The European Commission establishes regulatory technical standards specifying that central counterparties (CCPs) must recompense non-defaulting clearing members pari passu using identical allocation schemes for cash and profit-claim instruments. The regulation caps annual recompense payments from future profits at 70% of the CCP's annual profit and limits the duration of such payments to a maximum of 10 years. These rules supplement Regulation (EU) 2021/23 and entered into force on 22 March 2023.
