Rule · BCRA · 1 Aug 2011 · A 5212
Financial entities and cooperative credit unions must process judicial transfers via electronic means for amounts exceeding $30,000 and ensure all such credits are free of charge. They must cap daily electronic transfer fees at $10,000, applying this limit automatically unless clients request a lower threshold. Entities must open sight accounts for judicial use without fees, verify destination account types for free transfers, and offer free savings accounts with debit cards to beneficiaries lacking such accounts.

OPASI 2 - 429
Savings deposits, salary account, universal free account and special accounts. Regulation of the bank current account. Sight accounts opened in cooperative credit unions. Sight accounts for judicial use. ______ We address you to inform you that this Institution has adopted the following resolution:
"1. Replace, with effect from 1.09.11, points 5.8.3. and 5.8.4. of Section 5. of the rules for "Savings deposits, salary account, universal free account and special accounts", with the following:
"5.8.3. Deposits and other credits.
The crediting of amounts corresponding to judicial cases ordered by the intervening courts shall be carried out via electronic transfers from sight accounts opened in financial entities or through any other payment method other than cash, when the amounts exceed $ 30,000 and, preferably by these means, when the deposits are less than or equal to said amount. Regardless of the means and amount of the credit, it shall be free of charge for the originator and/or the depositor. In the case of foreign currency accounts, electronic payment means shall be used, when these are implemented by the financial entity intervening in the operation. Credits for the collection of deposits and time investments constituted by the court and/or by other operations carried out by the latter are also admitted.
5.8.4. Payments and other debits.
Payments to the beneficiary/beneficiaries designated in the respective orders shall be made via electronic transfer to accounts in their name when the amounts exceed $ 30,000 and, preferably by this means, for sums equal to or less than said amount destined to accounts opened in the name of the beneficiary/beneficiaries designated in the respective orders, without prejudice to what is provided in point 5.8. regarding compliance with provisions issued by the public powers of the different jurisdictions. To this effect, each beneficiary must inform the court of the account identification data and their Uniform Banking Key (CBU) in which their credit will be considered cancelled at the time of deposit. In the case of foreign currency accounts, electronic payment means shall be used, when these are implemented by the financial entity intervening in the operation. Judicial payment orders shall be integrated, authorized and sent to paying financial entities preferably electronically, through the system referred to in point 5.8.7., to the extent that the courts do not use other mechanisms for such requests. In the event that there are several beneficiaries, as many transfers as beneficiary persons shall be made, in the proportions indicated by the court. Debits for the constitution of deposits and time investments and other destinations are also admitted, in accordance with current legal provisions or as ordered by the court. The movements of these accounts - regardless of their nature - cannot generate a negative balance. When judicial payment beneficiaries do not have a sight account, the financial entities holding the judicial accounts must offer them the opening of a savings account and the issuance of a debit card (both free of charge for at least one year - unless it concerns periodic payments, in which case this condition of free service must be maintained - to the extent that they are used exclusively to receive the transfer from the court and withdraw these funds) in accordance with what is provided in Section 1. of these rules. To this end, they must optimize the processes to carry out the opening of that savings account and the issuance and delivery of the debit card to the beneficiary holder in the shortest possible time."
"6.11. Transfer service. Charges and/or commissions.
Financial entities must adjust their charging scheme for these concepts to the following provisions. This, without prejudice to additional services they offer to facilitate the bulk loading of such transactions in the systems offered to clients (and as long as charges are not applied for amounts related to the transferred amounts) and concepts that must be passed on to clients for taxes, withholdings, etc., according to applicable legal norms.
6.11.1. The charges and/or commissions that financial entities - which possess electronic means such as ATMs and/or "Internet" banking ("home banking") - apply for the transfer service between deposit accounts denominated in pesos will be subject to the following maximum limits:
6.11.1.1. For transfers carried out through electronic means - e.g. ATM, "Internet" banking ("home banking") and self-service terminals - transfers up to $ 10,000 daily will be free of charge, with no charge by the financial entity for any administrative, operational or any other concept.
This amount must be assigned automatically without the need for express request from the client, unless the client, by their own decision, explicitly requests to operate with a lower daily limit. For the excess of this amount, entities may charge fees and/or commissions up to 50% of the maximum commission according to the scale established below for transfers carried out at the counter.
6.11.1.2. For transfers carried out at the counter:
Transfer Amount Maximum Commission
Up to $ 50,000 $ 5
Greater than $ 50,000 and up to $ 100,000 $ 10 Greater than $ 100,000 $ 300
Additionally, the charging of interbank commissions will not apply, without prejudice to the fact that commissions charged between entities and to clients for geographic coverage - at the values in force on 23.9.10 - may be maintained in effect, in those cases where this is provided for.
6.11.2. Transfers destined to sight accounts for judicial use.
Fund transfers destined to these accounts must be free of charges and commissions for the originator.
To this effect, the financial entity receiving the transfer must verify that the destination account of the funds corresponds to a sight account for judicial use. If such correspondence is not verified, it must proceed with the return of the transaction, in accordance with the provisions of the applicable regulations in this matter."
"12.7. Transfer service. Charges and/or commissions.
