Rule · BCB · 26 Jul 2012 · Resolução CMN 4115
This resolution amends Resolution No. 4,087 to establish contribution rates of 0.02497% per month for time deposits with special FGC guarantee involving fiduciary alienation of credit receivables and lease assets. It introduces Article 3-A, which caps deposits without fiduciary alienation at the greater of double the Reference Equity (Level I) or historical baselines, and limits deposits with fiduciary alienation to multiples of Reference Equity (1.0 to 2.0) phased in from 2012 to 2017, subject to a combined aggregate cap of R$5 billion. Additionally, Article 3-B mandates a scheduled reduction of the cap for deposits without fiduciary alienation, decreasing by 20% annually from 2012 to 2016, while prohibiting early redemption and the issuance of new DPGE without fiduciary alienation once such operations have commenced. These rules apply to commercial banks, multiple banks, development banks, investment banks, credit/financing/investment companies, and savings banks.
The Central Bank of Brazil, pursuant to Article 9 of Law No. 4,595 of December 31, 1964, makes public that the National Monetary Council, in a session held on July 26, 2012, based on Articles 3, item VI, and 4, item VIII, of the aforementioned Law,
