The scope of this regulation is limited to Insurance products offered to consumers as defined in this Regulation. Le champ d'application du présent règlement est limité aux produits d'assurance offerts aux consommateurs tels que définis dans ce règlement. 85

Ingingo ya 3: Ibisobanuro Article 3: Definitions Article 3 : Définitions Uretse igihe byaba biteganywa ukundi, muri aya mabwiriza, amagambo akurikira asobanura:
In this regulation, unless otherwise stated, the following terms and expressions shall mean:
Dans le présent règlement, à moins que cela ne soit stipulé autrement, les termes et les expressions ci-après signifient:
1° Umusanzu: amafaranga uwahawe serivisi y’ubwishingizi yishyura umwishingizi ashingiye ku masezerano bagiranye. 1° Premium: payment due by the policyholder to the insurer under an insurance contract; 1° Prime: paiement dû par le preneur d'assurance à l'assureur en vertu d'un contrat d’assurance ; 2° Umuguzi: Umuntu ku giti cye cyangwa ikigo (gito cyangwa igiciriritse) bakorana n’utanga servisi y’imari bagamije kubona amasezerano y’ubwishingizi; 2° Consumer: an individual or legal person (Small or Medium Enterprise) that interacts with a financial service provider for the purpose of obtaining an insurance policy; 2° Consommateur: une personne physique ou morale (petite ou moyenne entreprise) qui interagit avec un prestataire de services financiers dans le but d'obtenir une police d’assurance ; 3° Ikigo gifite ubuzima gatozi: Ikigo icyo ari cyo cyose gifite ubuzima gatozi cyinjiza mu mwaka amafaranga atarengeje miriyoni mirongo itanu z’amafaranga y’u Rwanda (50.000.000 FRW) igihe hasabwa iyo servisi y’imari; 3° Legal person: any entity with legal personality which has an annual turnover not exceeding fifty million Rwandan Francs (FRW 50,000,000) at the time the financial service is requested; 3° Personne morale : toute entité dotée de la personnalité juridique dont le chiffre d'affaires annuel ne dépasse pas cinquante millions de francs rwandais (50.000.000 FRW) au moment de la demande du service financier ; 4° Inyemezamasezerano y’ubwishingizi: Inyandiko igaragaza amasezerano hagati y’ubwishingizi n’umuguzi; 4° Policy: a written document that evidences a contract of insurance between an insurer and the consumer; 4° Police d’assurance: un document écrit attestant d'un contrat d'assurance entre un assureur et le consommateur; 5° Uhabwa ubwishingizi: umuntu ugirana amasezerano n’umwishingizi; 5° Policyholder: person who enters into an insurance contract with an insurer; 5° Titulaire de la police: personne qui conclut un contrat d'assurance avec un assureur; 86

Amakuru y’Ingenzi (KFS) :
inyandiko itegurwa n’umwishingizi n’abahuza mu bwishingizi yanditse mu buryo bwujuje ibisabwa byose kandi itanga amakuru ajyanye n’ibyo aya mabwiriza agena byose ; 6° Key Facts Statements (KFS): a document prepared by an Insurer and insurance intermediaries in a standardized format and containing the information that meets all the requirements of this Regulation; 6° Déclaration des Informations Clés:
un document préparé par un assureur et les intermédiaires d’assurance dans un format normalisé et contenant les informations qui répondent à toutes les exigences du présent règlement; 7° Umwishingizi : ikigo gifite ubuzima gatozi cyemewe cyangwa cyahawe ububasha bwo gutanga serivisi z’ubwishingizi ; 7° Insurer: a licensed or authorized legal entity which carries on insurance business; 7° Assureur: une personne morale agréée ou autorisée qui exerce une activité d'assurance; 8° Guha abakiriya bose amahirwe angana (TCF) : bivuga ko umwishingizi n’abamuhagarariye bagomba gufata neza abakiriya babo, bababwiza ukuri, nta vangura kandi servisi y’ubwishingizi itanzwe ikaba inoze, ikoranywe ubunyamwuga n’umuhate bikwiye. 8° Treating Customer Fairly (TCF):
implies that an insurer and its representatives must treat their customer fairly, honestly, without discrimination and exercise due care, skill and diligence with regard to the insurance product or service it offers. 8° Traiter le Client Equitablement (TCF): implique qu'un assureur et ses représentants doivent traiter leur client de façon équitable, honnête et sans discrimination tout en exerçant le soin, la compétence et la diligence nécessaires à l'égard du produit ou du service d'assurance offert. In this respect, an insurer and an Insurance Intermediary act with due skills, care and diligence when dealing with customers and shall not place their interests above those of its consumer. An Insurer and Insurance Intermediaries must provide a Consumer, when required by this Regulation, with a completed Key Facts Statement in the form prescribed in Appendix I of this Regulation and displayed on paper or on any other Durable Medium and, in all cases, in a form that the Consumer can keep for future reference. A Key Facts Statement shall be presented in one of the official languages of the Republic of Rwanda as chosen by the Consumer.   Umuguzi agomba kumenyeshwa neza ingaruka zo kudakora cyangwa gukora ibinyuranye n’ibyo asabwa bishobora gutuma ubwishingizi buhagarara. Ingero ni nko :

