Circular addressed to Persons Authorised under the Trusts and Trustees Act providing company services in terms of Regulation 3(1)(a) of the Company Service Providers Act (Exemption) Regulations
The Malta Financial Services Authority (MFSA) requires persons authorized under the Trusts and Trustees Act who provide arranging services for others to act as company directors or secretaries to familiarize themselves with the "Dear CEO Letter" published on July 17, 2026. These authorized persons must undertake a documented gap analysis of their arranging services, considering the findings and recommendations in the Dear CEO Letter and the Thematic Review. The gap analysis should be made readily available to the MFSA upon request. They are also expected to align their arranging services with the MFSA's expectations, implementing corrective measures proportionately.
