CMN Resolution No. 4399 — Amends Resolution No. 4,088 of May 24, 2012 Regarding the Registration of Information on Guarantees and Vehicle Ownership

The Central Bank of Brazil, in accordance with Article 9 of Law No. 4,595 of December 31, 1964, makes public that the National Monetary Council, in a session held on February 27, 2015, based on Articles 4, items VI and VIII, of the aforementioned Law, and Article 23 of Law No. 6,099 of September 12, 1974, and having in view Articles 28 and 29 of Law No. 12,810 of May 15, 2013,

R E S O L V E D:

Article 1. The summary and Article 1 of Resolution No. 4,088 of May 24, 2012, shall henceforth read as follows:

“Provides for the registration of information concerning guarantees constituted on motor vehicles and real estate related to credit operations, as well as information concerning the ownership of motor vehicles subject to financial leasing operations.” (NR)

“Article 1. Financial institutions and other institutions authorized to operate by the Central Bank of Brazil must register, in a registration and financial settlement system for assets authorized by the Central Bank of Brazil or in a system maintained by an entity authorized by the Central Bank of Brazil to exercise the activity of financial asset registration, the information concerning:

I - guarantees constituted on motor vehicles or real estate related to credit operations; and

II - the ownership of motor vehicles subject to financial leasing operations.

Sole Paragraph. The systems referred to in the main text must:
