CMN Resolution No. 5144 — Amends Article 3 of CMN Resolution No. 5,097 of August 24, 2023, regarding eligibility criteria for innovation and digitalization financing operations using FAT resources transferred to BNDES

CMN RESOLUTION NO. 5,144, OF JUNE 26, 2024

Amends
Article 3 of CMN Resolution No. 5,097, of August 24, 2023, which defines the
eligibility criteria for financing operations for innovation and digitalization using resources from the Unemployment Insurance Fund – FAT transferred to the National Bank for Economic and Social Development – BNDES, through remuneration by the Reference Rate – TR.

The Central Bank of Brazil, in accordance with Article 9 of Law No. 4,595, of December 31, 1964, makes it known that the National Monetary Council, in a session held on June 26, 2024, considering the provisions of Article 4, caput, item VI, of Law No. 4,595, of December 31, 1964, and of Article 18-A of Law No. 13,483, of September 21, 2017,

RESOLVES:

Article

1. CMN Resolution No. 5,097, of August 24, 2023, published in the Official
   Gazette of the Union on August 25, 2023, shall enter into force with the following changes:

§

1. To calculate the value equivalent to the annual limit established in the
   caput, the base date of December 31 of the previous fiscal year shall be used, and the value may be updated at any time during the year, if the National Monetary Council changes the percentage established in Article 3, based on the competence provided for in the sole paragraph of Article 18-A of Law No. 13,483, of 2017.

§
2. Exclusively for the 2024 fiscal year, BNDES shall approve a limit of up to
2.12% (two and twelve hundredths percent) of the balance of resources transferred to it as provided in Article 239, § 1, of the Federal Constitution for the operations covered by this regulation.” (NR)

2. This Resolution enters into force on the date of its publication.
