I address you within the framework of the attributions and powers of the Securities Market Superintendence – SMV contemplated in articles 7 1, 13 2 and 270 3, of the Single Ordinance Text of the Securities Market Law, Legislative Decree No. 861, approved by Supreme Decree No. 020-2023-EF, related to the supervision of legal entities registered in the Public Registry of the Securities Market – RPMV, among which are Risk Classification Companies (hereinafter, ECR).

In this regard, it is appropriate to remind you that according to what is provided in article 5, numeral 5.1 of the Standards on preparation, presentation and dissemination of Financial Statements, Annual Report and Management Report applicable to entities supervised by the Securities Market Superintendence, approved by SMV Resolution No. 013-2023-SMV/01, obligated subjects must present their financial statements, annual report and management report to the SMV; while article 13 of the aforementioned standards specifies that individual or separate audited annual financial statements must be approved by the shareholders' general meeting or corresponding body, with the deadline for their respective presentation being March 31 of each year.

Without prejudice to the foregoing, it should be added that article 35 of the Regulation of Risk Classification Companies, approved by SMV Resolution No. 032-2015-SMV/01 and its amendments (hereinafter, ECR Regulation) establishes, among others: i) ECRs must present their audited individual annual financial information; ii) the "Income Distribution Table" must be presented at the same time as the audited individual annual financial information; and, iii) that the deadlines for the presentation of financial information of ECRs are those established in CONASEV Resolution No. 103-99-EF-94.10 or the norm that replaces it 4.

Considering the above, their represented entity is exhorted to apply due diligence and take all necessary measures to ensure compliance with the timely presentation of the information required by the regulations, keeping in mind that the deadline for the presentation of their audited individual annual financial information and the corresponding "Income Distribution Table" for the 2024 economic year is March 31, 2025.

Finally, it is appropriate to indicate that this circular is of a preventive and referential nature, so it does not require a response; nevertheless, this does not exempt their represented entity from its responsibility to know and observe the securities market regulations.
