Feedback on Exemption of Directorships Connected to Authorised and Registered Collective Investment Schemes

The Guernsey Financial Services Commission issued final regulations on 8 July 2023 to exempt specific directorships from licensing under the Fiduciaries Law, 2020. The new rules introduce a targeted exemption for directors of companies connected to authorised or registered collective investment schemes and create additional exemptions for directors of family companies, state-owned entities, and non-Bailiwick supervised financial firms. These changes align with the new directorship registration regime and aim to reduce the scope of activities requiring personal fiduciary licensing while maintaining anti-money laundering oversight.
