Commission Implementing Regulation (EU) 2020/1406 laying down implementing technical standards for information exchange and cooperation under the Market Abuse Regulation

The European Commission adopted Implementing Regulation (EU) 2020/1406 to establish standardized procedures and forms for information exchange and cooperation between competent authorities, ESMA, the Commission, ACER, and other specified entities under Articles 24 and 25 of Regulation (EU) No 596/2014. The regulation mandates the use of specific annexed forms for requests, acknowledgments, replies, and unsolicited exchanges, while requiring ESMA to maintain an updated list of contact points for these bodies by 26 November 2020. It further stipulates that communications may be made via post, fax, or secure electronic means, with oral requests permitted in urgent cases provided they are confirmed in writing without undue delay. The regulation entered into force on 27 October 2020 and is directly applicable in all Member States.
