Guidelines on the minimum list of services and facilities

The European Banking Authority specifies a minimum list of services and facilities that resolution authorities should consider requiring to enable a recipient to operate a business transferred under Article 65(5) of Directive 2014/59/EU. The guidelines apply to resolution authorities and require them to assess on a case-by-case basis whether services such as human resources, information technology, transaction processing, real estate, legal services, treasury, trading, risk management, accounting, and cash handling are necessary to maintain essential internal infrastructure. Resolution authorities must ensure that the provision of these services, particularly treasury, trading, and risk management functions, does not imply the taking of financial risks constituting financial support. These guidelines apply as of 1 August 2015 and are subject to review by 31 July 2017.
