Guidelines on the assessment of resolvability (Article 15(5) of CCPRRR)

Resolution authorities must apply a common set of aspects when assessing the resolvability of central counterparties under the 26 matters specified in Section C of the Annex to Regulation (EU) 2021/23. The guidelines establish principles for materiality assessments based on significance, probability, and complexity, and provide specific criteria for evaluating core business lines, essential staff and infrastructure, service agreements, governance, and cross-border issues. Competent authorities are required to notify ESMA within two months of publication whether they comply with these guidelines or intend to comply, and must provide reasons for any non-compliance.
