The CSSF establishes mechanisms for reporting presumed or actual breaches of the Law of 23 July 2016 and Regulation (EU) No 537/2014 to the Commission de Surveillance du Secteur Financier. The CSSF must assign dedicated staff members to handle reports, maintain secure and confidential communication channels, and publish information regarding the receipt and follow-up of breaches. The regulation mandates specific record-keeping procedures for written, oral, and physical reports, alongside strict data protection and confidentiality rules for both reporting and reported persons. The CSSF is required to review these procedures at least once every two years.
