Rule · BCB · 26 Nov 1984 · Carta Circular 1131
Commercial banks must ensure bail balances do not exceed five times paid-in capital and reserves, with single-client exposure capped at 50% of that sum. Exceeding these limits requires prior Central Bank authorization. Banks must obtain compatible counter-guarantees and update foreign currency counter-guarantees automatically. Prohibitions include avals, guarantees enabling public fundraising, and foreign currency bails unrelated to foreign trade. Fiscal appeal bails require specific clauses and semesterly progress checks. State or municipal guarantees need National Monetary Council approval.
