FIRST RESOLUTION OF MODIFICATIONS TO THE GENERAL FISCAL RESOLUTION FOR 2024 AND ANNEXES 1, 1-A, 9, 11, 14, 15, 23, 29 and 30

The Tax Administration Service, based on articles 16 and 31 of the Organic Law of the Federal Public Administration; 33, fraction I, subsection g) of the Federal Tax Code; 14, fraction III of the Tax Administration Service Law and 8 of the Internal Regulations of the Tax Administration Service, resolves:

FIRST. The Glossary, fraction II, item 48, as well as rules 2.1.29., second paragraph, fractions III and VII; 2.1.50.; 2.4.6., second paragraph; 2.8.3.2.; 2.11.1.; 3.10.5., fraction IX; 3.13.34.; 3.16.11.; 5.2.23., third paragraph; 11.1.3., current second paragraph and 11.11.6.; are reformed; item 14 is added to the Glossary, fraction III, as well as rules 2.4.11., fraction XII; 2.8.3.6.; 11.1.3., second paragraph, moving the current second paragraph to become third; 11.11.8., second paragraph, moving the current second and third paragraphs to become third and fourth, respectively; and Chapter 11.14, which comprises rules 11.14.1 to 11.14.4, is added; and rule 2.13.13., first paragraph, fraction I of the General Fiscal Resolution for 2024, is repealed, to remain as follows:

Option to make advance payments, by period or fiscal year of tax credits

2.1.50.

For the purposes of articles 20, eighth paragraph, 31, first paragraph and 145 of the CFF, taxpayers who have tax credits controlled by the tax authority for collection and pending payment, firm or not, may make advance payments thereof, being able to choose the type of contribution or benefit by which they wish to make the payment, which will be applied in the order established in the cited article 20.

Taxpayers who make advance payments must make the request in accordance with the procedure form 317/CFF "Request for capture line for advance payments, by period or fiscal year of controlled credits pending payment", contained in Annex 1-A. For this case, the tax authority will issue the response accompanied by the FCF (capture line) to make the payment within the term provided for such effect.

The payment made through the FCF (capture line) does not limit the authority in the exercise of its attributes to initiate or continue with the administrative execution procedure, regarding the other unpaid concepts.

Presentation of the ISR declaration of the fiscal year by liquidation for legal entities of the general law regime

2.8.3.2.

For the purposes of articles 9th, 11 and 31 of the CFF and 12, first paragraph of the ISR Law, taxpayers who tax under the terms of Title II of the said Law, who enter liquidation and must present the declaration of the fiscal year by early termination, must do so through the annual declaration corresponding to the regime in which they are taxing.

The annual declarations for each fiscal year in which they are in liquidation or the final declaration of the liquidation fiscal year must be presented through the application "Present your annual declaration legal entities. General regime fiscal years 2019 and later".

2.8.3.6.

For the purposes of articles 9th, 11 and 31 of the CFF and 12, first paragraph of the ISR Law, taxpayers who tax under the terms of Title II, Chapters VI, VII and VIII of the said Law, who enter liquidation, must present both the declaration of the fiscal year by early termination, as well as the annual declarations for each fiscal year in which they are in liquidation or the final declaration of the liquidation fiscal year, through the application "Present your annual declaration of legal entities".

Legal entities of Title III of the ISR Law, which dissolve, will present the declaration referred to in article 86, last paragraph of the said Law, through the application indicated in the previous paragraph.

CFF 9th, 11, 31, LISR 12

Request for installment payments

2.11.1.

For the purposes of articles 66, first paragraph and 66-A of the CFF and 65 of its Regulations, the request to pay in installments or deferred the omitted contributions and their accessories and/or the benefits and their accessories other than those incurred due to the import or export of goods or services, of tax credits controlled by the tax authority or those derived from the presentation of a declaration, will be presented in accordance with what is indicated in the procedure form 103/CFF "Request for authorization to pay debts in installments or deferred", contained in Annex 1-A or, if applicable, through the means authorized by the SAT to the federal entities.

