29/12/2010
4.14.1. By decision of the holder.
The holder may, by presentation at the entity, withdraw the total balance (principal and interest) and close their account. The entity will provide confirmation of the respective closure, free of charge to the client.
4.14.2. By decision of the entity.
Proceeding is appropriate when, in the judgment of the financial entity, the client has not complied with the operational conditions detailed in the procedure manual of point 6.10. of Section 6. or in case the account does not show a balance or movements for more than one year.
4.14.2.1. General procedure.
The holders will be notified by mail via certified letter, granting a period of no less than 30 calendar days before proceeding to close the account and transfer the funds to immobilized balances. Additionally, in the communication, reference will be made to the commission to be applied to those amounts and to the effective date.
4.14.2.2. Exception.
In the case of accounts that show balances lower than 50 times the value of the “certified letter plus” (basic service up to 150 grs.) of the Argentine Post, a notice may be issued by means of a general publication, once, in two newspapers circulating in the localities where the offices of the respective entity are located. This publication, which will contain the data indicated in point 4.14.2.1., may be made by each intervening entity, by a group of entities, or by the associations that group them, with express mention of the entities that will apply the provision.
4.14.3. By exceeding the admitted balance.
At the moment it is determined that the limit established in the last paragraph of point 4.7. has been exceeded, the entity will proceed to immediately close the account, transferring the funds to immobilized balances. This will be communicated to the holder by mail via certified letter under the terms established in point 4.14.2.1. Affected holders may only request the opening of a new universal free account after 6 months have elapsed, counted from the closure.
4.15. Deposit guarantee.
The status of the account with respect to the deposit guarantee insurance system will be specified. The incorporation of the corresponding legends will be formulated in accordance with what is established in point 6.4. of Section 6.

4.17. Delivery of the text of the rules.
The complete text of the rules in force at the date of account opening will be delivered to the holder, against a signed receipt. The limits established in point 4.7. and the provision of point 4.14.3. will be especially highlighted. Modifications to said text will be brought to the holder's knowledge, at the first opportunity they visit the entity's offices for any procedure or operation related to their account, through reliable notification or through its inclusion in the account statement.
4.18. Debit card.
At the request of the account holder, a magnetic card must be provided to each holder that allows operating in ATMs and carrying out the other operations provided for, with two magnetic cards being free of charge. Replacements due to demagnetization must not cost the client.

The client's waiver of benefits specifically contemplated in these rules will not be admitted.

To have the posters in the established dimensions, they must enter the exclusive site https://www3.bcra.gov.ar.

6.7.2. Notice to holders.
The application of commissions on immobilized balances will be admitted only to the extent that entities communicate this previously to the holders, referencing their amount -which may not exceed, per calendar month, the value of the postal item “certified letter plus” (basic service up to 150 grs.) of the Argentine Post- and to the effective date which may not be less than 30 calendar days from the communication. Communications will be sent by mail via the aforementioned certified postal item.
6.8. Discriminatory acts.
Entities must adopt the necessary precautions to prevent discriminatory acts against their clientele that originate from any physical disability present in persons, and what is provided in the substantive legislation (articles 52, 54, and 55 of the Civil Code) shall apply, when appropriate.
6.9. Mandatory account closure.
The account must be closed in case of not having recorded movements (deposits or withdrawals made by the holder(s)) or not showing a balance, in both cases for 180 calendar days. Charges for any concept will only be admitted up to the concurrence of the account balance, and under no circumstances may negative balances arise from such a situation. The closure of the account must be communicated in advance to its holders by note sent via certified postal item or, in its case, by means of a summary or statement corresponding to this product or other products the client has in the entity. In the notice to be sent, a period of no less than 30 calendar days must be granted for the client to opt to keep the account, before proceeding to its closure. These provisions will apply to the operations contemplated in this regulation, except those that have a specific treatment to proceed to their closure or whose opening has been ordered by the Judiciary.
6.10. Procedure manual.
Financial entities shall specify in a procedure manual, which must be available to the public, the conditions they will observe for the opening, operation, and closure of savings accounts, basic accounts, universal free accounts, and the special current account for legal entities, which must be based on objective criteria, and may not establish preferential guidelines for persons or companies linked to them, in which regard the definitions adopted by the Central Bank of the Argentine Republic will be taken into account.

6.11. Peso transfer service. Charges and/or commissions.
6.11.1. The charges and/or commissions that financial entities -which possess electronic means such as ATMs and/or “Internet” banking (“home banking”)- apply for the service of transfers between deposit accounts denominated in pesos will be subject to the following maximum limits:
6.11.1.1. 6.11.2. Advertising.
Financial entities -which possess electronic means such as ATMs and/or “Internet” banking (“home banking”)- must display in the headquarters of all their offices, in the places of access to the premises and where account opening procedures are carried out, informational posters -which must not be less than 29.8 cm in base by 42 cm in height- on the costs to be applied on transfers between accounts in pesos, the model of which is found in point 6.12.2. of Section 6.
