Circular Letter No. 2.753

CIRCULAR LETTER NO. 002753 ------------------------ Provides for registration in the RECOR system of rural credit operations extended or renegotiated under Law No. 9.138, of 29.11.95, and Resolution No. 2.238, of 31.01.96. We clarify, at the request of the National Treasury Secretariat (STN), that, for the purposes of issuing public securities and equalizing financial charges of rural credit operations extended or renegotiated under Law No. 9.138, of 29.11.95, and Resolution No. 2.238, of 31.01.96: I - it is essential, in addition to entering into a contract with the STN, to register all operations in the Common Registry of Rural Operations (RECOR) system, observing the specific instructions disclosed; II - the sum of the operations registered in the RECOR system referring to the financial institution's own resources - Mandatory Resources (MCR 6-2), DER, Rural Savings, Free Resources and Off-Market Investment Fund - must correspond to that indicated in the Term of Responsibility presented to the STN, observing the specific payment schemes of each source of resources and, where applicable, the provisions of item 5 of this Circular Letter; III - financial institutions may register or re-register the operations in question in the RECOR system until 15.08.97, without fail, after which the system will be blocked for this purpose; IV - only records entered in the RECOR system by the date provided in the previous item and that meet the regulatory requirements will be considered by the STN. 2. The municipalities that make up the Bahia-Sul, South of Maranhao and South of Piaui regions, cited in item 2, subsection II, of this Circular Letter, are listed in Annex I of Resolution No. 2.332, of 05.11.96 (Bahia-Sul) and, the others, in Title 5, Document No. 10, of the Minimum Price Operations Manual (MOPM), disclosed by the National Supply Company (CONAB). 4. Operations with resources from the National Treasury (TN), without specific linkage to the promotion programs indicated in item 2, subsection III, of this Circular Letter, must be registered or re-registered with the code "2015 - Treasury/Unified Rural Programs (P0099)". 5. Regarding repass operations, the following conditions should be observed: I - credit instruments called "cedulas-filhas": a) must be registered or re-registered by the financial institution responsible for entering the data into the RECOR system - bank or credit union -, mandatorily using a funding source code beginning with the number 5 (five); b) the amounts of these operations must not be computed in the sum of the Term of Responsibility declared to the STN; II - only the amounts of credit instruments called "cedulas-maes" and backed by the financial institution's own funds - Mandatory Funds (MCR 6-2), DER, Rural Savings, Free Funds and Off-Market Investment Fund - must be computed in
the sum of the Term of Responsibility declared to the STN. 6. Financial institutions must: I - pay special attention to filling in field no. 27 of the RECOR system - QUANTITY/UNIT - which must be expressed in kilograms and correspond to the total amount of the credit instrument, as per the guidance contained in Circular Letter no. 2.641/96; II - formally notify the Department of Registration and Information (DECAD) of the Central Bank of Brazil, sending a copy to the STN, of the completion of the registration or re-registration of information in the RECOR system, if it occurred before the deadline referred to in item 1, subsection III, of this Circular Letter. 7.