The presentation of the request must be made at any time after the tax credits have been notified, and for the case of self-determinations or self-corrections, the request must be presented within ten business days following the day in which the declaration was presented.

Regarding tax credits controlled by the tax authority, prior to the presentation of the request for authorization of installment payments, the taxpayer must request the FCF (Capture Line), through the means indicated in rule 2.11.2., fractions I and III to make the initial payment of at least 20% of the total amount of the debt updated at the time of the request.

In those cases where the taxpayer must present declarations to self-determine or self-correct, they must make the initial payment of at least 20% of the total amount of the debt, through the FCF (capture line) that the declarations and payments system generates for them at the time of presenting the declaration.

The taxpayer must attach to their request for authorization of installment payments, the receipt of the initial payment of at least 20% of the debt, so that the authority validates it, and if having made the calculations determines a difference to be covered of the initial payment, it will send to the taxpayer within fifteen business days following the date of the request, the FCF (capture line) through their tax mailbox so that they proceed to pay said difference, within the validity indicated in the FCF (capture line).

When the taxpayer does not comply with any of the requirements indicated in the procedure form 103/CFF "Request for authorization to pay debts in installments or deferred", contained in Annex 1-A, the authority, within the term of fifteen business days following the date of the request, will send a requirement to the taxpayer so that, in a term of five business days following the day in which the notification of said requirement takes effect, they comply with the omitted requirements.

The tax authority will issue the corresponding authorization resolution once the initial payment of at least 20% has been made and the rest of the requirements, if any, required by the tax authority have been complied with in time.

When the taxpayer does not meet the requirements for the authorization of installment payments to proceed, the authority will send the resolution of non-authorization of the request, in accordance with the following:

Within fifteen business days following the date on which the taxpayer complied with the requirement made by the authority,

Within fifteen business days following the date of expiration of the term to comply with the requirement when it was not attended, or

III.

Within fifteen business days following the date of the request, in case it was not necessary to require the taxpayer for missing information, nor initial payment.

The notification of the resolution of authorization or non-authorization of installment payments will be made through the tax mailbox, and if applicable, by any other of the means indicated in article 134 of the CFF.

For the cases of authorization, the resolution will include the FCF (Capture Lines) of the authorized installments, for the purpose that the taxpayer makes the punctual payment of each installment monthly and successively.

When the taxpayer does not pay any installment on time, they must request a new FCF (capture line) that includes the update and surcharges for delay applicable for the respective payment, which they must request at the closest ADR to their fiscal domicile for physical delivery, or through "My Portal" through a case of "Service or requests".

Regardless of the installment number indicated by the FCF (capture line), the payments made during the validity of the authorization will be applied to the oldest pending installment to be covered, including, if applicable, the update and surcharges for late payment.

An installment will be considered not fulfilled in time and amount when:

It is not paid no later than its due date.

The amount paid no later than its due date, is less than the authorized.

III.

It is paid with the update and surcharges for delay late.

When the SAT detects any of the causes indicated in article 82-Quater, section A of the ISR Law and initiates the procedure for revocation of the authorization to receive deductible donations, at the request of the civil organization or trust, it may extend up to two times the term granted to comply with the requirement established in section B, fraction I of the same legal provision, for periods equal to the original term, provided that it is requested prior to the expiration of said term. The extension will be understood as granted without the need for an express pronouncement by the authority and will begin to be counted from the next business day after the day on which the term to comply with the requirement expires.

Resumption of activities in the RFC of taxpayers inactive suspended from the Simplified Trust Regime

3.13.34.

For the purposes of articles 113-E, third paragraph and 113-I, second paragraph of the ISR Law, when the tax authority suspends taxpayers who are natural persons who tax under the terms of Title IV, Chapter II, Section IV, because it has been detected that in a fiscal year, they did not issue fiscal receipts, did not present any monthly payment, nor the annual declaration of the fiscal year; the suspended taxpayers may resume their fiscal situation by presenting the notice of resumption of activities in terms of rule 3.13.2.

3.16.11.

For the purposes of article 239 of the Regulations of the ISR Law, the accumulation factor applicable to the amount of the deposit or investment at the beginning of the fiscal year of 2023, is 0.0000.

