CIRCULAR
Regulating the provision of information between the State Bank of Vietnam and the Vietnam Deposit Insurance Agency

Pursuant to the Law on the State Bank of Vietnam No. 01/2010/QH12; Pursuant to the Law on Deposit Insurance No. 01/2024/QH15; Pursuant to Decree No. 26/2025/ND-CP of the Government defining the functions, duties, powers, and organizational structure of the State Bank of Vietnam;

At the proposal of the Director of the Department of Organizational Supervision; The Governor of the State Bank of Vietnam issues the Circular regulating the provision of information between the State Bank of Vietnam and the Vietnam Deposit Insurance Agency.

Chapter I
GENERAL PROVISIONS

Article 1. Scope of regulation
This Circular regulates the principles, scope, content, and methods of providing information between the State Bank of Vietnam (hereinafter referred to as the State Bank) and the Vietnam Deposit Insurance Agency.

Article 2. Subjects of application

1. The State Bank.
2. The Vietnam Deposit Insurance Agency.
3. Other organizations and individuals related to the operations of deposit insurance.

Article 3. Principles of providing, using, and managing information

1. Ensuring the accuracy and timeliness of provided information.
2. Providing, using, managing, and protecting information in accordance with legal regulations.
3. The information provider uses information for the purpose of performing assigned functions and duties.
4. The Vietnam Deposit Insurance Agency shall not provide information provided by the State Bank to third parties, except in cases of providing information to state agencies with competent authority as prescribed by law or according to the instructions of the Governor of the State Bank.

Chapter II
SPECIFIC PROVISIONS

Article 4. Scope of information provision

1. The Vietnam Deposit Insurance Agency is provided with and permitted to exploit information and reports by the State Bank according to the Decision of the Governor of the State Bank on the catalog, indicators, and reports between the State Bank and the Vietnam Deposit Insurance Agency.
2. In cases where the Vietnam Deposit Insurance Agency needs to perform its functions and duties, it may request the State Bank to review and provide other information and reports not included in the Decision of the Governor of the State Bank stipulated in Clause 1 of this Article.
3. The Vietnam Deposit Insurance Agency reports to the State Bank information according to the Decision of the Governor of the State Bank and the catalog, indicators, and reports between the State Bank and the Vietnam Deposit Insurance Agency.
4. When necessary, the Vietnam Deposit Insurance Agency provides other information and reports not stipulated in Clause 3 of this Article upon written request of the State Bank.

Article 5. Methods of information provision

1. The method of providing information between the State Bank of Vietnam and the Vietnam Deposit Insurance Agency is implemented according to the Decision of the Governor of the State Bank on the catalog, indicators, and reports between the State Bank and the Vietnam Deposit Insurance Agency.
2. For information and reports shared from the State Bank via electronic methods, the Vietnam Deposit Insurance Agency exploits them according to the guidance of the Information Technology Department.

Article 6. Network and procedures for electronic information provision

1. The head office of the Vietnam Deposit Insurance Agency connects its transmission network with the State Bank (Information Technology Department) and must have a plan to ensure the security of sending information and reports to the State Bank.
2. In case of failure of the data transmission system, the Vietnam Deposit Insurance Agency sends electronic reports directly to the State Bank (Information Technology Department) through the transmission network.

Article 7. Correction and adjustment of information

1. When the information provider discovers errors or inaccuracies in the provided information, the information provider may send a written request to the information recipient to verify or make corrections.
2. Within 15 days from the date of receiving the request for verification, the information provider is responsible for checking the information and responding to the information recipient.
3. When there is a need to adjust information, the information provider must promptly correct the information to be provided to the information recipient within 02 working days from the date the information is provided for adjustment.
4. The information provider is responsible for explaining and making records of information when requested by the information recipient.

Article 8. Time limits for sending information

1. The time limit for sending information and reports is stipulated in the Decision of the Governor of the State Bank on the catalog, indicators, and reports between the State Bank and the Vietnam Deposit Insurance Agency.
2. If the deadline for sending information and reports coincides with a holiday, Tet holiday, or weekend, the date of sending the information and report is the next working day after the holiday.
3. In case information and reports are sent via official documents, the actual date of sending is the date recorded on the stamp of the internal postal service receiving the information and reports. In case information and reports are sent via electronic reporting channels, the date of sending is the date the report is successfully transmitted.
4. In cases of urgent dispatch or immediate processing, units must send information and reports via fax or electronic document collection system to the State Bank. After sending information and reports via fax or electronic document collection system, the reporting unit is responsible for sending the official information and reports according to the provisions of Article 5 of this Circular. The date of sending the information and report is calculated as the date of transferring the information and report via fax or electronic document collection system.

