Final Report on Draft Regulatory Technical Standards and Guidelines on Business Reorganisation Plans

The European Banking Authority submits draft regulatory technical standards and guidelines to the European Commission for endorsement regarding business reorganisation plans under the Bank Recovery and Resolution Directive. The draft standards require institutions subject to the bail-in tool to submit plans that identify failure causes and demonstrate long-term viability, including financial projections and progress reports submitted twice annually. The guidelines mandate resolution and competent authorities to assess plan credibility, strategy appropriateness, and consistency with public policy objectives, while establishing coordination procedures to resolve divergences between authorities. The technical standards are scheduled to apply 20 days after publication in the Official Journal of the European Union, and the guidelines will apply 3 months after translation into all EU official languages.