Removal from the register of alcoholic beverage taxpayers in the RFC

5.2.23.

The tax authority will issue the resolution within the term of five business days counted from the next business day, to the one in which the clarification referred to in the previous paragraph has been presented, with the elements it has, which will be notified through the tax mailbox. After the term referred to in the previous paragraph has passed, without the taxpayer presenting their case of clarification in accordance with the procedure form 56/IEPS "Clarification to remedy or disprove the causes prior to removal from the Register of Alcoholic Beverage Taxpayers in the RFC", contained in Annex 1-A, the tax authority will proceed to issue the resolution in which it records the corresponding removal from the said register, which will be notified through the tax mailbox.

Loss of the right to apply fiscal stimuli in matters of ISR and IVA

11.11.6.

For the purposes of articles Sixth, fourth paragraph and Tenth, seventh paragraph of the Decree referred to in this Chapter, it will be understood that the right to apply the fiscal stimuli, consisting of the tax credits established in the cited articles, is lost when in the normal declaration or in the complementary declaration of "Obligation not presented", of the fiscal year or monthly of provisional or definitive payment, as appropriate, having tax incurred or to be paid, respectively, the cited credits are not applied; the loss of the right will only apply to the fiscal year or to the month, respectively, in which the stimulus was not applied, without it being able to be applied subsequently in any other fiscal year or month.

Chapter 11.14. Of the Decree by which various fiscal benefits are granted to taxpayers of the affected areas indicated, due to severe rains and strong winds on October 24, 2023, published in the DOF on December 13, 2023

Procedure to apply the corresponding fiscal benefits for the months of October and November 2023

11.14.1.

For the purposes of articles First, Second, Third and Fourth of Decree OTIS II, taxpayers who opt to apply the fiscal stimuli and who on the date of its entry into force had presented the corresponding declarations for the months of October and November 2023 and paid the taxes incurred, may apply the cited stimuli through the "Complementary" declaration of type "Modification of Obligations" attending to what is established in rule 2.8.3.3.; taxpayers who tax in the RIF, in accordance with what is provided in Title IV, Chapter II, Section II of the ISR Law in force until December 31, 2021, may also apply the cited stimuli by presenting the respective declaration.

In the event that the taxpayers indicated apply the fiscal stimuli in the terms of the previous paragraph, they may decrease the amounts they had effectively paid in the periods indicated in said paragraph, for the concept of the contributions referred to in articles First, Second, Third and Fourth of Decree OTIS II, of which it corresponds to pay the same tax, and in the case of IEPS it corresponds to goods of the same class, in the provisional or definitive payment corresponding to the month of March 2024, or to the second bimester of said fiscal year, as appropriate, or in the subsequent ones until exhausting them.

Application of fiscal stimuli in matters of ISR, IVA and IEPS

11.14.2.

For the purposes of articles First, Second, Third and Fourth of Decree OTIS II, taxpayers who have opted to apply the payment deferral facilitities for the months of October, November and December 2023, or in their case, fifth and sixth bimester of the fiscal year 2023 regarding taxpayers who tax in the RIF in accordance with what is provided in Title IV, Chapter II, Section II of the ISR Law in force until December 31, 2021, referred to in articles Second, Third and Fifth of Decree OTIS, as well as rules 11.13.2. and 11.13.3., may apply the fiscal stimuli in matters of ISR, IVA and IEPS, at the time of presenting the declarations referred to in the cited rules.

11.14.3.

For the purposes of articles First, third paragraph, Second, last paragraph, Third, third paragraph and Fourth, last paragraph of Decree OTIS II, it will be understood that the right to apply the fiscal stimuli established in the cited articles is lost when in the normal declaration or in the complementary declaration of "Obligation not presented", of provisional or definitive payment, according to the periodicity that corresponds to it, as well as of the fiscal year, as appropriate, having tax to be paid, the stimuli are not applied. The loss of the right will only apply to the respective period in which the stimulus was not applied, without it being able to be applied subsequently in any other period.

Decree OTIS II DOF 13/12/2023 First, Second, Third, Fourth

Application of the tax credit in provisional payments

11.14.4.

