Rule · BCB · 28 Oct 2004 · Circular 3261
Consortium administrators are permitted to invest collected resources in short-term, referenced, and fixed-income funds, while prohibiting investments in funds with derivative exposure exceeding one times net equity or those receiving the administrator's own resources. A maximum leverage limit of six times the Net Worth of the Administrator (PLA) is established, requiring daily compliance with specific deductions for pending judicial collections and federal securities held in repurchase agreements. Administrators must designate a director responsible for reporting to the Central Bank of Brazil, and non-profit civil associations are subject to half this leverage limit. Existing regulations are amended to reflect these rules, with a compliance deadline of April 1, 2005, for existing non-compliant investments.
Dispenses on the application of resources collected from consortium groups, the leverage limit for consortium administrators, and the designation of a director responsible for providing information.
The Collegiate Board of the Central Bank of Brazil, in a session held on October 26, 2004, having regard to the provisions of Article 10 of Law No. 7,691 of December 15, 1988, and Article 4, item "c", of Decree-Law No. 1,290 of December 3, 1973, and based on Articles 33 of Law No. 8,177 of March 1, 1991, and Article 2 of Resolution No. 2,092 of July 27, 1994,