Article 9. Exploitation of information by units under the State Bank

1. Units under the State Bank (excluding units receiving reports stipulated in the Decision of the Governor of the State Bank on the catalog, indicators, and reports between the State Bank and the Vietnam Deposit Insurance Agency) within the scope of their functions and duties, if they have the need to exploit information and reports from the Vietnam Deposit Insurance Agency, must regularly report in writing to the Department of Organizational Supervision to summarize and submit to the Governor of the State Bank for approval.
2. Units and individuals belonging to the scope of information and report exploitation are subject to management and use of information and reports in accordance with the law, ensuring confidentiality and protection of information.

Article 10. Responsibilities of units under the State Bank

1. Responsibilities of the Department of Organizational Supervision:
   a) Coordinate and assist relevant units in providing information to the Vietnam Deposit Insurance Agency according to the provisions of this Circular, the Decision of the Governor of the State Bank on the catalog, indicators, and reports between the State Bank and the Vietnam Deposit Insurance Agency; promptly receive written requests from the Vietnam Deposit Insurance Agency for other information and reports stipulated in Clause 2 of Article 4 of this Circular and submit to the Governor of the State Bank for review and approval for the Vietnam Deposit Insurance Agency; b) Initiate and coordinate with units under the State Bank and the Vietnam Deposit Insurance Agency to draft, submit to the Governor of the State Bank for issuance, amendment, and supplementation of the Decision of the Governor of the State Bank on the catalog, indicators, and reports between the State Bank and the Vietnam Deposit Insurance Agency; c) Receive written proposals regarding the implementation of this Circular, coordinate with relevant units to respond to the Vietnam Deposit Insurance Agency; monitor the handling of proposals by relevant units; d) Monitor, inspect, and check the implementation of information provision by the Vietnam Deposit Insurance Agency according to the provisions of this Circular; e) Archive, store, and manage official document reports received directly from the Vietnam Deposit Insurance Agency according to legal provisions on archiving.

2. Responsibilities of the Information Technology Department:
   a) Be the lead unit in organizing, updating, and timely synchronizing electronic report templates into the reporting system transmitted by the Vietnam Deposit Insurance Agency via the network or sent via the transmission network. In case of errors in file names, data structure, technical indicators, or missing report templates, require the Vietnam Deposit Insurance Agency to correct and resubmit according to regulations; respond promptly regarding data availability for reporting units. In case of data transmission failure by the State Bank, implement immediate measures to fix the failure; b) Coordinate with the Vietnam Deposit Insurance Agency in ensuring confidentiality, maintaining, and protecting the security and integrity of the transmission network between the State Bank and the Vietnam Deposit Insurance Agency; c) Direct units under the State Bank and the Vietnam Deposit Insurance Agency to handle discrepancies related to the authenticity and accuracy of statistical reports in the process of implementing the provisions of the Deposit Insurance Law, this Circular, and the Decision of the Governor of the State Bank on the catalog, indicators, and reports between the State Bank and the Vietnam Deposit Insurance Agency; d) Guide the issuance, management of keys, and electronic programs used in the reporting system for the Vietnam Deposit Insurance Agency; e) Direct coordination with the Statistics - Finance - Banking Department and relevant units to guide regulations on the structure and format of electronic report files and guide the Vietnam Deposit Insurance Agency to create and submit electronic report templates through the reporting system to implement this Circular, the Decision of the Governor of the State Bank on the catalog, indicators, and reports between the State Bank and the Vietnam Deposit Insurance Agency; f) Initiate and guide the Vietnam Deposit Insurance Agency to exploit statistical report indicators stipulated in the Decision of the Governor of the State Bank on the catalog, indicators, and reports between the State Bank and the Vietnam Deposit Insurance Agency; g) Notify the Vietnam Deposit Insurance Agency when the statistical reports in the Decision of the Governor of the State Bank on the catalog, indicators, and reports between the State Bank and the Vietnam Deposit Insurance Agency change the data file structure.

3. Responsibilities of other units under the State Bank:
   a) Provide information to the Vietnam Deposit Insurance Agency according to the provisions of this Circular and the Decision of the Governor of the State Bank on the catalog, indicators, and reports between the State Bank and the Vietnam Deposit Insurance Agency; b) Coordinate with the Department of Organizational Supervision to draft, submit to the Governor of the State Bank for issuance, amendment, and supplementation of the Decision of the Governor of the State Bank on the catalog, indicators, and reports between the State Bank and the Vietnam Deposit Insurance Agency; c) Check, verify, and respond to verification requests received from the Vietnam Deposit Insurance Agency regarding reports under the unit's responsibility to provide; d) Archive, store, and manage official document reports received directly from the Vietnam Deposit Insurance Agency according to legal provisions on archiving.