• Kutishyurira umusanzu ku gihe cyagenwe ;

• Kudatangaza amakuru y’ingenzi.

4. Andi makuru
   Aya makuru kuri serivisi unayahabwa n’intumwa/umukozi mu <izina ry’umwishingizi> cyangwa umuhuza wigenga mu bwishingizi wemewe (nusanga bikwiye ubisibe). Igice kimwe cy’igihembo cyabo gishobora kugenwa bitewe n’umubare ndetse n’ubwoko bwa serivisi bafashije abakiriya kugura. Hakurikijwe itegeko, basabwa gukorana ubushishozi n’umwete igihe baganira nawe ku biciro kandi bagashyira inyungu zawe hejuru y’izabo bwite. <Izina ry’umwishingizi> twishingira kandi tubazwa ibikorwa wakorewe ni intumwa yacu cyangwa umukozi wacu ubifitiye ububasha. Umuhuza wigenga mu bwishingizi nawe yishingira kandi akabazwa ibyo yakoze mu izina ryawe (nusanga bikwiye ubisibe). Nanone kandi ni ngombwa cyane gusobanura bihagije niba hari umusanzu wakwishyuranwa n’indi serivisi ku buryo ubwishingizi bwagurishirizwa hamwe n’iyo serivisi kuko iki na cyo ari igikorwa cyiza. 10. Ese ni ngombwa kongeramo amakuru yerekeye inshingano n’ibyishingiwe?
    Mu mikoranira myiza ijyanye n’icuruzwa ry’ ubwishingizi, birakwiye ko hakorwa ibishoboka kugira ngo hagabanywe ibihombo hafatwa ingamba zo kubitahura no kubigaragaza mbere y’uko biba. Ibihombo bikomeye umuguzi w’ubwishingizi akwiye gusuzumana ubwitonzi ni ibijyanye n’ibyo yakora cyangwa atakora byatuma atakaza ubwishingizi yari yizeye.     Iyo hatanzwe ubwishingizi bushingiye ku masezerano y’igihe gito, umwishingizi agomba kumenyesha mu nyandiko umuguzi igihe amasezerano y’ubwishingizi azarangirira ku buryo bishobora no gusobanurwa neza mu Nyandiko Imenyekanisha Amakuru y’Ingenzi mu magambo nk’aya:
    «Amasezerano yawe azarangira nyuma y’umwaka umwe keretse unaniwe kwishyura imisanzu yose iteganyijwe mbere y’icyo gihe, kandi inyandiko igaragaza igihe ubwishingizi buzarangirira tugomba kuyiguha dushimangira ko amasezerano yarangiye».

    Yego. APPENDIX I: KEY FACTS STATEMENT (KFS) FOR INSURANCE PRODUCT
KEY FACTS STATEMENT

1. Preamble
   The National Bank of Rwanda regulates the insurance sector. It requires us, <Name of insurer/Insurance Intermediary> as the provider of this insurance, to give you this important information. The information about our <name of product> insurance is provided to help you understand how it might be right for you. You should read this document carefully so that you understand what you are buying, and then keep it safe for future reference. If you are not sure whether this product is suitable for you, our “Name/title of insurer/Insurance Intermediary’s adviser” will be happy to help you with any questions. You will be asked to complete an application form that we will use to decide whether or not to issue an insurance policy. The insurance policy, when issued, will be provided to you and is an important document that contains the full details of the contract between us and you.

