FINANCIAL SERVICES WITHIN THE FRAMEWORK OF THE HEALTH EMERGENCY B.C.R.A. DECLARED BY DECREE No. 260/2020 CORONAVIRUS (COVID-19)
Section 2. Other provisions.
Balances that are unpaid between 13.4.2020 and 30.4.2020 must be automatically refinanced for a minimum term of one year with a 3-month grace period in 9 equal and consecutive monthly installments, and may only accrue compensatory interest, and no other surcharge, which may not exceed that established in point 2.1.1. of the regulations on “Interest rates in credit operations”.
Those refinanced balances may be prepaid, in whole or in part, at any time and at no cost –except for the compensatory interest accrued up to the prepayment– when the client requests it.
Institutions must incorporate the unpaid installments corresponding to maturities occurring between 1.4.2020 and 30.9.2020 starting from the month following the end of the life of the credit, inclusive, considering the accrual of the compensatory interest rate.
In the case of mortgage loans on single homes and pledge loans updated by UVA, the client may opt for this scheme or for the one provided in Decree No. 319/2020.
Credit assistance granted to the financial sector is excluded from this point.
Financial institutions must grant the peso financings “Crédito a Tasa Cero” and “Crédito a Tasa Cero Cultura” provided for in Decree No. 332/2020 (and amendments) to all clients who request them.
For the purposes of verifying who is eligible, for up to what amount and at which institution, institutions must only consult the list of beneficiaries made known by AFIP. In addition, for the “Crédito a Tasa Cero Cultura” the applicant must not have accessed the “Créditos a Tasa Cero”.
From the moment the application is submitted, the financial institution will have up to 2 business days to proceed with the crediting of the financing.

These financings must be credited to the credit card –issued by the institution– of the applicant for the financing; all financial institutions must allow these clients to request the “Créditos a Tasa Cero” and “Créditos a Tasa Cero Cultura” through Internet banking –“homebanking”–. If the applicant does not have a credit card, the financial institution listed in the AFIP list must:
issue a credit card with a purchase limit at least equal to the financing credited, and no cost may be charged for the issuance of that card or for its maintenance, except in the latter case where the client makes purchases for amounts exceeding the credited amount or, once the financing is paid off, wishes to keep the card; or
proceed to open a “Demand account for purchases in stores” – point 3.9. of the rules on “Savings deposits, salary account and special accounts” –;
keep the product active – credit card or demand account for purchases in stores – until the total cancellation of the “Zero Rate Credit” or “Zero Rate Culture Credit”, unless the client expressly requests cancellation;
allow these clients to process this application entirely through the use of electronic communication mechanisms.
When the institution must issue the card to the client, it must arrange the means to prioritize its delivery in the shortest possible time.
The financing must be disbursed in three equal and consecutive monthly credits; the available credit limit will be increased by the amount of each credit. From the moment of the first credit and until the total cancellation of the “Zero Rate Credit” or “Zero Rate Culture Credit”, the possibility of obtaining cash advances with the card will be prohibited.
In each of those credits, the amount equivalent to the payment of the total sums that must be paid for the resulting monthly periods as integrated tax and pension contributions payable by taxpayers adhering to the Simplified Regime for Small Taxpayers or mandatory pension contributions of the self-employed workers regime will be added. The referred amount will be withheld and deposited by the financial institution in the AFIP.
The “Zero rate credit” will have a grace period of 6 months from the first credit. From the following month, it will be repaid in at least 12 equal and consecutive monthly installments.
The “Zero rate culture credit” will have a grace period of 12 months from its first credit. From the thirteenth month, it will be repaid in at least 12 equal and consecutive monthly installments.

FINANCIAL SERVICES IN THE FRAMEWORK OF THE HEALTH EMERGENCY B.C.R.A. ORDERED BY DECREE N°260/2020 CORONAVIRUS (COVID-19)
Section 2. Other provisions.
In the event of partial payment of the settled credit card balance, the funds received by the financial institutions must be applied first to the cancellation of these installments.
The corresponding account statement must report the collection of each installment as a separate and duly identified concept.
The interest rate that FONDEP will recognize to financial institutions, as provided in article 9°bis of Decree N°332/2020, will be 15 % nominal annual on the balances of the disbursed financings.
The financial institutions covered by the first paragraph of point 8.3. of the rules on “Spot and forward operations, repos, collateral, other derivatives and with mutual investment funds” must grant financings to MSMEs – according to the definition contained in the rules on “Determination of the condition of micro, small or medium enterprise” – that are not reported in the “Central de deudores del sistema financiero”, at a nominal annual interest rate of up to 24 %, when they are presented with a FOGAR guarantee, for the amount covered by said guarantee.
The BCRA, through the site https://www3.bcra.gob.ar, makes available to financial institutions the list of MSMEs provided by the Ministry of Productive Development of the Nation, without prejudice to which financial institutions may include others as long as they meet the requirements provided in the rules on “Determination of the condition of micro, small or medium enterprise”.
Financial institutions must grant the “Subsidized Rate Credits for Companies” provided in Decree N° 332/2020 (and amendments) to all companies that request them, provided they are included in the list of beneficiaries to be published by the Federal Administration of Public Revenues (AFIP).
These financings will be in pesos and must be credited to the salary accounts – Section 2. of the rules on “Savings deposits, salary account and special accounts” – of their workers; this credit may be made directly or indirectly – with credit to the company's account, for subsequent debit to the salary accounts –. If the worker does not hold any salary account, the financial institution must proceed to open one.
From the moment the application is received, the financial institution will have up to 5 business days to proceed with the crediting of the financing.
The interest rate will be determined based on the positive nominal year-on-year variation in the company's billing with respect to the same period of the previous year based on the aforementioned list:
