Central Bank of Jordan Circular No. 5/2025 on Data Protection Officer Appointment Mechanism

The Central Bank of Jordan mandates that banks operating in the Kingdom appoint an internal Data Protection Supervisor and notify the regulator before the individual begins duties. Banks must submit a certified declaration to the Banking Supervision Department by the end of the third quarter of 2025, confirming the supervisor's appointment, independence, and qualifications. Greetings,

In light of the issuance of Personal Data Protection Law No. (24) of 2023, the approval of the Data Protection Supervisor Certification Standards document by the Personal Data Protection Council, and based on the provisions of paragraph (b) of Article (17) of the aforementioned Law, we confirm the following:

  1. The necessity to comply with the aforementioned Law and Document.
  2. Adherence to the attached certification mechanism and other requirements stated in the aforementioned Document regarding the appointment of a Data Protection Supervisor.
  3. Providing the Central Bank of Jordan - Banking Supervision Department with the attached certified declaration within a maximum period of the end of the third quarter of 2025.

Mechanism for Certifying the Data Protection Supervisor for Banks Operating in the Banking Sector:

First: Appointment: The Bank must notify the Central Bank of Jordan of the appointment of an internal Data Protection Supervisor from the bank's staff before commencing their duties, with a commitment to facilitate the Supervisor's work and protect their independence in accordance with Article (5) of the Personal Data Protection Document. The bank must confirm the attachment of the following: a recommendation from the specialized committee emanating from the Board of Directors, the Board of Directors' decision approving the appointment of the Supervisor, and evidence demonstrating the candidate Supervisor's specialized knowledge in data protection (academic qualification certificate / professional certificate / experience certificates) and their integrity (certificate of no criminal record).

Second: Independence: The Data Protection Supervisor reports to the Bank's Board of Directors through one of the specialized committees emanating from the Board of Directors.

Third: Separation: The Bank must notify the Central Bank of Jordan prior to the separation of the Data Protection Supervisor from their work (whether by resignation or termination of services), specifying the date of the end of their work and the reasons for it, emphasizing the necessity that this position remains vacant.

Fourth: Responsibility for Verifying the Continued Suitability of the Data Protection Supervisor: The specialized committee emanating from the Bank's Board of Directors bears the responsibility of verifying, initially and continuously, the suitability of the Data Protection Supervisor for the Bank.

It is noted that the tasks of the aforementioned specialized committee and Board of Directors fall upon the Audit Committee of the foreign bank branch.
