Commission Implementing Regulation (EU) 2025/2338 amending Implementing Regulation (EU) 2016/100
The European Commission amends Implementing Regulation (EU) 2016/100 to align the joint decision process for prudential permissions with the replacement of the Advanced Measurement Approach by the new standardised approach for operational risk. The regulation updates Article 1 to reference permissions under Articles 143(1), 151(9), 283, 325az, and Article 363 in the version in force on 8 July 2024. It modifies Article 3 to allow consolidating supervisors to involve third-country supervisory authorities in assessments for applicants operating in those jurisdictions. Furthermore, Article 4 establishes a 10-day deadline for forwarding applications to competent authorities and defines completeness criteria based on specific CRR articles.
