No. 095/2022, provides that the Board of Directors has the attribution to set the Table of Commissions that the BCB must charge for the services it provides.
• That the Economic Policy Advisory (APEC) and the General Managerates of International Operations (GOI), Treasury (GTES), Monetary Operations (GOM), Financial Entities (GEF), and Administration (GADM), through Report BCB-GOI-SOEXT-DOCC-INF-2022-30, conclude that it is necessary to approve the Table of Service Commissions and the Table of Fines of the BCB, and therefore recommend to the Board of Directors their approval.
• That the Legal Affairs General Management (GAL), through Report BCB-GAL-SANO-INF-2022-284, concludes that the proposal of the APEC, GOI, GTES, GOM, GEF, and GADM is technically justified and there is a need to approve the Table of Service Commissions and the Table of Fines of the BCB, and therefore recommends to the Board of Directors of the Issuing Entity their approval.

THEREFORE,

THE BOARD OF DIRECTORS OF THE CENTRAL BANK OF BOLIVIA

RESOLVES:

Article 1.- Approve the Table of Service Commissions and the Table of Fines of the Central Bank of Bolivia, which form part of this Resolution as an annex.

Article 2.- The Table of Service Commissions and the Table of Fines of the Central Bank of Bolivia will enter into effect from January 1, 2023.

Article 3.- From January 1, 2023, Board Resolution No. 146/2021 and the modification approved by Board Resolution No. 103/2022 of November 8, 2022, are hereby repealed.

Article 4.- The Presidency and General Management are charged with the execution and compliance of this Resolution.
