When registering Interchange Fees for Card Payments in terms of what is stated in the preceding paragraph, the justification supporting the respective charge must be attached.

The Authorities will resolve definitively on the Interchange Fee for Card Payments and may order that its amount or the manner of its determination be modified and, consequently, the corresponding registration will be updated. For the above resolution, the Authorities will consider the

13th. 15th. Participants in Networks shall be considered persons who maintain databases to provide information to Participants in the Card Payment Network, including identification numbers.

The foregoing does not limit the possibility of offering service and product packages provided that these are not offered at a price different from the sum of the price of those individually. c) Define minimum standards for Payment Recipients they affiliate with the objective of complying with the requirements of the Card Payment Network in which they participate. d) Have operational, regulatory, and financial audit programs that allow them to prevent Payment Recipients they affiliate with from violating the Conditions for Participation in Card Payment Networks. e) Provide in the contracts they enter into with Aggregators the obligation of these to receive home visits by the Authorities, to verify compliance with the provisions applicable to them, as well as to allow both the Authorities and the respective Acquirers access to the responsible personnel and their offices and facilities in general, related to the provision of the service in question. f) Employ standards that allow interoperability within the Card Payment Network, regardless of the POS terminal used, as well as between Card Payment Networks, and use technology that has the capacity to allow the installation of applications and certificates for the acceptance of Card Payments from other Brand Owners. g) Allow Aggregators to use more than one identifier linked to their affiliation number according to the conditions applicable to Interchange Fees.
VI. Issuers must register and certify the characteristics of their Cards with the Brand Owners, being able to rely on Specialized Companies for such purposes.
VII. Brand Owners must:

The foregoing does not limit the possibility of offering service and product packages provided that these are not offered at a price different from the sum of the price of those individually. e) Refrain from imposing any differentiated charge or commission on Issuers, Acquirers, Aggregators, or Specialized Companies for operations related to Card Payments depending on whether they have been processed or not through Clearing Houses for Card Payments operated by the Brand Owner itself. f) Refrain from imposing differentiated charges or commissions based on the volume of operations related to Card Payments. g) Make available to potential clients or counterparties, subject to confidentiality agreements they agree upon, the Conditions for Participation in Card Payment Networks regarding the use of the brand. Establish technological and operational conditions that do not hinder the entry of competitors in the provision of applications and technological infrastructure and additional services such as compliance certification standards, telecommunications services, among others. h) Establish standards that allow interoperability for all Issuers and Acquirers of the Card Payment Network, regardless of the POS terminal used, as well as between Card Payment Networks, and use technology that has the capacity to allow the installation of applications and certificates for the acceptance of Card Payments from other Brand Owners. i) Establish minimum requirements regarding the surveillance, detection, and prevention of events that deviate from the usual usage parameters of Cardholders, including fraud, which their Acquirers and Issuers must comply with. Such programs must be available to the Authorities at all times. j) Establish POS terminal, Card, and application certification procedures that Issuers and Acquirers must comply with to ensure the correct operation of Cards with their brand. Such procedures must be available to said Issuers and Acquirers, and have service providers other than the Brand Owners. k) Establish and make public the criteria and standards regarding the services they offer to Acquirers, Aggregators, and Specialized Companies. Such criteria and standards will be subject to the supervision of the Authorities, who may order corrections at any time when they
determine that said criteria and standards are contrary to the principles referred to in fractions I to IV of article 4 Bis 3 of the Law. l) Respond regarding the settlement of Card Payments of their brand duly processed between Acquirers and Issuers, in terms of what was agreed, regardless of the Clearing Houses for Card Payments that have performed their processing. m) Brand Owners must have schemes that guarantee the settlement of the obligations of Issuers and Acquirers for the corresponding Card Payments in case of non-payment by one of them. n) Promote the formation of working groups with other Participants in the Card Payment Network whose objective is to determine the adoption of new technologies or best practices, create more efficient standards, or any other activity that promotes the growth of the Card Payment Network in which they participate.

CONSIDERING
(April 2, 2015)
That as a result of the identification program carried out by the National Banking and Securities Commission in terms of article Fifth, fraction VI of the Decree by which various provisions in financial matters are reformed, added, and repealed and the Law to Regulate Financial Groupings is issued, published in the Official Gazette of the Federation on January 10, 2014, participants in networks were recognized, and it is necessary to specify the subjects that will be classified as relevant disposition media network participants, and
That in view of the aforementioned and that the card payment network is the one identified and all its participants are relevant for the functioning of said network, considering the activities they perform, they have resolved to issue the following:
CONSIDERING
(April 27, 2026)
That the National Banking and Securities Commission has as its objective to supervise and regulate, within the scope of its competence, the entities and institutions comprising the Mexican financial system and other natural and legal persons, in order to ensure their stability and proper functioning, as well as to maintain and foster the healthy and balanced development of said system as a whole, in protection of the public's interests.
That the Bank of Mexico has within its objectives to promote the healthy development of the financial system and to foster the proper functioning of payment systems.
That in terms of what is established in article 4 Bis 3 of the Law for Transparency and Ordering of Financial Services, said authorities, jointly, must issue general provisions to regulate the terms and conditions under which services related to disposition media networks are provided, as well as the interchange fees charged directly or indirectly, except for services provided by the Bank of Mexico and those referred to in the Payment Systems Law.
That, in exercise of the powers referred to in the preceding considerations, the National Banking and Securities Commission and the Bank of Mexico jointly issued the “General Provisions Applicable to Disposition Media Networks”, published in the Official Gazette of the Federation on March 11, 2014 and modified, for the last time, by the resolution published in said dissemination medium on April 2, 2015, whose provision 10th establishes, verbatim, the following:
“10th. Interchange Fees for Card Payments must be included in the Conditions for Participation in Card Payment Networks and, for their validity, must be registered with the Authorities through the Payment Systems Directorate of the Bank of Mexico, at least thirty days before the date on which they are intended to be applied, through the Issuers, prior to consensus with Acquirers, Clearing Houses for Card Payments, and, if applicable, Brand Owners, or by a common representative designated for this purpose in said conditions.
When registering Interchange Fees for Card Payments in terms of what is stated in the preceding paragraph, the justification supporting the respective charge must be attached.”
That the Federal Government has promoted the management and negotiation of agreements with representatives of the gas station business sector, with the objective of protecting the consumer economy, and that participants in the card payment networks market have expressed interest in promoting the adoption of digital payments in key sectors of the economy, as well as improving the conditions of acceptance services for these payment methods.
That a broad sector of said participants has requested the National Banking and Securities Commission and the Bank of Mexico to temporarily flexibly the process for the registration of interchange fees, with the purpose of generating conditions that foster the adoption of card payments, as well as strengthen the traceability of operations in protection of the public's interests.
For the above, it is considered appropriate to temporarily flexibly the process for the registration of interchange fees for the commercial activity of gas stations in order to reduce operational burdens, expedite their adoption, as well as ensure a timely and coordinated response, without prejudice to the principles of security, transparency, and supervision applicable.
That the Board of Governors of the Bank of Mexico, within the scope of its competence, determined to exempt these modifications from the public consultation process, in order that, in a timely manner, the effects sought to be achieved with this resolution are produced.
