Circular OPRAC 1-396. Fixed or Variable Rate Credit Operations. Clarification

Financial entities must not designate loan operations as fixed-rate if clauses allow interest rate modification due to specific circumstances, except those ordered by a competent authority. Fixed-rate contracts must exclude such modification clauses. Variable-rate contracts must clearly specify determination parameters and change periodicity. Entities must explicitly record whether operations are fixed or variable, detailing parameters and periodicity for the latter. Advertisements must clarify whether advertised operations are agreed at fixed or variable rates. These requirements replace point 1.1 of Chapter II of Circular OPRAC-1.
