CMN RESOLUTION NO. 4,983, OF FEBRUARY 17, 2022
Amends Resolution No. 4,753, of September 26, 2019, which provides for the opening, maintenance, and closure of deposit accounts.
The Central Bank of Brazil, in accordance with Art. 9 of Law No. 4,595, of December 31, 1964, makes public that the National Monetary Council, in a session held on February 17, 2022, based on Arts. 3, item V, and 4, item VIII, of the aforementioned Law, and Art. 69, sole paragraph, of Law No. 7,357, of September 2, 1985,
RESOLVES:
Art. 1. Resolution No. 4,753, of September 26, 2019, shall enter into force with the following alterations:
"Art. 4 ............................................................................................................

§ 1. Institutions must provide or make available to the account holder a copy of the contract referred to in the caput through any available customer service channel, including electronic means.
§ 2. Institutions, prior to contracting, must provide the account holder, by physical or electronic means, a prospectus of essential information, explicitly stating, at a minimum, in a synthetic manner, information regarding the basic rules of account operation, existing risks, and security measures for account movement, including in case of loss, theft, or robbery of the holder's credentials." "Art. 4-A It is prohibited for financial institutions to postpone cash withdrawals from checking deposit accounts of value equal to or less than BRL 5,000.00 (five thousand reais), with postponement to the next business day being admitted for withdrawals of value higher than established." (NR)
Art. 2. The following are repealed:
I - Resolution No. 3,695, of March 26, 2009; and
II - the sole paragraph of Art. 4 of Resolution No. 4,753, of 2019.
Art. 3. This Resolution enters into force on March 1, 2022.