Appendix II
Part A – Guidance to Insurer and Insurance Intermediaries for completing key aspects of a KFS for
Insurance product

1. For which types of Insurance products must I complete and provide a KFS for Insurance product?
   A KFS for Insurance product is required for all Insurance productsin accordance with this regulation.

2. Does all of the information in a KFS have to be completed?
   Yes, all of the types of information specified in the KFS template in Appendix I of the Regulation must be included for the relevant Insurance product. You must otherwise not delete any of the information included in the template except to the extent absolutely necessary to ensure that the KFS is not misleading in relation to your Insurance product. It should also contain significant or unusual exclusions or limitations. An exclusion would be judged to be significant or unusual if it would be expected to normally impact decisions of consumers, if it may not be clear to customers otherwise (As evidenced by patterns of past complaints), or would not usually be found in comparable contracts issued by other insurers etc. Even those exclusions that are adopted more generally may still be worth mentioning if they would be considered material such as those that are drawn from laws (eg, suicide in the case of life insurance). Notwithstanding with the provision of the above paragraphs, the KFS should not be more than two or three standard pages in length. It can be less if an Insurance company determines that all information can be covered in a smaller space. This constraint means that insurers have to ensure that their language is plain and simple and that the issues covered are the material ones for clients.

3. Does each fee or charge need to be disclosed separately or can I aggregate them?
   You must disclose each required premium, fee or charge separately or bundled.

4. Can I amend the fee determined in the KFS?
   You must use the exact fee descriptions determined in the KFS unless doing so would mislead the consumer, in which case you may amend them only to the extent absolutely necessary to ensure that they are accurate. You may not amend determined fee descriptions simply because you prefer to refer to the same type of fee in a different way. 115

5. What if a fee or other amount required to be disclosed in the KFS is in not known at the time that the
   KFS needs to be provided?
   Under the Regulation you are required to disclose any fee, charge, limit or other amount as follows:
    if the amount applies in FRW and is known at the date of the KFS, you must specify it in FRW; or  if the amount is not known as at the date of the KFS and it will be calculated by reference to a percentage of another amount in FRW, you must specify that percentage and, in the case of a fee or charge, also the amount that would be payable for every FRW 1,000 of the reference amount; or  if the amount is not known as at the date of the KFS and it will be calculated on any other basis, you must describe that basis clearly and concisely in the KFS;  if the amount is known as at the date of the KFS, but may be subject to change in certain circumstances , you must, in addition to the above, also include this information clearly and concisely in the KFS.

6. Do fee amounts in a KFS have to include Value Added Tax (VAT)?
   Yes, any fee or charge amount specified in a KFS must be inclusive of VAT where it is applicable.

7. What types of fees or charges do not need to be included in a KFS?
   A KFS is not required to include any fee or charge that is payable as a result of a cancellation or non￾payment of a transaction.

8. What is the payment am I required to pay for the product?
   The KFS should address how the product is paid for. The premium, dates due, period’s payable, and related information needs to be given some attention. It is also especially relevant to bring some transparency if there is a premium bundled with another product that the insurance may be sold in combination / bundled with as this is a good practice. When combined with other products, the KFS should note whether or not the customer may choose an alternative product than the one being offered. Indicate the Levels of fees, charges etc. deducted from premiums or added to the quoted premiums and any charges that the customer might have been charged directly to them, where applicable.

