Rule · BCRA · 28 May 2004 · A 4147
Financial entities must apply foreign currency deposit lending capacity in the collection currency, permitting use for exports, producer financing, inter-financial loans, or Central Bank bills. Daily minimum cash integration must reach 50% of the prior month’s requirement, rising to 70% after a deficiency, with amounts credited within 5 business days. Defects trigger an equivalent increase in the minimum cash requirement. These rules replace specific points in the “Minimum Cash” norms effective June 1, 2004, and August 1, 2004.

Comm. “A”
4147
“1. Establish that the lending capacity arising from deposits constituted in foreign currency shall be applied, taking into consideration the currency collected, indistinctly, to the following destinations:
1.1. Pre-financing and financing of exports carried out directly or through agents, consignees or other intermediaries acting on behalf and order of the owner of the goods, in accordance with what is provided in Communication “A” 3818.
1.2. Financing granted to producers or processors of goods, provided they have firm sales contracts for the merchandise to be produced to an exporter, with price fixed in foreign currency and it concerns fungible goods that have quotation, in foreign currency, normal and habitual in local or international markets, of wide dissemination and easy access to public knowledge.
1.3. Financing to producers of goods to be exported, either in the same state or as an integral part of other goods, by third-party acquirers thereof, provided they have total guarantees in foreign currency from said third parties.
1.4. Debt titles or certificates of participation in financial trusts - including other specifically recognized collection rights in the trust contract to be constituted within the framework of “BID Loan Nº1192/OC-AR” - whose underlying assets are constituted by loans originated in financial entities under the conditions referred to in points 1.1. to 1.3.
As an exception, attribution of up to 10% of the lending capacity is also admitted for financing that has other destinations, different from those mentioned above, included in the credit program referred to in that loan from the Inter-American Development Bank.
1.5. Inter-financial loans.
Entities must identify the inter-financial loans granted with these resources.
1.6. Bills of the Central Bank of the Argentine Republic in US dollars, acquired in auctions or through secondary negotiation.
Entities must verify that the financing agreed upon and the maturities established maintain a relationship with the expected income flow in the currency of granting the loans. Loans granted must be settled in the Single and Free Foreign Exchange Market.
The lending capacity shall be determined for each foreign currency collected and will result from the sum of foreign currency deposits and received inter-financial loans, which have been identified by the granting financial entity as coming from its lending capacity of deposits of that kind, net of the deduction of the minimum cash requirement on the deposits. Defects in application will be subject to an equivalent increase in the minimum cash requirement in the respective foreign currency.”

Section 2. Integration.
Version: 7th. COMMUNICATION “A” 4147
Validity:

2.2. Calculation.
The compliance with the integration of the minimum cash will be measured based on the monthly average of daily balances of the concepts admitted for this purpose, registered during the same month to which the minimum cash corresponds, dividing the sum of said balances by the total number of days in the period. On days when no movement is registered, the balance corresponding to the immediately preceding business day must be repeated. In the case of current accounts opened in commercial banks by non-bank entities, the balances reflected in the account summaries will be taken into account.
2.3. Minimum daily integration.
On no day of the month will the sum of the balances of the concepts admitted as integration referred to in points 2.1.2. to 2.1.5., 2.1.7. and 2.1.8., registered at the close of each day, be less than 50% of the total minimum cash requirement, determined for the immediately preceding month, recalculated based on the requirements and concepts in effect in the month to which the reserves correspond, without considering the effects of the application of what is provided in point 1.5.1. of Section 1. This daily requirement will be 70% when a deficiency in integration has been registered in the previous calculation period with a monthly average exceeding the admitted transfer margin.
2.4. Remuneration of balances of peso accounts opened at the Central Bank.
Interest will be recognized on the monthly average of the daily balances of the current accounts and special guarantee accounts in favor of the electronic clearing chambers and for the coverage of the settlement of operations with credit cards and in automated teller machines (considered together), without exceeding the greater of the amounts resulting from comparing the result of the following procedure:

2.4.2. Net minimum daily integration requirement after the integration carried out through the admitted concepts of points 2.1.5., 2.1.7. and 2.1.8.
Interest will accrue at the rate that is set and which will be transmitted through the Foreign Exchange and Open Market Operations Desk. In case of modifications during the same month, the weighted average rate will be used based on the number of calendar days of validity in the period. Amounts will be credited to the corresponding accounts within 5 business days of validating the presentation of the relevant information regime.