For the purposes of article Second, second and third paragraphs of Decree OTIS II, the provisional payments of ISR corresponding to the months of January and February 2024, in which the tax credit referred to in said article is applied, will be creditable in the determination of the subsequent provisional payments of that same fiscal year.

The provisional payments of the months of January and February 2024, to which the tax credit referred to in the first paragraph of this rule has been applied, will not be creditable in the determination of the ISR of the fiscal year 2024 in which the fiscal stimulus indicated in the previous paragraph is applied.

Decree OTIS II DOF 13/12/2023 Second

SECOND.

In accordance with what is provided in article 5th. of the Federal Law of the Rights of the Taxpayer, the updated text of the rules referred to in Resolutive First of this Resolution, may be consulted in the SAT Portal.

THIRD.

Annex 9 of the RMF for 2024, the First Modification to Annexes 1, 1-A, 11, 14, 23, 29 and 30 of the RMF for 2024, as well as the Seventh Modification to Annex 15 of the RMF for 2022, are made known.

FOURTH.

Transitory Articles Eighth and Twenty-Sixth of the General Fiscal Resolution for 2024, published in the DOF on December 29, 2023, are reformed, to remain as follows:

Eighth.

For the purposes of article 134, fraction I, penultimate paragraph of the CFF and rule 2.5.4., when

los contribuyentes requieran consultar información de notificaciones electrónicas a través de

buzón tributario asociadas al RFC anterior, deberán solicitarlo mediante un caso de aclaración

en el Portal del SAT, utilizando la etiqueta Buzón Tributario, hasta en tanto se visualicen en su

buzón los documentos asociados a la clave del RFC anterior.

Vigésimo

Sexto.

Para los efectos de la regla 3.11.4., hasta en tanto se libere el sistema para la consulta de

enajenaciones de casa habitación en el Portal del SAT, se tendrá por cumplida la obligación del

fedatario público de efectuar la consulta a que se refiere el artículo 93, fracción XIX, inciso a),

último párrafo de la Ley del ISR, siempre que en la escritura pública correspondiente, se incluya

la manifestación del enajenante en la que, bajo protesta de decir verdad, señale si es la primera

enajenación de casa habitación efectuada en los tres años inmediatos anteriores a la fecha de

esta enajenación.

Transitorios

Primero.

La presente resolución entrará en vigor el día siguiente al de su publicación en el DOF. Por lo que se refiere

a las disposiciones dadas a conocer de manera anticipada en el Portal del SAT, su contenido surtirá sus

efectos en términos de la regla 1.8., tercer párrafo.

La Primera Modificación al Anexo 23 de la presente Resolución, surtirá sus efectos a partir del 1 de mayo de

2024.

Segundo.

Para los efectos del artículo 113-G, fracción II de la Ley del ISR y de la regla 3.13.36, el cumplimiento de la

obligación de contar con buzón tributario habilitado, será aplicable a partir del 1 de enero de 2025.

Tercero.

Para los efectos del artículo 113-G, fracción II de la Ley del ISR y de la regla 3.13.37, el cumplimiento de la

obligación de contar con e.firma, será aplicable a partir del 1 de enero de 2025.

Article 29 Bis of the CFF states that CFDIs must comply with the specifications in matters of informatics

they must validate that the document complies with the technical specification of Annex 20.

and data " , included in fraction I of this Annex, and that CFDI certification providers are obligated to comply with

in accordance with rule 2.7.2.8. fractions VI and XV. Non-compliance with rule 2.7.2.8., fraction VI, is a cause for

revocation in terms of rule 2.7.2.12., fraction I, subsection b).

"Complement for payment receipt" being able to register in the "Description" field of the CFDI to which the complement is incorporated, the description and indication of the operation by which the right to collect the ceded charge originated, as well as the number, name or identifier that the document or documents supporting, proving or identifying the collection rights subject to the financial factoring operation have.

For the purposes of the preceding paragraph, certification providers may not consider the validation rule for the "Description" field of the "Element: Receipt", consisting of "For this attribute the value 'Payment' must be registered", contained in the standard for the payment receipt complement. "

Certification providers are obligated to perform the validations included in the reviews of CFDIs and their complements published by the SAT on its Internet page, as well as to observe what is established and made known through communications issued by the SAT to them.

