Rule · BCRA · 23 Mar 2010 · A 5053
Participating entities must operate electronic check clearing via CECs, transmitting daily files in two sessions with strict deadline hours. Depository entities must credit non-rejected checks after BCRA settlement and return rejected items, while drawee entities must debit accounts based on electronic data. Rejections require specific file transmissions, and out-of-exchange responses are due within 15 business days. Imageless truncated checks clear in 48 hours, as do those with images. Entities must archive rejected checks and report rejections to the BCRA, adhering to defined message formats and record designs.

ANNEX
It will be the responsibility of participating entities to operate in accordance with the standards and formats defined by these rules for the electronic exchange of check information.
2.2.2. Participating actors.
Electronic check clearing in general involves the participation of the following actors:
They communicate with each other to exchange cross transactions, which enables entities to communicate only with their CEC, and for the CEC to take charge of transactions from all entities, regardless of whether they are its clients or not. The main functions they will perform are the following:
2.2.2.5. Federal Capital Exchange Point:
It is the place where the physical exchange of checks involving the registration of deferred payment checks, claims, and adjustment vouchers takes place. The relationship between participants is described in the following table:

2.3.1. Truncated checks
These are those that remain in the possession of the depositing entity, after capturing their representative data, with only the information about them reaching the drawee entity electronically. These data constitute all the information that the depositing entity sends to the drawee entity so that the latter confirms/rejects payment, without it being necessary to resort to sending the original document. According to the amounts of the documents, two different cases can be distinguished:
Truncated checks where only electronic information is sent, without image of the documents
Truncated checks where electronic information and image of the documents are sent.
The amount from which the image must be sent will be informed through communication from the BCRA, as it increases over time.
2.3.2. Deferred payment checks.
Deferred payment checks (CPD) have two distinct cycles, the registration cycle and the payment cycle.
The registration cycle will not be contemplated in the clearing system, as it is an exchange of documents between entities without money settlement. The payment cycle begins when the CPD matures. This cycle is similar to the clearing of a check, so the same rules and instructions that govern common checks will apply.
2.3.3. Certified checks.
These checks will be cleared in the same manner as common checks. Each drawee entity will keep a record of the checks it has certified, to be able to identify them from the electronic information it receives.
2.4. Scope of application.
Through this system, checks of any origin and destination may be electronically cleared within the national territory.

The transactions to be presented electronically to the CEC are the following:
In the presented session:
Checks and other negotiable instruments to be cleared: they will present all records corresponding to documents received daily, and the images of those checks whose amounts exceed the one fixed by this BCRA and of all remaining negotiable instruments.
Adjustments: they will present eventual adjustments to checks already presented and cleared, a transaction defined later.
Claims.
Out-of-exchange rejections.

3.1.1.2. Deadlines and hours.
For each session (presented and rejected), the deadline hours for presenting information to the CECs defined by each of them will apply, which govern communications between them and their respective adhering entities. These hours function as the deadline for information transmissions between a CEC and its adhering entities. This means that entities may transmit files to a CEC throughout the day, from the start of operations hour defined by each chamber, until said deadline hour. Entities that have not been able to send information to their CEC before these deadline hours must wait until the next business day to transmit the information to be cleared or exchanged. The exception to this occurs with the communication of rejections, which in case of not being sent in the corresponding session may be managed through adjustments in the presented session of the same day.
3.1.2. Processing of information in the CEC.
3.1.2.1. Reception and validation.
The CEC will execute electronic processing of information related to checks, whether information received in the presented session or in the rejected session, from the corresponding deadline hours for each session. The CEC will perform a series of validations on received files, rejecting them in case of error. The reasons for rejection will be:
Impossibility of reading the file.
Error in file structure.
Lack of match in control totals.
Error in drawee and depositing entity codes.

ii) Clearing between CECs.
CECs will interconnect to enable the exchange of movements between entities, a procedure that must be applied both for the presented session and for the rejected session. The procedure to be followed in each session will be the following:
The CEC that receives information from the origin entity will first calculate bilateral clearing movements between itself and all its destination entities. Secondly, it will retransmit the detail information to the CEC of the destination entities. The CEC of the destination entities will calculate bilateral clearing movements between its adhering entities and the origin entity, delivering the detail of transactions to each destination entity. Each CEC will communicate the bilateral movements resulting from clearing to its respective entities. CECs will calculate their final inter-chamber position. The CEC that has ended up with a debit balance will pay the creditor CEC, and finally, both CECs must effect the settlement of Creditor Entities. Example Assuming the case where two entities were adhered to each of the CECs, these would be the net positions of the system's participating entities:

Entity A Entity C Entity B Entity D
B +80 A(50) A(80) A(20)
C +50
D +20
Where Entity A would collect from Entities B, C, and D.

The structure, content, and format of files to be exchanged electronically between chambers must comply with the same specifications and standards defined in the Transactions and messages chapter and in the Record design chapter. iii) Deadlines and hours. To avoid delays in sending information resulting from clearing to entities and the BCRA, deadline hours will be defined for information transactions between CECs.
3.1.2.3. Out-of-exchange rejections.
Out-of-exchange rejections are values rejected by the drawee entity within a maximum period of 120 days, after the corresponding deadline for presenting rejections. The out-of-exchange rejection circuit applies in all locations in the country for all checks. i) Description of the out-of-exchange rejection circuit. This circuit allows the drawee entity to present the out-of-exchange rejection to the depositing entity, through a non-monetary transaction using the Individual record of out-of-exchange rejections. Admitted rejections are those originating in the reasons for check rejection used by the drawee entity, such as: insufficient available funds, stop payment order, account closed by judicial order, etc. The presentation of an out-of-exchange rejection is carried out in the presented session of checks, in batches separate from the documents to be cleared. On the other hand, the exchange of images of checks rejected out-of-exchange will be carried out bilaterally between the drawee and depositing entities. ii) Response to out-of-exchange rejection. The deadline attributable to the depositing entity to give a response regarding the acceptance or not of the out-of-exchange rejection is 15 business days from its presentation by the drawee entity. Likewise, CECs will carry out a statistical control of non-compliance incurred by entities in order to analyze, in a future stage, the possibility of establishing a specific deadline for "not acceptVersion: 2nd. “Rejection” of out-of-exchange.
Starting the day following the receipt of the out-of-exchange transaction, the depository entity may carry out the following actions:
In the first three cases, the depository entity will send a non-monetary response transaction equivalent to a rejection of the original out-of-exchange transaction. For this, the following records will be used: Individual Out-of-Exchange Rejections Record and Additional Out-of-Exchange Rejections Record; in the latter, in the 3 positions of field No. 3 “First Reason for Rejection”, the response will be given using the following rejection codes:
On the other hand, when the depository entity responds to a request for an out-of-exchange rejection, it must indicate the maturity date corresponding to the original transaction.
3.1.2.4. Claims
i) Sending of the claim to the CEC.
The request for the original document or its image, and the fulfillment of that request, i.e., the sending of the image, will be carried out through a similar system with records of similar characteristics. Depository entities must respond to claims regarding all checks paid or rejected. The delivery of the original document will take place at the Physical Exchange Center of the Federal Capital, with the intervention of the person in charge of the Exchange Point. The deadline for making a claim through this circuit will be one (1) year counted from the date of check clearing; however, upon completion of that deadline, the claim will also be admitted through the system subject to the application of a differentiated interbank commission.

Likewise, the possible collection of differences by the drawn entity that could be verified by viewing the received document (reproduction or original) will be admitted for compensated documents with an age of less than one (1) year; while those adjustments derived from the observation of compensated documents with an age greater than that period will have a bilateral treatment between the intervening entities.
ii) Receipt of the claim at the CEC.
The CEC, upon receiving the claims sent by the drawn entities, will carry out the corresponding format and resolution deadline controls before processing them. However, they will not control that the claim data corresponds to the data sent in the presentation of the check for clearing.
iii) Response to the received claim.
The depository entity, upon receiving the claim message, will carry out the necessary checks, essentially verifying that the claimed check was presented by itself on the date informed in the claim. The sending of the claimed image or the possible rejection of the request if it does not correspond, will be sent through the same system.
iv) Rejection of the claim.
The reasons why a claim may be rejected are mentioned below:
| Reason | Description |
|---|---|
| Non-existent Account | The affected account cannot be identified |
| Invalid Account Number | The affected account has a format error |
| Check Already Delivered | Check that has already been delivered to the drawn bank or the depositing client |
| Incorrect Presentation Date | When an incorrect presentation date for the original check is informed, including an non-working day or an erroneous date |
| Incorrect Amount | When the depository entity proceeds to reject a claim in which the amount does not match the amount of the requested document or because it was made on a non-truncated document. |
| Duplicate Transaction | When duplicate transactions are received. |
| Non-existent Check | When claims are received regarding non-existent checks or checks that were rejected prior to July 22, 2005. |
If any of the specified reasons are verified, the depository entity may reject the claim on its due date, which is 8 business days counted from the date of its presentation. For this, a control record without an associated image will be used, using the rejection codes detailed in the annex that describes the record design.

v) Transmission of the image.
In case the request was for a reproduction, the depository entity must send the images of the front and back of the claimed check, both in a single image file, which will be associated with a control record containing the data of the check that were sent in the electronic transaction of the claim. For this, the following session exchange scheme will exist, similar to that used for rejected truncated check images:

vi) Receipt of the images at the CEC.
The CEC will control the fulfillment of the sending of the images, matching the indexed data with it to the data of the electronic transaction of the claim sent through the same system.
vii) Receipt by the drawn entity.
The drawn entity may reject the received image, in case of deficiencies that do not allow it to carry out the pertinent checks. Such rejection must be sent under the same modalities used for the rejection of rejected truncated check images, i.e., by sending a control record with the design described in the annex, without the associated image file. Upon receiving the rejection of the image due to deficiencies in the image or incorrect image, the CEC must unmark the fulfillment, passing to include it within the pending sending and receipt.

viii) Exchange of claimed originals.
The delivery of the claimed originals must be carried out at the Exchange Center until the tenth business day counted from the date of presentation of the claim, while the depository entity may reject the request for a claim of an original document on the eighth business day following its presentation. At the time of delivery, the intervention of the person in charge of the Exchange Center will be available, who will verify it through the capture of the physical check data, using a technological means that allows reading of the CMC7 characters, and the manual entry of the amount, then matching the obtained data with a database of claimed originals provided by the CEC. The latter will determine the procedure through which, from the data of the delivered original, the fulfillment of the claim will be marked, generating at the same time the information related to unanswered claims.
3.1.2.5. Adjustments.
i) Definition.
In the presented session, depository entities may inform as “adjustments” the eventual differences found by their control processes, between the amounts of the checks presented electronically and the amounts of the physical checks, and also for other types of differences detected in their processes.

The entities will receive from the CEC the files resulting from the clearing, up to the reception hours that each chamber defines. The entities may impute the movements in their clients' accounts based on the files received from the CEC, being able to carry out rejections, according to current regulations, from said records. If a rejection occurs based on the electronic information, the drawn entities will reject based on said information. The reasons for check rejections, as well as the rejections of electronic transactions, are included in detail in Section 7 “Record Design” in the Additional Rejection Record, field 3 “First reason for rejection”. In cases of rejection reasons, as well as in the case of unwinding by a CEC (“Unwinding”), it corresponds to return the physical check to the depositing client. If the validations are not exceeded, the entities reserve the right to request the retransmission of the file in whole or in part.

3.1.4.1. Business days for clearing.
All days that the BCRA defines as such will be considered business days for clearing.
3.1.4.2. Local holidays.
i) Definition.
A planned local holiday is considered any declared by a competent authority (national, provincial, municipal, or Autonomous City of Buenos Aires), that allows it to be included in advance in a calendar of local holidays. Such calendar will be administered by the CEC, and will include the dates of the planned holidays for the different exchange points. It will be timely disseminated through the publication of a CIMPRA bulletin and will be prepared with the information that entities must provide to the CEC. An unplanned local holiday is considered any declared by a competent authority (national, provincial, municipal, or Autonomous City of Buenos Aires), that cannot be included in advance in the calendar administered by the CEC, but that is known by them through the information formally provided by the bank(s) present in the plaza, at most 48 business hours before the date on which the holiday occurs.
ii) Operational Instructions. a) Planned local holidays:
Upon receiving the holiday notice, the CEC will identify the movements with the bank postal code(s) with a clearing date of the holiday day, reject them in the rejected session of that same day for which it will use the code R09 “local holiday”, and in the immediate next presented session, they will be re-presented with the date of the next business day, distributing to the entities the information of the transactions corresponding to the exchange point with the local holiday.

3.1.4.3. Exception procedure for communication failure.
In the eventuality of a failure in the communication between the Transmission Centers and the CEC, an exception procedure is foreseen based on the exchange of information by magnetic medium with physical delivery of the same in the plaza where the CEC provides the magnetic medium reading service. The entities will be responsible for the delivery or withdrawal of said medium to the CEC. However, if the communication problem had not extended to all entities, those affected will have the option to resort to another entity's Transmission Center that manages the transmission of information to the CEC.
3.1.4.4 Emergency situations.
i) Definition.
These are all those of external origin to the financial entities and of serious effects, (for example: flood, tornado, road cuts, etc.) that affect one or several plazas and some or most of the entities participating in electronic clearing. Internal situations registered by the entities (for example: labor actions taken by the entity's staff, computer center problems, etc.) are not included in this procedure, their resolution corresponding through the application of the “Force Majeure” scheme and norms.

Rejected Session:
The corresponding one for the presented of the previous business day will be carried out, with the usual procedure for normal days. The head offices of the affected branches will reject all the records presented, on the previous business day, using the rejection code of the transaction: R 34 “Emergency Situation”. The transmission of the electronic rejection files will be carried out in the usual hour of sending the information to the CEC. Depository Entity: must re-clear the documents rejected due to emergency situation in the presented round of the same day or the next business day. Given this situation, the need to identify depositors through checks is observed; for this, it is convenient to develop identification procedures for deposits, such as establishing a relationship between the check and the deposit slip. In case that in the second presentation, any value results rejected for a cause that generates a fine, the obtaining of the image to be delivered to the drawn entity, they must obtain it from the files of the original presentation. Presented Session of that date:
The CEC will be available to carry out the processing in the established hours.

The physical exchange of said checks will be operated through the Capital Federal Exchange Center.
iii) Management of rejections by the CEC.
The CEC must manage the validity of the entities' rejections regarding time limits. The normal rejection period for a check will be 1 business day. In the event that the depository entity transmits to the CEC the rejection of a check for any of the provided grounds, and said check is also rejected by the drawee entity for any of the provided grounds, a duplication of rejections on the same document in the same compensation cycle (collision of rejections) would occur. The CEC processes the information received from both entities in the rejection session and, in the event that it detects records corresponding to the same document, it must administer the collision as follows:
Identification of the signer in the Drawee Entity upon request of the holder of the rejected check.
Proceed according to the regulations that the BCRA issues for this purpose.
3.2.8. Circuit of rejected check images.
The depository entities that receive rejected movements for reasons that imply information to the BCRA's Rejected Checks Central, must send to the drawee entities, the images of the front of said checks, so that they identify the signer. The depository entity must capture the image of the documents corresponding to the rejections effected by the drawee entity before delivering them to the depositing client.
3.2.8.1. Reasons for rejections by the drawee entity that generate the sending of image.
Below are detailed the rejection codes that determine the need to send the document image to the drawee entity and those that, generated by the depository entity, can annul that requirement:
i) Reasons for rejections by the drawee entity that generate the sending of the image:
R01: Seized account,
R08: Report of loss and theft of checks,
R10: No sufficient available funds in account, R21: Preventive bankruptcy, R33: Forgery of the check, R35: Lack of conformity of checkbook, R36: Alteration of the check, R44: Values stolen from checkbooks not delivered to clients.
ii) Reasons for rejections by the depository entity that can annul the sending of image in case of collision of rejections:
R16: The document is not a check,
R37: Legal validity period expired,
R38: The drawer's signature does not match that of the person who clears the back, R46: Document/Design not compensable, R47: Second presentation does not correspond, R96: Errors of the depository entity, R97: Early presentation date of CPD.
3.2.8.2. General description of the procedure.
The entities must send to their respective CEC, through the procedures each one determines, a control file with the data of the rejected checks that require the sending of images and the number of images necessary associated with said control file. For its part, the CECs will validate that all the data of each record of the control file correspond to the data of a rejection processed through them that requires the sending of an image and, additionally, that there is an image associated with that record. As a result of each exchange, the CECs will send to the entities a control file with the corresponding associated images and the pending reports in the formats each one determines. The period comprising the sending of information by the banks and the processing by the CECs is defined as “Image Exchange Cycle” and the fixed terms are the following:

ii) Session for rejection of images: the fifth day after the day of rejection. iii) Session for presentation of rejected and/or missing images: the seventh day after the day of rejection. It must be taken into account that the second presentation to send images not sent in the first session and/or rejected by the CECs or by the drawee entities will count with the application of a charge and there will be no possibility of recovery in case of rejections. iv) Session for rejections of resent or missing images and final report of the compensation cycle: the eighth day after the day of rejection. In the following graph, an example of a complete exchange cycle is presented:
Monday Tuesday Wed. Thursday Friday Saturday Sun Monday Tuesday Wed. Thursday Friday Day 8 Day 1 Day 2 Day 3 Day 4 Day 5 Day 6 Day 7 Presentation Rejections of Images Resending of rejected/missing Final report Rejections of resent images rejection
3.2.8.3. Receipt of images in the CECs:
The CECs will control the compliance with the sending of the images, pairing the data indexed to them with the data of the check rejection that generated the requirement.
3.2.8.4. Receipt by the drawee entity:

The drawee entity must verify that the image has sufficient clarity to allow the correct reading of the areas intended for the route code and the signers of the documents. In the event of deficiencies that do not allow said checks to be performed, it may reject the received image by sending a control record without the associated image file.
3.2.8.5. Charges for non-compliance.
In order to ensure the sending of images by the depository entity, so that the drawee entities can comply with the information to the BCRA's Rejected Checks Central, there will be charges for non-compliance in the sending of them, with a differentiated cost depending on the moment when they were sent, taking into account that there will be two sessions for the presentation of images.
3.3. Particular aspects of the compensation of truncated checks with image.
3.3.1. Definition of truncated checks with image.
Those are those that, by exceeding the limit amount defined by the BCRA, in addition to being included in the information sent electronically in files, are subject to sending the image of the front and back to the drawee entity.
3.3.2. Compensation deadlines.
All truncated checks with image will have a compensation period between entities of 48 hours.