9. Do I need to present KFS in a separate document or include the product brochure?
   The KFS may be presented as a separate document or it may be included as the first, second and third page in a larger product brochure and insurer as well as Insurance Intermediaries should retain evidence that the 116

KFS was provided to the client through acknowledgement of this on the application form or by retaining a signed copy or part thereof in the application file. Regardless of where the KFS is included, the words “Key Facts Statement” (or equivalent in the language of the KFS) should be prominent at the top of each page.
10. Is it required to include Information about obligations and risks?
For the sale of insurance relationship, there should be good practice to attempt to reduce risks through proactive communication before the event. The main risks that an insurance consumer usually needs to have drawn to their attention are the risks that they act or fail to act in a way that leads to a loss of coverage that would have otherwisebeen expected and can be stated in the contract for example:
“consequences of failure tomake premium payments in a timely manner or failure to disclose material facts when making an application shall imply the cancellation of insurance contract”. Information on rights and obligations in details should be determined by insurers and Insurance Intermediaries in accordance the provisions of this regulations.
11. Is there any notice for expiration of insurance contract required?
Where insurance cover under an insurance contract is provided for a limited period of time, an insurer shall give the policyholder written notice of the expiration of the insurance contract and can be stated in the KFS illustratively as follow:
“Your insurance is intended to end after one year, unless you fail to pay any due premium before then, and a notice of when the cover ends is required to be provided by us to you to confirm that it has ended”.
12. Do I need to insert special issues in the KFS?
Yes, it is paramount importance to address the material regarding insurance intermediaries and the existence of coverage under the special guarantee fund and respectively mention in the KFS information regarding the status, responsibilities, obligations and potential conflicts that are part of an insurance intermediary involvement in the purchase of insurance and can be formulated as follow:
This product is provided through a licensed agent who represents <name of insurer>. They are paid by commissions based on the volume of premiums on products that they sell to you and other customers. Licensed agents are required, under the law, to act with care and diligence when dealing with you and to place your interests above their own. <name of insurer> is accountable to you for the actions of our licensed agents.
13. Do I need to include in the KFS the information on claim and complain process?
Yes, at the end of the KFS, there should be information on how to contact the insurer/an Insurance Intermediariesin the event that the customer wishes to “access the services” under the product. These services would include making claims, but also addressing other servicing issues or, for that matter, making a complaint. 117

Part B – Guidance for explaining a KFS to a consumer
As an Insurer aor an Insurance Intermediary, you are required by Article 10 to provide an adequate oral explanation to a consumer about any information provided in a KFS in relation to which they have a question. You are also required to provide a full explanation of a KFS to a consumer if it is reasonably clear that they are illiterate or blind. The following guidance, in the form of potential questions from consumers and responses by the Insurer and the insurance intermediary, is intended to assist you to provide such explanations. You must ensure that your explanations are consistent with this guidance (to the extent relevant). You must also ensure that those explanations are adequate for the specific consumer (e.g., depending on the consumer’s circumstances and questions, you may need to address matters not covered in this guidance or provide a more detailed explanation than provided for in this guidance). You should also develop internal guidance for staff to assist them to explain features specific to your Insurance product, such as:
 Insurance product, signing of a policy, and contract termination requirements;  the consequences of early termination of policy’s obligations;  the consequences of non-paying premiums and violation of other policy’s obligations; the features of each services referred to in the KFS.

1. Why have you given me the KFS? / What is the purpose of the KFS?
   If the KFS is provided to a consumer when they make an inquiry, or seek information, about a particular Insurance product, you should explain:
   The KFS provides you with key information about our Insurance product to better understand the costs and features of the Insurance product. It provides you with information on the benefits of the policy, the risks that are insured by the contract and the risks that are excluded. You can use the KFS to compare the costs and features of our Insurance product with those Insurance products offered by other insurance companies (who must also give you a KFS about their Insurance products). The KFS should also inform you about when the cover begins and ends. You should read the KFS carefully to ensure that you understand these costs and other features. You should also read the KFS carefully and you can ask us questions about any of the information that it contains. You will also be given an up-to-date KFS when you subscribe for an Insurance product. If the KFS is provided to a consumer when they are signing a policy for an Insurance product:

After carefully reading the KFS, you will be asked to complete an application form that we will use to decide whether or not to issue an insurance policy. The insurance policy, when issued, will be provided to you and is an important document that contains the full details of the contract between us and you
2. What is the premium and related charges I can pay?
The premium is the payment due by the policyholder to the insurer under an insurance contract. This is the amount you shall pay periodically (monthly/quarterly, annually or semi-annually, etc) in accordance to the provisions of the policy for Insurance product you choose. We determine premium with consideration of underwriting result based on the information you disclosed in application form you filled relating to the insured event [explain in details the basis for determination of premiums and other related charges where applicable].
3. Can the ‘the premium’ change?
If the KFS specifies that the premium is “variable”: Yes, the premium is variable, which means that we may change it in the future. We will notify a policyholder of this change by [explain how you notify the premium changes. You should also provide further details regarding when the premium may change from time to time and the consequences implied]. If the KFS specifies that the premium is not “variable”: No, the premium for Insurance product purchased will remain unchanged as specified in the KFS provided to you on the day that you subscribe for an Insurance product.
4. Is the KFS a contract for an Insurance product?
The KFS is not a contract for an Insurance product or an offer to enter into a contract. The KFS does not supersede or replace the fuller explanation of the contract, and gives a clear indication of the process of completing the application and the acceptance or otherwise of the policy. If you would like to subscribe for an Insurance product, you need to fill an application form for insurance product and sign a required policy.
5. Will the premium fees and charges included in KFS be the same as those in the
insurance product policy?
If you are giving the KFS because the consumer has made an inquiry, or sought information, about an Insurance product: The premium or fees and charges for your 119

Insurance product may be different, depending on when you fill an application form and sign an Insurance product policy since the premium, fees and charges may have changed in the meantime. If you are giving the KFS because the consumer is filling an application form and signing a policy for an Insurance product: The information in the KFS reflects the premium, fees and charges and features of your Insurance product as at the date of signing a policy for insurance product. However, as noted in the KFS, things like premium, fees and charges and features may change in the future. We will notify a policyholders of such changes by [explain how you notify changes]
6. Why do you need me to sign the KFS?
We are required by law to provide you with a KFS when you subscribe for an Insurance product. We ask you to sign the KFS to show that we have provided it to you when we are required to do so. 120

Vous devriez lire attentivement ce document afin que vous compreniez ce que vous achetez, puis conservez-le en toute sécurité pour référence future. Si vous n'êtes pas certain que ce produit vous convient, notre «Nom / titre de l'assureur / conseiller en assurance» sera à votre disposition pour toute question. Vous serez invités à remplir un formulaire de demande que nous utiliserons pour décider de l'émission ou non d'une police d'assurance. 1. Pour quels types de produits d’assurance dois-je remplir et donner une Déclaration des Informations
   Clés pour un produit d’assurance ?
   Une Déclaration des Informations Clés pour un produit d’assurance est requise pour tous les produits d’assurance conformément au présent règlement.
2. Toutes les informations contenues dans une Déclaration des Informations Clés doivent-ils être
   remplis ?
   Oui, tous les types d'information spécifiés dans le modèle de Déclaration des Informations Clés de l'Annexe I du present Règlement doivent être inclus pour le produit d'assurance concerné. Vous ne devez supprimer par ailleurs aucune des informations incluses dans le modèle, sauf dans la mesure absolument nécessaire pour garantir que la Déclaration des Informations Clés n'est pas trompeuse par rapport à votre produit d'assurance. Il doit également contenir des exclusions ou des limitations importantes ou inhabituelles. Une exclusion est jugée importante ou inhabituelle si elle devait normalement avoir une incidence sur les décisions des consommateurs, si elle n'est pas claire pour les clients ou ne serait pas habituellement trouvée dans des contrats comparables émis par d'autres assureurs, etc. Même les exclusions qui sont adoptées de façon plus générale peuvent encore être mentionnées si elles seraient considérées comme significatives telles que celles tirées des lois (par exemple, le suicide dans le cas d'une assurance-vie). Nonobstant la disposition des paragraphes ci-dessus, la Déclaration des Informations Clés ne doit pas avoir plus de trois pages standards. Elle peut être moins si l’assureur détermine que toutes les informations peuvent être couvertes dans un espace plus restreint. Cette contrainte signifie que les assureurs doivent s'assurer que leur langue est claire et simple et que les questions abordées sont les plus importantes pour le consommateur.

