CMN RESOLUTION NO. 5,149, OF JULY 3, 2024
Provides for adjustments to the general rules for rural credit and the National Program for Supporting Medium-Sized Rural Producers – Pronamp.
The Central Bank of Brazil, in accordance with Article 9 of Law No. 4,595, of December 31, 1964, makes it public that the National Monetary Council, in an extraordinary session held on July 2, 2024, considering the provisions of Article 4, caput, item VI, of Law No. 4,595, of December 31, 1964, Articles 4 and 14 of Law No. 4,829, of November 5, 1965, and Articles 48 and 49 of Law No. 8,171, of January 17, 1991,
RESOLVES:
Art. 1. Section 2 (Beneficiaries) of Chapter 1 (Preliminary Provisions) of the Rural Credit Manual – MCR shall enter into force with the following alterations:

d) persons unrelated to indigenous peoples or communities who carry out agricultural or extractive activities in indigenous areas.” (NR)
Art. 2. Section 5 (Utilization) of Chapter 2 (Basic Conditions) of the MCR shall enter into force with the following alterations:
“13 - The release of installments related to fertilizers, soil conditioners, agricultural pesticides, seedlings, and supervised or certified seeds acquired up to 180 (one hundred and eighty) days before the formalization of the credit is admitted, provided that the acquisition of products, proven by an invoice, is compatible with the financed enterprise.” (NR)
Art. 3. Section 9 (Social, Environmental, and Climatic Impediments) of Chapter 2 (Basic Conditions) of the MCR shall enter into force with the following alterations:
“3 - Rural credit shall not be granted for an enterprise located in a rural property wholly or partially inserted in a Conservation Unit, provided it is registered in the National Registry of Conservation Units (CNUC) of the Ministry of Environment and Climate Change (MMA), unless the economic activity is in compliance with the Management Plan of the Conservation Unit, respecting the provisions of Article 28 of Law No. 9,985, of 7/18/2000, and the specific provisions applicable to the traditional population beneficiary or resident, in accordance with Decree No. 4,340, of 8/22/2002.” (NR)

b) the provisions of the caput do not apply to cases where the applicant belongs to indigenous peoples or communities occupying or inhabiting the indigenous land where the enterprise is located.” (NR)
“~~~~8-A - The provisions of item 8, item “a”, do not apply to financing under the Pronaf Floresta credit lines, governed by MCR 10-7, Pronaf Bioeconomy, governed by MCR 10-16, or RenovAgro Ambiental, governed by MCR 11-7-1-“c”-VI, with the exclusive purpose of recovering native vegetation in the embarged area of the rural property and provided that it constitutes execution of the Environmental Regularization Program (PRA) or a similar instrument established and approved by the competent authority, with the force of an extrajudicial executive title, which has as its object an obligation related to the repair of environmental damages, if any.” (NR)

Art. 4. Section 2 (Working Capital Credits) of Chapter 3 (Operations) of the MCR shall enter into force with the following alterations:

a) the borrower must request the extension after the harvest and up to 15 (fifteen) days before the date fixed for maturity;

“11 - Up to December 31, 2024, the contracting of an investment credit operation for the isolated acquisition of machinery and equipment and the acquisition of animals for breeding or raising is admitted under the National Program for Supporting Medium-Sized Rural Producers (Pronamp), when contracted in accordance with the provisions of MF Ordinance No. 835, of May 23, 2024, with the provisions of MCR 8-1-5 and MCR 8-1-6 not applying for this purpose.” (NR)
Art. 7. Section 1 (Pronamp) of Chapter 8 (National Program for Supporting Medium-Sized Rural Producers – Pronamp) of the MCR shall enter into force with the following alterations:
