The Financial Services Authority amends Article 2 of Regulation 44/POJK.03/2017 to create exceptions to the prohibition on commercial banks providing credit or financing to developers for land acquisition and processing. These exceptions allow such financing for the construction of simple houses (including non-storied, multi-story, shophouses, and traditional market stalls) and land processing for residential development, provided specific conditions are met, such as dedicating at least 90% of land area to residential use and initiating construction within one year. The regulation mandates that disbursements be made in stages based on project progress and prohibits financing for commercial areas. This regulation entered into force upon its promulgation on August 16, 2018.

I. GENERAL
To increase Indonesia's economic growth, efforts are needed to drive the intermediary function of banking through adjustments to regulations regarding restrictions on the provision of Credit or Financing by Banks for Land Acquisition and/or Land Processing. The adjustment of these regulations is expected to increase the potential for expansion of Bank Credit or Financing in a measurable manner while still observing the principle of prudence. The aforementioned regulations are focused on driving the growth of Credit or Financing in priority sectors, namely the housing sector.