4. Puis-je modifier le prix déterminé dans la Déclaration des Information Clés ?
   Vous devez utiliser les descriptions exactes des prix déterminées dans la Déclaration des Informations Clés à moins que cela ne trompe le consommateur ; dans ce cas vous ne pouvez les modifier que dans la mesure absolument nécessaire pour garantir qu’elles sont exactes. 5. Que se passe-t-il si le prix ou un autre montant exigé pour être divulgué dans la Déclaration des
Informations Clés n'est pas connu au moment où la Déclaration des Informations Clés doit être donnée ? En vertu du règlement, vous devez divulguer tous les frais, charge, limite ou autre montant comme suit :
 si le montant est en Frw et est connu à la date de la Déclaration des Informations Clés, vous devez le spécifier en Frw; ou  si le montant n'est pas connu à la date de la Déclaration des Informations Clés et qu'il sera calculé par référence à un pourcentage d'un autre montant en Frw, vous devez spécifier ce pourcentage et, dans le cas des frais ou d'une charge, spécifier également le montant qui serait payable pour chaque
1.000 Frw du montant de référence;
 si le montant n'est pas connu à la date de la Déclaration des Informations Clés et qu'il sera calculé sur une autre base, vous devez décrire cette base de façon claire et concise dans la Déclaration des Informations Clés;  si le montant est connu à la date de la Déclaration des Informations Clés, mais peut être sujet à des changements dans certaines circonstances, vous devez, en plus de ce qui précède, inclure également dans la Déclaration des Informations Clés ces informations de façon claire et concise.
6. Les montants dans une Déclaration des Informations Clés doivent-ils inclure la Taxe sur la Valeur
Ajoutée (TVA)?
Oui, tous les montants des frais ou charges spécifiés dans une Déclaration des Informations Clés doivent inclure la TVA là où il est applicable.
7. Quels types de frais ou charges qui ne doivent pas être inclus dans une Déclaration des Informations
Clés ?
Une Déclaration des Informations Clés n'est pas tenue d'inclure tous les frais ou charges qui sont payables à la suite d'une annulation ou de non-paiement d'un service. 126

8. Quel est les frais ou charges que je suis tenus de payer pour le produit ?
   La Déclaration des Informations Clés devrait indiquer comment le produit est payé. La prime, les dates d'échéance, la période à payer et les informations connexes doivent faire l'objet d'une certaine attention. Il est également particulièrement pertinent d'apporter un peu de transparence si une prime est offerte avec un autre produit où l'assurance pourrait être vendue en combinaison avec ce produit, car il s'agit d'une bonne pratique. Lorsqu'elle est combinée avec d'autres produits, la Déclaration des Informations Clés doit noter si le consommateur peut choisir un autre produit que celui offert. Indiquer les Niveaux des frais, charges, etc. déduits des primes ou ajoutés aux primes estimées et tous les frais qui aurait été facturé, le cas échéant.
9. Dois-je présenter la Déclaration des Informations Clés dans un document séparé ou dois-je l’attacher
   dans la brochure indiquant les conditions general du produit ?
   La Déclaration des Informations Clés peut être présentée comme un document séparé ou elle peut être la première, la deuxième et troisième page dans une brochure indiquant les conditions generales du produit et l’assureur ainsi que les intermédiaires d’assurance doivent conserver la preuve que la Déclaration des Informations Clés a été donnée au consommateur et conserver une copie signée dans le dossier de demande. Peu importe là où la Déclaration des Informations Clés est incluse, les mots « Déclaration des Informations Clés » (ou l’équivalent dans La langue de la Déclaration des Informations Clés) devraient être en tête en haut de chaque page.
10. Est-il nécessaire d'inclure des informations sur les obligations et les risques ?
    Pour la bonne relation de vente d'assurance, il devrait être une bonne pratique de tenter de réduire les risques par une communication proactive avant l'événement. Les principaux risques auxquels un consommateur d'assurance doit habituellement attirer son attention sont les risques qui auraient pourtant été prévus auxquels il signe un contrat ou non d'une manière qui entraîne une perte de couverture et qui peuvent être indiqués dans le contrat suivant cet exemple: «Les conséquences de l’omission de verser les primes en temps opportun ou le défaut de divulguer des informations importantes lors de la présentation d'une demande de service pourront impliquer l'annulation du contrat d'assurance». L'information sur les droits et obligations en détails devrait être déterminée par les assureurs et les intermédiaires d'assurance, conformément aux dispositions du présent règlement.
11. Y a-t-il un avis d'expiration du contrat d'assurance requis ?
    Lorsqu’une couverture d’assurance en vertu d’un contrat d'assurance est donnée pour une durée limitée, l'assureur doit donner au preneur d'assurance un avis écrit de l'expiration du contrat d'assurance et peut être indiqué dans la Déclaration des Informations Clés à titre illustratif comme suit: «Votre assurance est destinée à prendre fin après un an, à moins que vous ne parveniez pas à payer toute la prime due avant 127

