CIRCULAR NO. 2.377
SEPTEMBER 8, 2026

This Commission, in exercise of the powers conferred upon it by Articles 5, paragraphs 1 and 18, and Article 20, paragraph 3, both of Law Decree No. 3.538, which creates the Financial Market Commission; Article 61 of the Decree with Force of Law No. 251, of 1931, of the Ministry of Finance; Article 23 of Supreme Decree No. 1.055 of 2012 of the Ministry of Finance; and as agreed by the Commission's Council in Ordinary Session No. 512 of September 3, 2026, has deemed it appropriate to issue the following instructions:

I. Circular No. 2.110 of 2013 is modified as follows:

1. The third paragraph is replaced by the following:

"Information to the Commission must be sent through CMF Supervisa, using the 'Claim Settlement Extensions' application enabled for these purposes. The foregoing through the following options available in the aforementioned application, the operational functioning of which is described in the technical sheet available on this Commission's website:
1) Form for entering the first individual extension.
2) Form for entering the first mass extensions.
3) Form for entering the second individual extension, and subsequent ones.
4) Form for entering the second mass extensions, and subsequent ones.
5) Request for resubmission of information.
6) Individual Claims Closure.
7) Mass Claims Closure."

2. The seventh paragraph is replaced by the following:

"Furthermore, companies and adjusters must report semi-annually to the Commission, through CMF Supervisa, Aggregated Statistical Information on Claim Settlement, in accordance with the instructions established in the technical sheet.

For information corresponding to the first semester of each year (January – June), the information must be submitted no later than July 31 of the same year, or the next business day if it is a Saturday or holiday. Likewise, for information corresponding to the second semester of each year (July – December), the information must be submitted no later than January 31 of the following year, or the next business day if it is a Saturday or holiday.

The sections to report this data are:
1) Individual Aggregated Information – Insurance Companies
1.1.) Claims reported in the period.
1.2.) Claims reported and settled directly by the company during the period to be reported.
1.3.) Claims reported in periods prior to the one being reported and settled directly in the current period.
1.4.) List of the 20 Claims Adjusters, registered in the Registry of this Commission, to whom the highest number of claims was assigned during the period, detailing the number of claims assigned to each of them.
2) Mass Aggregated Information – Insurance Companies
2.1.) Claims reported in the period.
2.2.) Claims reported and settled directly by the company during the period to be reported.
2.3.) Claims reported in periods prior to the one being reported and settled directly in the current period.
2.4.) List of the 20 Claims Adjusters, registered in the Registry of this Commission, to whom the highest number of claims was assigned during the period, detailing the number of claims assigned to each of them.
3) Individual Aggregated Information – Claims Adjuster
3.1.) Claims assigned and settled during the period to be reported.
3.2.) Claims assigned in periods prior to the one being reported, settled in the current period.
4) Mass Aggregated Information – Claims Adjuster
4.1.) Claims assigned and settled during the period to be reported.
4.2.) Claims assigned in periods prior to the one being reported, settled in the current period.
5) Request for Resubmission of Statistics
The Insurance Company or the Claims Adjuster, in case of errors in the information sent, may request the CMF to resubmit said corrected information."

3. Annexes 1 and 2 are eliminated.

II. Validity
This Circular takes effect from February 1, 2027.