Article 11. Responsibilities of Regional Branches of the State Bank

1. Provide lists and information on organizations, branches of state banks operating in the region under competent authority to the Vietnam Deposit Insurance Agency, and branches of the Vietnam Deposit Insurance Agency in the region according to the provisions of the Deposit Insurance Law, this Circular, and the Decision of the Governor of the State Bank on the catalog, indicators, and reports between the State Bank and the Vietnam Deposit Insurance Agency.
2. Coordinate with the Department of Organizational Supervision to build and implement the Decision of the Governor of the State Bank on the catalog, indicators, and reports between the State Bank and the Vietnam Deposit Insurance Agency.
3. Implement cooperation mechanisms and provide information to branches of the Vietnam Deposit Insurance Agency.
   a) Receive information and reports from the Vietnam Deposit Insurance Agency and its regional branches and promptly handle them according to assigned functions and duties; b) Coordinate with the Vietnam Deposit Insurance Agency and its regional branches to handle discrepancies related to the responsibilities of the Regional Branch of the State Bank in implementing the Deposit Insurance Law, this Circular, and the Decision of the Governor of the State Bank on the catalog, indicators, and reports between the State Bank and the Vietnam Deposit Insurance Agency.
4. Archive, store, and manage official document reports received directly from the Vietnam Deposit Insurance Agency and its regional branches according to legal provisions on archiving.

Article 12. Responsibilities of the Vietnam Deposit Insurance Agency

1. The Vietnam Deposit Insurance Agency is responsible for providing information to the State Bank according to the provisions of the Deposit Insurance Law, this Circular, and the Decision of the Governor of the State Bank on the catalog, indicators, and reports between the State Bank and the Vietnam Deposit Insurance Agency.
2. Coordinate with the Department of Organizational Supervision to build, submit to the Governor of the State Bank for issuance, amendment, and supplementation of the Decision of the Governor of the State Bank on the catalog, indicators, and reports between the State Bank and the Vietnam Deposit Insurance Agency.
3. Coordinate with the Information Technology Department in ensuring the security and integrity of the transmission network between the State Bank and the Vietnam Deposit Insurance Agency.
4. Based on inspection results, assessment of the operational status of participating organizations in deposit insurance, or other information sources, when participating organizations in deposit insurance have conditions violating regulations on safety, violating other legal regulations on currency and banking; posing risks of significant loss, asset loss, or having negative impacts on other participating organizations in deposit insurance, the Vietnam Deposit Insurance Agency promptly provides relevant information to the Department of Organizational Supervision.
5. Instruct regional branches of the Vietnam Deposit Insurance Agency to build and implement cooperation mechanisms and provide information to regional branches of the State Bank.
6. Archive, store, and provide extracts and reports to the State Bank according to legal provisions and instructions of the Governor of the State Bank.

Article 13. Responsibilities of Regional Branches of the Vietnam Deposit Insurance Agency

1. Provide information and lists of organizations participating in deposit insurance under management to regional branches of the State Bank according to the provisions of this Circular and the Decision of the Governor of the State Bank on the catalog, indicators, and reports between the State Bank and the Vietnam Deposit Insurance Agency.
2. Build and implement cooperation mechanisms and provide information to regional branches of the State Bank in the locality.
3. Coordinate with regional branches of the State Bank in handling organizations subject to early intervention and takeover according to legal provisions.
4. Archive, store, provide extracts, and report to regional branches of the State Bank according to legal provisions and instructions of the Governor of the State Bank.

Chapter III
IMPLEMENTATION ORGANIZATION

Article 14. Effectiveness

1. This Circular takes effect from May 4, 2026.
2. The contents of Circular No. 34/2016/TT-NHNN dated December 28, 2016, of the Governor of the State Bank regulating the provision of information between the State Bank of Vietnam and the Vietnam Deposit Insurance Agency are repealed from the date this Circular takes effect, except for the provisions in Clause 3 of this Article.
3. From the date this Circular takes effect, the provision of information and reports stipulated in Clause 1 and Clause 3 of Article 4 of this Circular, the method of providing information in Clause 1 of Article 5 of this Circular, and the time limit for sending information in Clause 1 of Article 8 of this Circular are implemented according to Model 01 and Model 02 issued together with Circular No. 34/2016/TT-NHNN dated December 28, 2016, of the Governor of the State Bank regulating the provision of information between the State Bank of Vietnam and the Vietnam Deposit Insurance Agency until the Decision of the Governor of the State Bank on the catalog, indicators, and reports between the State Bank and the Vietnam Deposit Insurance Agency is issued according to the provisions in point b, Clause 1, Article 10 of this Circular.

Article 15. Implementation Organization
The Director of units under the State Bank, the Vietnam Deposit Insurance Agency, and relevant organizations and individuals are responsible for implementing this Circular.
