HDI Global SE: PRA financial penalty for misreporting FSCS Liabilities

1. Action
   1.1. For the reasons set out in this Notice, the Prudential Regulation Authority
   (“PRA”) imposes a financial penalty on HDI Global SE (the “Firm”) of £4,165,000 for breaches of:
   1.1.1. PRA Fundamental Rule 2 (A firm must conduct its business with due
   skill, care and diligence); and
   1.1.2. PRA Fundamental Rule 6 (A firm must organise and control its affairs
   responsibly and effectively), between 13 August 2021 and 31 August 2024 (the “Relevant Period”).
   1.2. The Firm participated in the PRA’s Early Account Scheme (“EAS”) under the
   PRA Settlement Policy, producing a fulsome and candid account (the “Account”). The Firm agreed to settle during the Discount Stage of the PRA’s investigation. While the Firm made candid admissions of fact, it did not make early admissions in relation to the potential breaches under investigation and did not, therefore, qualify for an enhanced settlement discount under paragraph 10.40 of the PRA Settlement Policy. Accordingly, the Firm qualified for a 30% settlement discount pursuant to the PRA Settlement Policy. Were it not for this discount, the PRA would have imposed a financial penalty of £5,950,000.
