CONCERNING
THE MANAGEMENT OF PROFESSIONAL CERTIFICATION BODIES
IN THE FINANCIAL SERVICES SECTOR
BY THE GRACE OF GOD THE ALMIGHTY
THE BOARD OF COMMISSIONERS OF THE FINANCIAL SERVICES AUTHORITY,
Considering :
a. that in order to realize a national economy capable of sustainable and stable growth,
human resources are needed who are able to carry out activities in the financial services
sector in an orderly and accountable manner;
b. that in order to improve the quality of human resources in the financial services sector,
it is necessary to have work competency certification that is in accordance with the needs of
the financial services industry;
c. that in order to maintain the quality of work competency certification carried out and
issued by professional certification bodies, it is necessary to regulate the procedures for
ensuring that certification is carried out in accordance with work competency standards and the
established qualification framework;
d. that based on the considerations referred to in letters a, b, and c, it is necessary to establish
a Financial Services Authority Regulation regarding
The Management of Professional Certification Bodies in the
Financial Services Sector;
Considering : Law Number 21 of 2011 concerning the Financial Services Authority (State Gazette of the
Republic of Indonesia Year 2011 Number 111, Supplement to the State Gazette of the
Republic of Indonesia Number 5253);
DECIDES:
To Establish : A FINANCIAL SERVICES AUTHORITY REGULATION CONCERNING
THE MANAGEMENT OF PROFESSIONAL CERTIFICATION BODIES IN
THE FINANCIAL SERVICES SECTOR.
CHAPTER I
GENERAL PROVISIONS
Article 1
In this Financial Services Authority Regulation, the following terms are meant by:
1. The Indonesian National Qualification Framework, hereinafter abbreviated as KKNI, is a framework
for classifying competency qualifications that can juxtapose, equate, and integrate between the fields of education and
work training fields, as well as work experience in the context of granting work competency recognition in accordance with
the job structure in various sectors.
2. The Indonesian National Work Competency Standards, hereinafter abbreviated as SKKNI, is a formulation of
work capabilities that covers aspects of knowledge, skills and/or expertise as well as work attitudes that are
relevant to the implementation of tasks and job requirements established in accordance with applicable legislation.
3. Work Competency Certification is the process of granting work competency certificates that is carried out
systematically and objectively through competency testing in accordance with SKKNI.
4. Qualification is the mastery of learning outcomes that states the competency level or expertise in KKNI.
5. The National Professional Certification Body, hereinafter abbreviated as BNSP, is an independent institution formed
to carry out Work Competency Certification.
6. Professional Certification Body, hereinafter abbreviated as LSP, is an institution that carries out professional certification
activities that have met the requirements and have obtained a license from BNSP.
7. Certification Scheme is the pattern of competency certification used as a reference for the implementation of
professional competency certification, which consists of a set of competency units sourced from work competency standards
as well as other requirements related to competency recognition in types of work.
Article 2
The management of LSPs in the financial services sector aims to:
a. provide references and guidelines for LSPs in submitting recommendations and LSP registration to the Financial
Services Authority as well as updating certification data;
b. provide references and guidelines to the financial services industry in developing human resources through
Work Competency Certification by LSPs that are in accordance with industry needs; and
c. build a sustainable learning ecosystem through the application of KKNI through the mechanism of
LSP management in the financial services sector.
Article 3
(1) The management of LSPs in the financial services sector is carried out by considering the needs for human resource development in the sectors:
a. banking;
b. capital markets; and
c. insurance, pension funds, financing institutions,
and other financial service institutions as referred to in
the Law concerning the Financial Services Authority.
(2) The management of LSPs in the financial services sector
as referred to in paragraph (1) is implemented through stages that include:
a. issuance of recommendations for LSPs;
b. LSP registration; and
c. updating of certification data carried out by
LSPs.
CHAPTER II
ISSUANCE OF RECOMMENDATIONS FOR LSPs
Article 4
(1) LSPs submit applications for recommendation letters to the Financial Services Authority.
(2) The submission of recommendation letters as referred to in paragraph (1) is a requirement for LSPs to
obtain a license or approval from BNSP for:
a. the license of an LSP that will be established; or
b. approval of changes to the Certification Scheme including changes to the scope of the LSP license.
(3) The recommendation letter as referred to in paragraph (2) letter a is issued by the Financial Services Authority for LSPs that
meet the criteria:
a. established by an industry association and/or a professional association recognized by the Financial Services Authority;
b. is a legal entity separate from its founders and able to act professionally
and independently, including towards the financial services industry;
c. has an organizational structure consisting of at least
guiding elements, and implementing elements that are independent and do not hold concurrent positions
as members of the board of directors or equivalent, members
of the board of commissioners or equivalent, and employees in
the financial services industry; and
d. has a Certification Scheme containing:
1. structure in accordance with guidelines established by
BNSP;
2. competency units in accordance with SKKNI established
by the Ministry of Manpower; and
3. Qualification levels in accordance with KKNI established
by the Financial Services Authority.
(4) In the event that there are specific industries and/or professions that do not yet have an association as referred to in
paragraph (3) letter a, the establishment of an LSP can be carried out by a regulator or other institution appointed by
the government.
(5) To obtain a recommendation from the Financial Services Authority as referred to in paragraph (2) letter a,
LSPs established by a regulator or other institution appointed by the government must meet the requirements
as referred to in paragraph (3) letters b, c, and d.
(6) The recommendation letter as referred to in paragraph (2) letter b is issued by the Financial Services Authority for LSPs that
meet the criteria:
a. established by an industry association and/or a professional association recognized by the
Financial Services Authority, or a regulator or other institution appointed by
the government; and
b. has a change to the Certification Scheme containing:
1. structure in accordance with guidelines established by
BNSP;
2. competency units in accordance with SKKNI established
by the Ministry of Manpower; and
3. Qualification levels in accordance with KKNI established
by the Financial Services Authority.
Article 5
(1) The submission of applications for recommendation letters as referred to in Article 4 paragraph (2) letter a must
attach documents:
a. a certificate of fulfillment of the appreciation process by
BNSP;
b. proof of establishment of the LSP by:
1. an industry association and/or a professional association in
the financial services sector recognized by the Financial
Services Authority;
2. a regulator; or
3. another institution appointed by the government;
c. a photocopy of the LSP's articles of association;
d. the structure and organizational profile of the LSP; and
e. The Certification Scheme.
(2) The submission of applications for recommendation letters as referred to in Article 4 paragraph (2) letter b must
attach documents:
a. proof of establishment of the LSP by:
1. an industry association and/or a professional association in
the financial services sector recognized by the Financial
Services Authority;
2. a regulator; or
3. another institution appointed by the government;
b. a photocopy of the LSP's articles of association;
c. the structure and organizational profile of the LSP; and
d. changes to the Certification Scheme.
Article 6
(1) The Financial Services Authority issues a recommendation letter for the submission of an LSP recommendation letter application
within a maximum of 20 (twenty) working days from the date the application for the recommendation letter and the documents required
as referred to in Article 5 paragraph (1) and paragraph (2) are received in full.
(2) In the event that the application documents for the recommendation letter
do not meet the requirements as referred to in
Article 5 paragraph (1) and paragraph (2), the LSP submits fulfillment of the required documents within a maximum of
15 (fifteen) working days from the date of receipt of the letter requesting document completeness from the Financial Services Authority.
(3) An LSP that does not submit fulfillment of the required documents within the time period as referred to in
paragraph (2) is deemed to have canceled the application for the recommendation letter.
(4) In the event that an LSP as referred to in paragraph (3)
submits a new application for a recommendation letter to the Financial Services Authority, the LSP must submit a new
application for a recommendation letter accompanied by
document requirements as referred to in Article 5 paragraph (1) and paragraph (2).
Article 7
(1) The recommendation letter issued by the Financial Services Authority has a validity period:
a. 1 (one) year from the date the recommendation is established for the
establishment of an LSP; or
b. 6 (six) months from the date the recommendation is established for
changes to the Certification Scheme.
(2) An LSP that does not submit an application for the establishment of an LSP
or approval of changes to the Certification Scheme within the time period as referred to in paragraph (1) to
BNSP, the recommendation letter that has been issued by the Financial Services Authority becomes invalid.
CHAPTER III
LSP REGISTRATION
Article 8
(1) Work Competency Certification programs in the financial services sector are carried out by LSPs registered with the Financial Services Authority.
(2) LSPs registered as referred to in paragraph (1) have a registered sign from the Financial Services Authority.
Article 9
(1) To obtain the registered sign as referred to in Article 8 paragraph (2), LSPs submit
a registration application to the Financial Services Authority.
(2) The submission of an LSP registration application as referred to in paragraph (1) must attach documents:
a. proof of license issued by BNSP that is still valid;
b. proof of establishment of the LSP by:
1. an industry association and/or a professional association in
the financial services sector recognized by the Financial
Services Authority;
2. a regulator; or
3. another institution appointed by the government;
c. a photocopy of the LSP's articles of association;
d. the structure and organizational profile of the LSP; and
e. The Certification Scheme or changes to the Certification Scheme
that have been validated by BNSP.
Article 10
(1) The Financial Services Authority issues a registered sign letter for the submission of an LSP registration application within a maximum of
20 (twenty) working days from the date the registration application and the documents required as referred to in
Article 9 paragraph (2) are received in full.
(2) The Financial Services Authority may announce the name of the LSP
that is registered with the Financial Services Authority as referred to in paragraph (1) on the website of the Financial Services Authority.
(3) In the event that the application documents for registration do not
meet the requirements as referred to in Article 9 paragraph (2), the LSP submits fulfillment of the required documents
within a maximum of 10 (ten) working days
from the date of receipt of the letter requesting document completeness
from the Financial Services Authority.
(4) An LSP that does not submit fulfillment of the required documents within the time period as referred to in
paragraph (3) is deemed to have canceled the application for registration.
(5) In the event that an LSP as referred to in paragraph (4)
submits a new registration application to the Financial Services Authority, the LSP must submit a new
registration application accompanied by document requirements
as referred to in Article 9 paragraph (2).
CHAPTER IV
UPDATING OF CERTIFICATION DATA
Article 11
LSPs registered with the Financial Services Authority are required to:
a. carry out certification activities continuously in the financial services sector according to the validity period of the license that has been issued by BNSP;
b. submit updates of LSP certification data to the Financial Services Authority;
c. adjust the Certification Scheme in accordance with the latest SKKNI established by the Ministry
of Manpower and the latest KKNI established by the Financial Services Authority;
d. submit institutional updates related to the LSP license to the Financial Services Authority;
e. issue work competency certificates in the financial services sector in accordance with the results of competency testing; and
f. revoke work competency certificates in the financial services sector if the holder of the work competency certificate in the financial services sector is proven guilty of committing a criminal offense in the financial sector based on a court decision that has permanent legal force or a violation of the professional code of ethics.
Article 12
(1) Data updates as referred to in Article 11 letter b are submitted periodically every semester at the latest by January 31 and July 31 of each year
to the Financial Services Authority electronically.
(2) In the event that the electronic system is not available or
experiences a disturbance, the submission of data updates
as referred to in paragraph (1) is carried out manually.
(3) Under certain conditions, the Financial Services Authority may
request other data related to the development of the implementation of certification.
(4) Other data as referred to in paragraph (3) must be submitted by the LSP within a maximum of 5 (five) working days from the date of receipt of the data request letter from the Financial Services Authority.
(5) If the deadline for submission of data updates and
other data as referred to in paragraph (1) and paragraph (4)
falls on a holiday, the submission of data updates and
other data is submitted at the latest 1 (one) working day
following.
CHAPTER V
ADMINISTRATIVE SANCTIONS
Article 13
LSPs registered with the Financial Services Authority proven to have committed violations:
a. do not carry out certification activities as referred to in Article 11 letter a;
b. do not submit updates of certification data to the Financial Services Authority as referred to in Article 11 letter b within the time period as referred to in Article 12 paragraph (1);
c. do not adjust the Certification Scheme as referred to in Article 11 letter c;
d. do not carry out institutional updates related to the LSP license as referred to in Article 11 letter d;
e. do not issue work competency certificates in the financial services sector in accordance with the results of competency testing as referred to in Article 11 letter e;
f. do not revoke work competency certificates in the financial services sector as referred to in Article 11 letter f;
or
g. do not submit other data related to the development of the implementation of certification as referred to in Article 12 paragraph (4),
are subject to administrative sanctions in the form of a written reprimand by the Financial Services Authority.
Article 14
LSPs registered with the Financial Services Authority proven to have committed violations:
a. do not implement the written reprimand as referred to in Article 13 letter a within a period of 6
(six) months from the date of the written reprimand letter;
b. do not implement the written reprimand as referred to in Article 13 letter b within a period of 3
(three) months from the date of the written reprimand letter; or
c. do not implement the written reprimand as referred to in Article 13 letters c through g
within a period of 30 (thirty) calendar days from the date of the written reprimand letter,
are subject to administrative sanctions in the form of revocation of the LSP registered sign by the Financial Services Authority.
CHAPTER VI
OTHER PROVISIONS
Article 15
In the event that there are indications of violations committed by an LSP
regarding the implementation of Work Competency Certification in the financial services sector, the Financial Services Authority carries out coordination
with BNSP.
Article 16
The Financial Services Authority may carry out coordination with
related agencies for the management of LSPs in the financial services sector.
Article 17
Further provisions regarding the application of Qualification levels
according to KKNI in each sector are established by the Financial Services Authority.
CHAPTER VII
TRANSITIONAL PROVISIONS
Article 18
LSPs that have received a recommendation from the Financial Services Authority before the implementation of this Financial Services Authority Regulation may continue the license approval process in accordance with applicable legislation.
Article 19
(1) LSPs that have received a license from BNSP before the implementation of this Financial Services Authority Regulation but do not yet have a Certification Scheme that is in accordance with the SKKNI established by the Ministry of Manpower and the KKNI established by the Financial Services Authority, submit an application for:
a. a recommendation letter as referred to in Article 5 paragraph (2); and
b. LSP registration to the Financial Services Authority as referred to in Article 9.
(2) LSPs that have received a license from BNSP before the implementation of this Financial Services Authority Regulation and
have a Certification Scheme that is in accordance with the SKKNI established by the Ministry of Manpower and the
KKNI established by the Financial Services Authority, submit an application for LSP registration to the Financial Services Authority as referred to in Article 9.
(3) Parties that issue certificates of competency proof and/or proficiency that have received recognition from the Financial Services Authority before the implementation of this Financial Services Authority Regulation, submit an application for a recommendation letter as referred to in Article 5 paragraph (1) and submit an application for LSP registration to the Financial Services Authority as referred to in Article 9.
(4) The submission of applications as referred to in paragraph (1), paragraph (2), and paragraph (3) is carried out within a maximum of 6 (six) months from the implementation of this Financial Services Authority Regulation.
(5) LSPs as referred to in paragraph (1) and paragraph (2) as well as parties as referred to in paragraph (3) remain
able to carry out certification activities in the financial services sector until the time period as referred to in paragraph (4).
(6) In the event that LSPs as referred to in paragraph (1) and paragraph (2) as well as parties as referred to in paragraph (3)
do not submit applications:
a. recommendation letters to the Financial Services Authority as referred to in Article 5 paragraph (1) and paragraph (2); and/or
b. LSP registration to the Financial Services Authority as referred to in Article 9,
until the end of the time period as referred to in paragraph (4), they cannot carry out certification activities in the financial services sector.
Article 20
(1) Work competency certificates issued by LSPs as referred to in Article 19 paragraph (1) and paragraph (2) as well as certificates of competency proof and/or proficiency issued by parties as referred to in Article 19 paragraph (3) before the implementation of this Financial Services Authority Regulation are declared to remain valid and recognized.
(2) Work competency certificates issued by LSPs as referred to in Article 19 paragraph (1) and paragraph (2) as well as certificates of competency proof and/or proficiency issued by parties as referred to in Article 19 paragraph (3) for certifications carried out during the time period as referred to in Article 19 paragraph (4) are declared to remain valid and recognized.
(3) LSPs as referred to in Article 19 paragraph (1) and paragraph (2) as well as parties as referred to in Article 19 paragraph (3) report each certificate issued as referred to in paragraph (1) and paragraph (2) that still has a validity period to the Financial Services Authority within a maximum of 6 (six) months from the implementation of this Financial Services Authority Regulation.
CHAPTER VIII
CLOSING PROVISIONS
Article 21
At the time this Financial Services Authority Regulation comes into force:
a. Provisions of Article 14, Article 15, Article 16, Article 17, Article 19,
Article 21, and Article 22 paragraph (2) of Bank Indonesia Regulation Number 11/19/PBI/2009 concerning Risk Management Certification for Directors and Officials of Commercial Banks (State Gazette of the Republic of Indonesia Year 2009 Number 80,

Article 22
This Financial Services Authority Regulation comes into force on the date of its promulgation.

CONCERNING
THE MANAGEMENT OF PROFESSIONAL CERTIFICATION AGENCIES IN THE FINANCIAL SERVICES SECTOR
I. GENERAL
To realize sustainable, stable, and contributive Financial Institutions, competent and innovative human resources are required. One of the efforts made to enhance this competence is by formulating competency standards required for human resources in the financial services sector. The Financial Services Authority is interested in promoting the application of competency standardization through regulations on certification obligations for specific positions/professions in the banking sector, capital market, insurance sector, pension funds, financing institutions, and other financial services institutions. Fulfillment of these competency certification obligations is obtained through Work Competency Certification referring to the National Competency Standards (SKKNI) established by the Ministry of Manpower of the Republic of Indonesia and the Indonesian National Qualifications Framework (KKNI) established by the Financial Services Authority.
Certification implementation is carried out by LSPs operating in the financial services sector and registered with the Financial Services Authority. The certification obtained is one of the mandatory requirements to meet the propriety and suitability assessment criteria required by the Financial Services Authority to become management, professional expertise, or managerial positions in Financial Institutions.
To support the continuous implementation of certification in the financial services sector according to needs, regulations on the management of LSPs in the financial services sector are required. The management process involves a mechanism for issuing recommendations for LSPs that will apply for licenses to BNSP and issuing registration certificates with the Financial Services Authority.

The term "banking sector" refers to all banking activities based on the scope of regulation and supervision of banking by the Financial Services Authority as regulated in statutory regulations. Banking activities outside the scope of regulation and supervision by the Financial Services Authority, such as payment systems, management of Rupiah funds, and other activities, are subject to regulations of other competent authorities.