VII.

Graphic usage guidelines for the logo for authorized CFDI certification providers and functional requirements, general services and minimum service levels.

In this section, the graphic usage guidelines for the logo granted by the SAT to certification providers and the functional requirements, general services and minimum service levels for the use of this logo are indicated, in order for them to comply with the obligation established in rule 2.7.2.8., fraction XXI, consisting of publishing on their Internet page the official logo that accredits authorization to operate as a certification provider provided by the SAT.

VII.1.

Logo for authorized CFDI certification providers.

The logo for authorized CFDI certification providers, granted by the SAT, is registered with the Mexican Institute of Industrial Property.

The Opinion on the Use of Image and Design for CFDI Certification Provider is granted to the company that obtained authorization from the SAT to operate as a certification provider, and the logo will include the authorization number assigned to said provider.

The logo granted by the SAT to authorized CFDI certification providers must be implemented on the provider's Internet page in a visible place, in the section where it informs about the billing certification services it offers.

The logo authorized by the SAT and granted to authorized CFDI certification providers is non-transferable and inalienable and cannot be used by third parties.

The logo granted by the SAT to authorized CFDI certification providers is for exclusive use for its incorporation in the authorized certification provider's Internet page and in its stationery. Any use other than that expressly indicated in this document is prohibited.

The use of the logo for personal purposes or purposes unrelated to the certification process, contained in article 29 Bis, fractions I, II and III of the CFF, for which the SAT granted authorization to operate as a certification provider, is strictly prohibited.

Certification providers that require using the logo in media other than their electronic page and the company's stationery, such as: advertising media, including backs and invitations for events, as well as in audiovisual and digital media, must request permission from the ACGSTME of the SAT with a minimum advance of fifteen business days, using for this purpose the procedure form 114/CFF "Notices from the CFDI certification provider" from Annex 1-A, who will proceed to consult and validate with the Central Administration of Institutional Communication. The request for authorization to use the logo in media other than those indicated in this document must indicate the place, medium, format and date on which it is required to be used.

The SAT reserves the right to authorize or deny the use of the logo to the provider in applications or in media other than its electronic page and its printed stationery or digital documentation related to the object of the authorization granted by the SAT to operate as a certification provider.

As part of the implementation of the distinctive image (logo of authorized CFDI certification providers), these functional requirements, general services and minimum service levels are issued, in order to guarantee the correct use of the distinctive image.

The distinctive image (logo of authorized CFDI certification providers) must be implemented within five natural days following the date of receipt of the Opinion on the Use of Image and Design for CFDI Certification Provider.

The information on the type of Hydrocarbons or Petroleum Products corresponding to each operation of receipt, delivery or inventory control must be obtained from:

Laboratory opinions issued in conformity and in the periodicity referred to in Annex 32 "Of the characteristics that the opinions determining the type of hydrocarbon or petroleum product, the calorific power of natural gas and the octane rating in the case of gasoline must contain".

Instruments installed online for chromatography or density, verified by providers accredited by the competent instance, must obtain the data referred to in section 30.6.1.2.3. of this Annex.

The information on the type of Hydrocarbons or Petroleum Products that must be registered and stored in the UCC is that established in section 32.4. of Annex 32 "Of the characteristics that the opinions determining the type of hydrocarbon or petroleum product, the calorific power of natural gas and the octane rating in the case of gasoline must contain".

III.

The taxpayer is responsible for ensuring that the capture of information on the type of Hydrocarbons or Petroleum Products is carried out correctly.

The taxpayers referred to in rule 2.6.1.2. must register the information relating to the type of hydrocarbon or petroleum product in question, whether from laboratory opinions, from online instruments for chromatography or density, or from the information provided by other subjects of the aforementioned rule, which they obtain in accordance with Annex 32 "Of the characteristics that the opinions determining the type of hydrocarbon or petroleum product, the calorific power of natural gas and the octane rating in the case of gasoline must contain".