cette date, et un avis de la fin de la couverture doit être fourni par nous à vous pour confirmer qu'elle a pris fin».
12. Dois-je insérer des problèmes spéciaux dans la Déclaration des Informations Clés ?
Oui, il est primordial d’aborder les problèmes essentiels concernant les intermédiaires d'assurance et l'existence d'une couverture par le Fonds Spécial de Garantie et mentionner respectivement dans la Déclaration des Informations Clés, les informations sur le statut, les responsabilités, les obligations et les conflits potentiels qui font partie de l'engagement d'un intermédiaire d'assurance dans l'achat d'une assurance et peuvent être formulées comme suit :
Ce produit est fourni par un agent autorisé qui représente <nom de l'assureur>. Ils sont payés selon des commissions basées sur le volume des primes sur les produits qu'ils vendent à vous et à d'autres clients. Les agents autorisés sont tenus, en vertu de la loi, d'agir avec prudence et diligence lorsqu'ils traitent avec vous et de placer vos intérêts au-dessus de leurs propres. <Nom de l'assureur> est responsable envers vous des actions de nos agents autorisés.
13. Dois-je inclure dans la Déclaration des Informations Clés l'information sur le processus de
réclamation et de plainte?
Oui, à la fin de la Déclaration des Informations Clés, il devrait y avoir des informations sur la façon de contacter l'assureur/un intermédiaire d’assurance dans le cas où le consommateur souhaite « accéder aux services » liés au produit. Ces services comprennent des réclamations, mais aussi d'autres questions relatives au service ou, d’ailleurs, à la manière de déposer une plainte. 128

Partie B - Guide pour expliquer une Déclaration des Informations Clés, à un consommateur En tant qu'assureur ou un intermédiaire d'assurance, il vous est demandé par l'article 10 de ce règlement, de donner des explications orales appropriées à un consommateur à propos de toutes les informations contenues dans la Déclaration des Informations Clés, sur lesquelles il a des interrogations. Il vous est également demandé de donner des explications complètes d'une Déclaration des Informations Clés, à un consommateur s'il est raisonnablement clair qu'il est analphabète ou aveugle. Le guide suivant, présenté sous forme des questions potentielles des consommateurs et des réponses de l'assureur et de l’intermediare d’assurance, ont pour objet de vous faciliter la tâche de donner ces explications. Vous devez vous assurer que vos explications sont cohérentes avec ce guide (au niveau requis). Vous devez également vous assurer que ces explications sont appropriées pour le consommateur spécifique (ex: selon les circonstances et les questions du consommateur, vous pouvez embrasser des sujets qui ne sont pas développés dans ce guide ou donner des explications plus détaillées que celles présentées dans le guide). L’assureur et un Courtier d'Assurance doivent également élaborer un guide interne à l'intention du personnel pour les aider à expliquer les caractéristiques propres à votre produit d'assurance, notamment :
 le produit d'assurance, la signature d'une police et les exigences de résiliation de contrat;  les conséquences de la résiliation anticipée de la police d’assurance ;  les conséquences des primes non acquittées et la violation des obligations d'autres polices d’assurance;  les caractéristiques de chaque produit mentionné dans la Déclaration des Informations Clés.

1. Pourquoi m'avez-vous donné la Déclaration des Informations Clés ? /Quel est l’objet
   de cette Déclaration des Informations Clés ?
   S’il est donné une Déclaration des Informations Clés à un consommateur quand il fait des investigations, ou quand il est en enquête d’informations sur un produit quelconque, vous devez lui donner des explications :
   La Déclaration des Informations Clés vous donne des informations clés sur notre produit d'assurance pour vous aider à mieux comprendre les coûts et les caractéristiques du produit d'assurance. Elle vous donne des informations sur les avantages de la police d’assurance, les risques qui sont assurés par le contrat et les risques qui sont exclus. Vous pouvez vous servir la Déclaration des Informations Clés pour comparer le coût et les caractéristiques de notre produit d'assurance avec ceux qui sont offerts par d'autres sociétés d'assurance (qui peuvent eux aussi vous donner une Déclaration des Informations Clés sur leurs produits d'assurance). La Déclaration des Informations Clés doit également vous informer du moment où la couverture commence et se termine. Vous devez lire attentivement la Déclaration des Informations Clés pour vous assurer que vous comprenez ces coûts et autres caractéristiques. Vous devez également lire attentivement la Déclaration des Informations Clés et vous pouvez nous poser des questions sur les informations qu'il 129

contient. Vous recevrez également une Déclaration des Informations Clés actualisée lorsque vous allez souscrire à un produit d'assurance. Si la Déclaration des Informations Clés est donnée à un consommateur quand il signe une police pour un produit d’assurance :
Après avoir lu attentivement la Déclaration des Informations Clés, vous devrez remplir un formulaire de demande que nous utiliserons pour décider de conclure ou non une police d'assurance. La police d'assurance, une fois émise, vous sera fournie et constitue un document important qui contient tous les détails du contrat entre nous et vous.
2. Quelle est la prime et les charges connexes que je peux payer ?
La prime est le paiement dû par le preneur d'assurance à l'assureur en vertu d'un contrat d'assurance. Il s'agit du montant que vous devez payer périodiquement (mensuel/trimestriel, annuel ou semestriel, etc.) conformément aux dispositions de la police pour le produit d'assurance que vous choisissez. Nous déterminons la prime en tenant compte du résultat de souscription en fonction des informations que vous avez communiqué dans le formulaire de demande que vous avez rempli relatif à l'événement assuré [expliquer en détail les bases de détermination des primes et autres charges relatives, le cas échéant]
3. La « prime » peut-elle changer ?

4. La Déclaration des Informations Clés est-elle un contrat pour un produit d’assurance
?
La Déclaration des Informations Clés n'est pas un contrat pour un produit d'assurance ou une offre pour conclure un contrat. La Déclaration des Informations Clés n’annule ou ne 130

remplace pas l'explication plus complète du contrat et donne une indication claire du processus de remplir la demande et l'acceptation ou non de la police. Si vous souhaitez souscrire à un produit d'assurance, vous devez remplir un formulaire de demande pour le produit d'assurance et signer une police requise.
5. Les primes et charges incluses dans la Déclaration des Informations Clés sont-elles les
mêmes que ceux de la police d’assurance ?
Si vous donnez la Déclaration des Informations Clés parce que le consommateur a fait la demande, ou s’informer sur un produit d’assurance : La prime ou les frais et charges pour votre produit d'assurance peuvent être différents selon le moment où vous remplissez un formulaire de demande et signez une police d'assurance, puisque la prime, les frais et les charges peuvent avoir été changé entre-temps. Si vous donnez la Déclaration des Informations Clés parce que le consommateur remplit un formulaire de demande et signe une police pour un produit d’assurance : Les informations contenues dans la Déclaration des Informations Clés reflètent la prime, les frais, les charges et les caractéristiques de votre produit d'assurance ainsi que la date de signature d'une police d'assurance. Cependant, comme noté dans la Déclaration des Informations Clés, la prime, les frais et les charges et les dispositifs peuvent changer à l'avenir. Nous aviserons les assurés de ces changements par [expliquer comment vous communiquez les modifications]
6. Pourquoi me demandez-vous de signer la Déclaration des Informations Clés ?
Nous sommes tenus par la loi de vous donner une Déclaration des Informations Clés lorsque vous souscrivez pour un produit d'assurance. Nous vous demandons de signer la Déclaration des Informations Clés pour montrer que nous vous l'avons offert étant donné que nous sommes tenus de le faire. 131
